Mr. Williams review this case with the Cissioners and stated that
staff was recommendin approval of Resol ion No. 238 which recommends
to the City Council the proval of t Change of Zone to PR-6.
4 Chairman Wilson opened the Pu is earing and asked if there was anyone
! present wishing to speak in FAVOR of e proposed Change of Zone. Being no one,
he asked if, there was anyone prese wi ing to speak in OPPOSITION to the pro-
posed Change of Zone.
ALEXIS NEWBRANDER, 46- Cottage Lane, sp ke to the Commission and
stated she desired a imilar zoning designation for the subject property
as the adjacent zo ng.
Mr. Williams s ted that the PR-6 zoning designatio would be more
flexible, b perhaps the R-2-8,000(4) ,S.P. would be m, e appropriate
since it fleets presently surrounding uses.
Commis ioner Reading moved that the Planning Commission appro e Resolution
No. 238, ith the Change of Zone to R-2-8,000(4) ,S.P. Commissioner Berkey seconded
the motion; motion unanimously carried (4-0) .

lots for financing purposes from a 9-acre parcel located north of
44th Avenue and east of Highway 111.
Mr. Williams presented the staff report to the Commission. He stated that
staff was recommending adoption of Planning Commission Resolution No. 239,
approving the Tentative Parcel Map.
Chairman Wilson opened the Public Hearing and asked if the applicant was
present.
FRANK J. URRUTIA, 73-350 El Paseo, Architect for the Applicant, spoke
to the Commission and stated that the applicant had no objections to
any of the Conditions of Approval as imposed by the staff.
Chairman Wilson asked if there was anyone present wishing to speak either
in FAVOR of or OPPOSED to the request. Being no one, he closed the Public Hearing
on Case No. PM 9851 and asked the Commission for their feelings.
Commissioner Kelly moved that the Planning Commission approve Resolution
No. 239, subject to compliance with the Conditions of Approval. Commissioner
Berkey seconded the motion; motion unanimously carried (4-0) .

I. REQUEST:
A request for approval of a Tentative Parcel Map to create three (3) lots
for financing purposes from a 9-acre parcel located north of Avenue 44
and east of Highway 111.
II. STAFF RECOMMENDATION:
Approve the Tentative Parcel Map by Planning Commission Resolution No. 239 ,
subject to the attached conditions.
Justification is based upon the following:
1. Conformance of the Tentative Parcel Map to all requirements of the Palm
Desert Zoning Ordinance, General Plan, Subdivision Ordinance, and the
California Subdivision Map Act.
2. The proposed project would conform to all existing and proposed adjacent
land use.
3. The proposed project does insure the protection of the public health,
safety, and general welfare.
III. BACKGROUND:
A. Description: The subject site is described as Assessor's Parcel
Number 629-023-004.
B. Location: The subject site is located south of Avenue 44 and
east of Highway 111.
C. Size: The existing 9-acre parcel would be divided into
Parcel 1 - 5.2 acres, Parcel 2 - 1.8 acres, and
Parcel 3 - 2.0 acres.
D. Existing Zoning: P.C. (4) S.P.
E. Adjacent Zoning: North - PC(4), S.P.
South - PR-6, S.P.,
East - PR-6, S.P. .
West - PC(4) , S.P.,
F. EIR Finding: This project is exempt from the requirements of CEQA.
A Negative Declaration was filed on April 11, 1977,
and the appeal period expired on April 19, 1977.
IV. DISCUSSION:
CASE NO. PM 9851 is directly related to CASE NO. DP 01-77 which was approved
by Planning Commission Resolution No. 210 on January 25, 1977. The uses
approved by the Development Plan included a 156 unit hotel, an 8,000 square
foot restaurant and 7,500 square feet of commercial uses which must be
clearly auxiliary to the proposed hotel. Parcel .1 of PM 9851 would be
used as the hotel site, Parcel 2 as the restaurant site, and Parcel 3 as
the commercial site. The parceling of the site is being done solely to
facilitate financing of the project. The parcel map should not be construed
as a means of constructing the project in different phases. Condition #5

in the Conditions of Approval for Case No. DP 01-77 states that the con-
struction of the development shall be done as a single project. The Con-
ditions of Approval for PM 9851 ensure that the construction of the develop-
ment will be done as a single project.

