RECOMMENDATION: Adopt Resolution No. 77-46 approving the Final Map for
Parcel Split 9136 and approving the Standard Subdivision
Improvement Agreement relating thereto.
Discussion:
The Parcel Split is located on the vacant parcel behind the
Post Office between E1 Paseo and Larrea Street. It conforms
substantially to the Tentative Map approved by the Planning
Commission in January 1977.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, APPROVING PARCEL MAP 9136 AND THE STANDARD SUB-
DIVISION AGREEMENT RELATING THERETO
BE IT HEREBY RESOLVED by the City. Council of the City of Palm Desert,
California, as follows:
I
1 . Parcel Map 9136 located in the City of Palm Desert, California, is
hereby approved subject to the' conditions of the Tentative Map.
2. The Mayor. and City Clerk are authorized to execute on behalf of
the City a Standard Subdivision Agreement guaranteeing completion of the public
improvements required by law.
3. The City Engineer is authorized to receive the improvement security
as required by law on behalf of the City, subject to the approval of the City Attorney
as to form.
4. The City Engineer is directed to process the Parcel Map for recording
upon receipt of the required improvement security and the payment of all fees.

G CASE NO. PM 1136, R. W. BOLMEIER & JENS HARBOE, APPLICANTS
Request for approval of a Tentative Parcel Map to subdivide a
2.64 acre parcel into one lot of 2.04 acres and one lot of 0.6
acres , on property located in the C-1 Zone District and situated
at the southwest corner of E1 Paseo and Lantana.
Mr. Williams explained the request and gave a background of the
project. Further, he stated that staff was recommending approval
of the Parcel Map by Planning Commission Resolution No. 212, sub-
ject to the attached conditions of approval .
Chairman Wilson opened the Public Hearing and asked if the applicant was
present.
C. ROBERT HUBBARD, 22 Stanford Drive, Rancho Mirage, spoke to the
Commission and stated that he was one of the owners of the property
i" in question. He explained what type of project was proposed for
the property in question - a financial institution and office space,
—' He further stated that the owners objected to the requirements as
listed in the conditions of approval . He stated that they felt that
requiring the applicant to agree to the conditions before the property
was developed would be "getting the cart ahead of the horse". Finally,
he, stated that they would be willing to agree to the conditions of ap-
proval at such a time as when the plans were presented; however, they
were asking the Commission to do awaywith the conditions at this time
and wait until they present the plans to go into construction.
Chairman Wilson asked if there was anyone present wishing to speak in
FAVOR of the Parcel Map. Being no one, he then asked if there was anyone
present wishing to speak in OPPOSITION to the Parcel Map. Being no one,
Chairman Wilson closed the Public Hearing on PM 9136 and asked the Com-
mission to take the matter under advisement.
Chairman Wilson stated that the Commission had before them the explanation
from staff and the major issue that has been brought up by the applicant;
which is whether or not the Conditions of Approval , particularly Condition
No. . 3 pertaining to curb, gutter, etc. , are premature. Chairman Wilson
then asked the Commission for their feelings.

There was a discussion among the Commissioners , the staff, and the
City Engineer pertaining to the Conditions of Approval . The consen-
sus was that the Conditions should remain but should be reworded and
re-numbered as follows:
j1. The Tentative Parcel Map is granted for the land as. described
in the application and any attachments thereto, and as shown
on th'e plot plan as revised, labeled Exhibit A, and the require-
ments herein.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as a part of any construction, including the
installation of the following:
a. Install curb, gutter, ten (10) foot sidewalk, and paving
as necessary on Larrea Street and Lantana Avenue to pro-
vide ultimate 44 foot travelled way.
b. Install ten (10) foot sidewalk along the full El Paseo
frontage.
c. Install street lights at the intersection of Lantana
Avenue with El Paseo and Larrea Street.
d. All work in the public right-of-way shall be constructed
in conformance with the City standards, specifications,
and the requirements of the City Engineer.

e. Street trees shall be planted along all street frontages
in accordance with the requirements of the City Engineer.
Commissioner Berkey moved that the Planning Commission adopt Resolution
No. 212, with the revisions to the Conditions of Approval as noted above.
Commissioner Reading seconded the motion; motion unanimously carried.

Mr. Williams reviewed the est with the Commission and stated

I. REQUEST:
Request for approval of a Tentative Parcel Map to subdivide a 2.64 acre
parcel into one lot of 2.04 acres and one lot of 0.6 acres located at the
southwest corner of El Paseo and Lantana.
II. STAFF. RECOMMENDATION:
Approve the Tentative Parcel Map -by Planning Commission Resolution No. 212 ,
subject to the attached conditions.
Justification .is based upon:
1. Conformance of the Tentative Parcel Map to all requirements of the Palm
Desert Zoning Ordinance, General Plan, Subdivision Ordinance, and the
California Subdivision Map Act.
2. The proposed project would conform to all existing and proposed adjacent
land use.
3. The proposed project does insure the protection of the .public health,
safety, and general welfare.
III. BACKGROUND:
A. Description: The subject site is described as Assessor's Parcel Number
625-131-005.
B. Location : The subject site is south of E1 Paseo, west of Lantana, and
north of Larrea Street.
C. Size: The existing 2.64-acre parcel would be divided .into Parcel 1 - 0.6
acres and Parcel 2 - 2.04 acres.

E. Adjacent Zoning: North - C-1
South - R-3(3)
East - C-1,S.P. and R-1
West - P (post office)
F. EIR Finding: A Negative Declaration was filed on January 7, 1977 for the
project, exempting it from CEQA as a Class 5 categorical
exemption (minor lot line adjustment not resulting in a
change in land use density). The appeal period expired on
January 15, 1977.
G. General Plan: The adopted Palm Desert General Plan indicates the property
to be Core Area Commercial.

IV. DISCUSSION•
The total site of 2.64 acres is planned as a professional off%ce complex
with a possible bank at the corner of Lantana and El Paseo. Due to fi-
nancing requirements, the developers are requesting that the bank site
be designated as a separate parcel . The lot lines have been drawn to
correspond to the eventual site plan. As a condition of approval , the
staff is recommendingthe dedication of twenty (20) feet along the west
side of Lantana Avenue to bring that street up to a full width of sixty
(60) feet. New curb and gutter will also be provided on Lantana and
Larrea. As with all commercial sites, a standard ten (10.) foot sidewalk
will be required along all three (3) street frontages.

APPROVING A TENTATIVE PARCEL MAP COVERING 2.64 ACRES OF

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did receive a verified application from W. R. BOLMEIER and JENS HARBOE, requesting
approval of a lot split of 2.64 acres of land, located in the C-1 Zone District
and situated on the south side of E1 Paseo, west of Lantana and north of Larrea,
more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14" , in that
an Environmental Assessment form was submitted and a Negative Declaration was made
by the Director of Environmental Services, and the appeal period has expired; and.,
WHEREAS, the Planning Commission did take into consideration, the Tentative
Parcel Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS, the Planning Commission did find that the subject Tentative Parcel
Map does substantially comply with the City of Palm Desert Municipal Code and the
State of California Subdivision Map Act, as amended; and,
WHEREAS, the Planning Commission did find that the subject Tentative Parcel
