Dear Mr. Anderholt:
This letter is in response to your oral request made to the undersigned and the request set forth in your letters of May 30, 1974. and September 13, 1974 Al
to our legal counsel, Maurice C. Sherrill.of Redwine and Sherrill, Attorneys
at Law, Riverside, California.
It is our understanding that your client is an owner of a parcel of real
property in Palm Desert, California, to be more specific, Cahuilla Hills, .
and must have some right of access to his property in order to obtain a
construction loan for the building of a residence thereof.
In the general Cahuilla Hills area, which is Improvement District No. 6 of
the Coachella Valley County Water District, the District has constructed and
- - is maintaining and operating a water system. In connection with the pipelines, :
in some instances, the District followed existing roads and in other instances
installed the pipelines where no roads existed and in the course of the
construction cleared a path which can be used by vehicles. In all instances, .
•';� - the District's pipelines are in rights of-way for pipeline purposes and the
maintenance and operation thereof obtained. from the owners of the underlying '
fee title to the lands involved.
The District claims no interest in the heretofore constructed roads or the -
areas cleared for pipeline. construction other than is absolutely necessary C '
for the District's purposes in the maintenance and operation of said pipelines.
Specifically, the District does not and will not maintain these roads and cleared
areas.
As to your client's use of a road or cleared area within the right of way
easement area secured by the District from private landowners, the District
will not prohibit your client's use thereof and, in fact, could not legally
as the right of way easements are non-exclusive. e

I. REQUEST:
That the City Council approve a Tentative Parcel ' a-p- and Waiver of the
Final Map to divide a 3.8 acre parcel into 2 lots of 2.4 and 1.4 acres.
II . RECOMMENDATION:
That the City Council approve Resolution No. 76-62 subject to the
attached conditions.
Justification is based upon:
1. Conformance of the Parcel Map _to the requirements of the
General Plan and Zoning .Ordinance.
2. Conformance of the Parcel Map. to the State Subdivision Map
Act and City Subdivision Ordinance.
3. The Parcel Map meets all the requirements of the Land Division
Review Committee.
III . BACKGROUND:
A. Description : Government Lot 39, Section 30
B. Location : The subject property is located in the hillside area west
of the Palm Valley Storm Channel , adjacent to the Palm
Desert City Limits.
C. Size: Lot 39 has 3.8 acres. It would be divided into 2 parcels of
2.4 and 1.4 acres.
D. Existing Zoning: RE-43,560, H.
E. Adjacent Zoning: RE-43,560,H on north, south and east.
F. EIR Finding: The project was evaluated with an Environmental Assessment ,
resulting in the finding that the project would not have a
substantial adverse 'impactaon the environment. The appeal
period has expired.
G. General Plan: The Palm Desert General Plan indicates this property to
be potential very low density residential (1-3 du/acre) .
H. Water: Coachella Valley County Water District
I. Sewer: Septic Tank
J. Telephone: General Telephone Company
K. Gas: Southern California Gas Company

IV. DISCUSSION:
The 3.8-acre site is situated in the 900-1000 foot elevation level of the
hillside area west of the Palm Valley Storm Channel . The maximum elevation
of the property .is approximately 500 feet above the level of Highway 74 at
a point parallel to the site, which is 3700 feet to the east. Access to
the site is provided by a gravel roadway which winds through Section 30
and emerges on Highway 74 at Bel Air Road.
The applicant's attorney has provided a copy of a letter submitted to the
Chicago Title Insurance Company written by the Coachella Valley County Water
District permitting access to Mr. Martin's property over the existing road-
way which is based on easements to provide .water service. The City will re-
quire a valid title insurance policy as a Condition of Approval .
Water service is already provided by the CVCWD. Sanitation service will be
by septic tank, subject to the requirements .of the California Regional Water
Quality Control Board. Trash pick-up is provided by Palm, Desert Disposal
at pick-up sites near Highway 74. ATI other utilities will be brought to the
site by underground line.
The applicant is proposing to upgrade the quality of the road leading to the
site, although it will not be surfaced in order to retain as natural an ap-
pearance as possible. Detailed construction plans will be subject to the
approval of the City Engineer.
The proposed Parcel Map has been reviewed by the City of Rancho Mirage and
the County of Riverside Planning Department. No adverse comments have been
received.
The site is mainly granite rock. The topography varies greatly with a major
ridge running diagonally through it. There is a surprising amount of native
vegetation, mostly small shrubs, in existence, even in areas with steep slope.
Approximately 55% of the site has a slope of 35q or more.
Parcel No. 2 has already been graded and there is an existing concrete slab.
The previous structure has been demolished and the area is littered with
broken glass, wood, and other debris. The applicant proposes to use the
southerly portion of the ridge to the west of the existing slab for the site
of a second residence. The driveway would be hidden by the existing access
road and would not be visible from Highway 74.
Because of the Hillside Overlay District, all grading and construction plans
will be reviewed under a Conditional Use Permit,