recreation facilities totalling 12,000 square feet of building
area, and their related open recreation areas which are construed
as auxiliary to the hotel activity.
2. The applicant shall underground all existing and proposed overhead
utility distribution lines on the property and/or along the full
frontage of the project.
3. , The applicant shall be responsible for the improvement of 44th Avenue
for the full frontage of the property to City Standards and as approved
by the City Engineer on the basis of a 70' half street right-of-way.
Improvements shall consist-of, but not be limited to:
a. Completion of curb, gutter, and related tie-in paving for the
full frontage.
b. Installation of a meandering 10' wide P.C.C. pedestrian and bicycle
path for the full length of the subject property.
c. Street lights as required by the City Engineer.
d. Landscaping, sprinkler system, and earth berming of a minimum
average height of three feet above the ultimate curb height as
approved by the Director of Environmental Services.
e. Any required drainage structures as deemed necessary by the City
Engineer to guarantee drainage from 44th Avenue to the Palm Valley
Channel will occur.
4. The applicant, subject to an encroachment permit issued by the State
of California Department of Transportation and approval of the City
Engineer, shall be responsible for the improvement of the full frontage
of the property on Highway 111 on the basis of 55' half street right-of-
way. Said improvements shall include, but not be limited to:
a. Completion and/or modification of the curb, gutter, and tie-in
paving to .provide for the proposed deceleration lane.
b. Street lights.
c. Landscaping and sprinkler system.
5. That all landscape areas adjacent to parking areas shall be enclosed
by a raised concrete curb or low wall . All planters adjacent to the
street right-of-way shall be constructed with weep holes.
6. That prior to construction the applicant shall submit a drainage plan
to the Building Official for consideration and approval .
7. That this approval is subject to the City of Palm Desert receiving
all necessary dedications and easements from the applicant.
8. That all areas sl'own as open parking areas shall be surfaced with
asphalt concrete and shall be suitably marked, outlining individual
parking spaces and traffic flow. Said surfacing and marking shall
be completed prior to final inspection of the structure or struc-
tures by the Department .of Building and Safety. All open parking
space shall be a minimum of 9' wide by 20' deep and the surface shall
be maintained in a reasonable state of repair at all times.
9. Prior to .the issuance of any building permits, the applicant shall
dedicate to the City an easement on the 30' wide area for the full
frontage of the subject property on State Highway 111. Said ease-
ment shall provide for the usage of the .area for public access. The
installation of the indicated improvements and future maintenance of
the area shall be the responsibility` of the developer and at his cost..
The form of the agreement shall be subject to the approval of the City
Attorney.
10. Fire protection conditions as required by the City Fire Marshall in his
memo dated January 12, 1977, attached hereto, shall be met as a part of
the development.

shall be provided and maintained.- :. .(This area shall consist of a
17' parkway and a 30' setback. ) A minimum of 19 shade trees shall
be provided therein, along with a 10' wide meandering bike and pe-
destrian path and undulating berms averaging 3' in height. An ease-
ment encon:pa sing this area shall be given to the City for public
circulatioH. Maintenance of this area shall be the responsibility
of the developer in perpetuity.
12. A landscaped screen (minimum 7' in height) shall be provided along
the Palm Valley Channel . The prescribed height shall be obtained
within 19 m:)nths from the time construction begins.
13. Shade trees as prescribed by ordinance (one tree per five parking
spaces) shall be provided and maintained throughout the parking
area.
14. No signs shall be considered approved as a part of this action.
15. All window areas on store fronts -of all stores shall be "tinted
glass". -
16. An automatic underground sprinkler system shall be provided to all
landscaped areas.
17. All sidewalks at intersection points with streets shall be ramped.
instead of curbed. Specific details shall be as required by the
City Engineer.
18. As a part of development, the subject property shall be annexed to
Improvement Districts No. 54 and No. 80 of the Coachella Valley County
Water District for sanitation service.
19. As a part of development, a center line stripeing, stop sign designa-
tion, loading area designation, and other traffic directional signs
shall be provided throughout the proposed parking areas as approved
by the City Engineer.
20. The developer, as part of his application for building permits shall
enter into an agreement with the City to pay one-eighth of the actual
cost of the installation of a traffic signal system at the intersection
of Highway 111 and 44th Avenue or the City's cost, whichever is less,
if the project is funded under a grant program. Accompanying said
agreement shall be a payment in the amount of $12,500 which is the ap-
plicant's estimated cost for the installation of said traffic signal
system to State standards at the time of agreement.
21. Prior to the issuance of. any building permits, a detailed plan of all
proposed exterior lighting, including required parking lot lighting;
tennis court lighting, etc. , shall have been reviewed and approved by
the Design Review Board and the Planning Commission.
22. Where practical , on-site drainage shall be conducted directly to a
storm drain or channel .
23. A raised median shall be installed in Highway 111 for sufficient length
east of Avenue 44 to adequately control access to eastbound High�.ray 111.

Development of this property should include any necessary widening
of the highway with PCC curb 38 from the centerline. We would
like the opportunity to review the street improvement plans when
available.
An encroachment permit must be obtained by the developer from the
District 8 office of the State Department of Transportation prior
to doing any work within the State highway right of way. '

Gentlemen:
This is to advise that the subject property is located within
the service territory of the Southern California Edison Company, and that
the electric loads of the project are within parameters of projected load
growth which Edison,is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds
our estimates, and providing that there are no unexpected outages to major
sources of electrical supply, we expect to meet our electrical load require-
ments for the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new gener-
ating facilities are delayed, our ability to serve all customer loads during
peak demand periods could become marginal by 1981 .
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe that our low sulfur fuel oil inventory,
together with our contractual commitments for delivery and our customers'
conservation efforts, will permit us to meet the forecasted demand for
electricity during 1977..
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient
supply of electricity.

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur—
rent tariffs as approved by the California Public Utilities Commission.
The developer will be required to deposit the full cost of these facili—
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be place in a joint trench with
other utilities wherever possible.