CONDITIONS OF APPROVAL
PARCEL MAP NO. 7794
1. This project shall conform substantially to the Parcel Map No. 7794,
labeled Exhibit A, and the requirements herein.
2. All requirements of any applicable law, ordinance, or regulation of the
State of California, City of Palm Desert, and any other applicable
government entity shall be complied with as a part of construction.
3. Legal access, as required by the Subdivision Ordinance, shall be provided
from the parcel map boundary to a dedicated public right-of-way. A copy
of a valid title insurance policy quaranteeing access shall be submitted
to the Department of Environmental Services prior to the issuance of any
building or grading permit.
4. The applicant shall provide an easement restricting in open space all
areas of both parcels which will not be used for building site or road-
way purposes. Said easement shall be shown on the Parcel Map and shall
be recorded as directed by the City Engineer and City Attorney.
5. No grading or construction permits of any kind shall be issued relative to
this project without a valid Conditional Use Permit first being in effect.
The approval of the Tentative Map does not imply or include approval of
any proposed Conditional Use Permit.
6. Sewerage disposal for individual systems will be permitted in accordance
with the requirements of the Riverside County Health Department and the
California Regional Water Quality Control Board, Colorado River Basin
Region, as stated in their letter dated April 16, 1976, a copy of which
is attached.
7. Road improvement plans shall be submitted to the City Engineer for review
as part of the Conditional Use Permit approval process. The applicant
shall agree in writing to join any assessment district created for road
improvement purposes.

MEETING OF MAY 4, 1976
D. CASE NO. CUP 06-76, JOMO DEVELOPMENT, INC. , Applicant
Request for a Conditional Use Permit to allow a 4-unit
planned residential development in the R-3 Zone, on pro-
perty located on Ocotillo Drive, north of Verba Santa Drive,
Paul Williams reviewed the applicant' s request, showed plans of
the project, and gave a detailed explanation of the background
including description, location, size, zoning, etc. He ended
his presentation of the request by giving staff's recommendation
that the Planning Commission approve Resolution No. 144, granting
the Conditional Use Permit for the above case.
JOHN OUTCAULT, 74-133 E1 Paseo, Palm Desert - Mr. Outcault, who
is the architect for the project, spoke to the Commission as a
representative of the owner. He stated the owner accepted all
13 Conditions of Approval with the exception of Condition No. 9
pertaining to undergrounding of utility lines. The owner's ob-
jection was mainly one of cost.
There being no-one present who wished to speak to the Commission
either in favor of or opposed to the project, Chairman Wilson
closed the Public Hearing and opened the case for discussion.
The general consensus of the Commi.ssion was that the applicant
could post a cash bond for their pro-rata share of the under-
grounding and requested staff to reword Condition No. 9 to re-
flect the above revision.
Commissioner Berkey moved to approve Planning Commission Resolu-
tion No. 144 with the above noted revision to Condition No. 9.
Commissioner Kelly seconded the motion. Motion carried unanimously.
E. CASE NO. PM 7794, CHARLES MARTIN, . Applicant
Request to divide a 3-acre parcel into two parcels, located
in Section 30.
Paul Williams reviewed the request for a parcel map and a waiver
of the final map for the above case. He also showed a map of the
location which explained the existing slope. He then went into the
issues of access and eventual development of the parcel . Further,
he stated tha the City of Rancho Mirage plus all the utility com-
panies had been contacted reference the case and that no objections
were received. He then recommended that the Planning Commission
approve Resolution No. 145 which recommended approval to the City
Council of PM 7794.
CHARLES MARTIN, 73-612 Highway 111, Palm Desert - Mr. Martin spoke
as the projects applicant and explained his request.
The public hearing was then closed as no-one was present who wished
to speak to the Commission either in favor of or opposed to the pro-
ject.
j Commissioner Kelly moved to adopt Planning Commission Resolution
No• 145 Commissioner. Van de Mark seconded the motion. Motion
carried unanimously.

Justification is based upon:
1. Conformance of the Parcel Map to the requirements of the

III . BACKGROUND:
A. Description : Government Lot 39, Section 30
B. Location: The subject property is located in the hillside area west
of the Palm Valley Storm Channel , adjacent to the Palm
Desert City Limits.
C. Size: Lot 39 has 3.8 acres. It .would be divided into 2 parcels of
2.4 and 1.4 acres.

F. EIR Finding: The project was evaluated with an Environmental Assessment,
resulting in the finding that the project would not have a
substantial adverse impact on the environment. The appeal
period has expired.

be potential very low density residential (1-3 dwelling
units per acre) .

Case No. PM 7794
IV. DISCUSSION:
The 3.8-acre site is situated in the 900-1000 foot elevation level of the
hillside area west of the Palm Valley Storm Channel . The maximum elevation
of the property is approximately 500 feet above the level of Highway 74 at
a point parallel to the site, which is 3700 feet to the east. Access to
the site is provided by a gravel roadway which winds through Section 30
and emerges on Highway 74 at Bel Air Road.
The applicant's attorney has provided a copy of a letter submitted to the
Chicago Title Insurance Company written by the Coachella Valley County Water
District permitting access to Mr. Martin' s property over the existing road-
way which is based on easements to provide .water service. The City will re-
quire a valid title insurance policy as a Condition of Approval .
Water service is already provided by the CVCWD. Sanitation service will be
by septic tank, subject to the requirements .of the California Regional Water
Quality Control Board. Trash pick-up is provided by Palm Desert Disposal
at pick-up sites near Highway 74. All other utilities will be brought to the
site by underground line.
The applicant is proposing to upgrade the quality of the road leading to the
site, although it will not be surfaced in order to retain as natural an ap-
pearance as possible. Detailed construction plans will be subject to the
approval of the City Engineer.
The proposed Parcel Map has been reviewed by the City of Rancho Mirage and
the County of Riverside Planning Department. No adverse comments have been
received.
The.-site is mainly granite rock. The topography varies greatly with a major
ridge running diagonally through it. There is a surprising amount of native
vegetation, mostly small shrubs, in existence, even in areas with steep slope.
Approximately 55% of the site has a slope of 35% or more.
Parcel No. 2 has already been graded and there is an existing concrete slab.
The previous structure has been demolished and the area is littered with
broken glass, wood, and other debris. The applicant proposes to use the
southerly portion of the ridge to the west of the existing slab for the site
of a second residence. The driveway would be hiddeh} by the existing access
road and would not be visible from Highway 74.
Because of the Hillside Overlay District, all grading and construction plans
will be reviewed under a Conditional Use Permit,

The Regional Board has reviewed parcel map No. 7794, relating to the
subdivision of a 3 .8 acre lot into 2 parcels for single family res-
idences. The Regional Board's policy on subsurface sewage disposal,
as it applies to the subject development, may be briefly stated as
follows :
1. Subsurface disposal is prohibited in areas which do not meet
the Minimum Criteria as set forth in Section IV of the"Guide-
lines for Sewage 711sp_os:all From Land Developments" , a copy of
which is enclosed for your consideration.
2. The Board requires that sufficient land area of suitable
quality be available to provide for treatment and disposal
of 100% of the maximum design flow of waste water.
The suitability of the land for subsurface disposal and. the
land area required for said disposal shall be determined by
this Board in consultation with the County Health Department .
The maximum design flow shall be the best available estimate
of the maximum flow to the system as determined by this
office.
3 . An additional parcel of land, equivalent to that described in
No. 2, above, is required to be available should extension
or replacement of treatment and disposal facilities be
necessary for any reason.
4. For single family residences utilizing individual subsurface
disposal systems, a minimum lot area of '20,000 square feet
is required.

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur—
rent tariffs as approved by the California Public Utilities Commission.
The developer will be required to deposit the full cost of these facili—
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the esthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.

B. The date of filing a tentative map shall be fixed when all of the maps
and information requiredby the Subdivision Map Act and Land Division
Ordinance No . 460 have been filed and the required fee is paid.

C. The Planning Commission shall take no action on a tentative map
until at least 15 days after the date of filing (Section 4 . 4)
D. Within 50 days after filing , the Planning Commission shall approve ,
conditionally approve , or disapprove the tentative map. The time
limit may be extended beyond the 50 days with mutual agteement of the
land divider and the City (Section 4 . 9)
E. The land divider may request a waiver of filing a final parcel map
when the land division is 4 or less parcels under 60 acres , or where
the parcels each have a gross area of not less than 40 acres or each

land divider prior to consideration by the Planning Commission . (Section 1 .2)
I . The final map may then be submitted to the City Engineer (County
Surveyor's office) for checking pursuant to Ordinance 460 and to Section
11575 through Section 11580 of the Subdivision ;dap Act , unless waived by
the Planning Commission . (Section 6 . 1)
J. The Planning Commission will act on tentative .maps and send its
recommendation directly to the land divider and his engineer. The land
divider is allowed one year in which to record a final map. An extension
of one year can be obtained by a written application addressed to the
Planning Commission 30 days prior to the expiration date.

WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from CHARLES MARTIN requesting approval of a Tentative Parcel
Map and Waiver of a Final Map for a lot split on 3.8 acres of land, located in the

CONDITIONS OF APPROVAL
PARCEL MAP NO. 7794,
1. This project shall conform substantially to the Parcel Map No. 7794, labeled
Exhibit A, and the requirements herein.
2. All requirements of any applicable law, ordinance, or regulation of the State
of California, City of Palm Desert, and any other applicable government entity
-shall be complied with as a part of construction.
3. Legal access, as required by the Subdivision Ordinance, shall be provided from
the parcel map boundary to a dedicated public .right.of-way. A copy of a valid
title insurance policy guaranteeing access shall be submitted to the Department
of Environmental Services prior to the issuance of any building or grading per-
mit.
4. The applicant shall provide ah easement, restricting in open space all areas of
both parcels which will not be used for building site or roadway purposes.
Said easement shall be shown on the Parcel Map and shall be recorded as directed
by the City Engineer and City Attorney.
5, No grading or construction permits of any land shall be issued relative to this
project without a valid Conditional Use Permit first being in effect. The ap-
proval of the Tentative Map does not imply or .include approval of any proposed
Conditional Use Permit.
..6. Sewerage disposal for individual systems will be permitted in accordance with
