CONCEPT PROPOSAL
AN AGREEMENT BETWEEN THE CITY OF PALM
DESERT, CALIFORNIA, AND THE COACHELLA VALLEY
PARKS AND RECREATION DISTRICT TO PROVIDE
MAINTENANCE FOR THE PALM DESERT SPORTS
COMPLEX.
This Agreement, made and entered into this _ day of , 1983, by and
between the City of Palm Desert, hereafter referred to as the City, and the Coachella
Valley Parks and Recreation District, hereafter referred to as the District, to effect the
establishment of a maintenance agreement for recreation facilities commonly referred to
as the Palm Desert Sports Complex.
WHEREAS, the City of Palm Desert has planned and developed approximately 10
acres of a 12 acre site located generally south of the Whitewater Channel on the westside
of Cook Street as a Sports Complex; and,
WHEREAS, the Coachella Valley Parks and Recreation District is desirous of
executing a formal agreement for maintenance of the facility.
NOW, THEREFORE, THE CITY AND THE DISTRICT HEREBY AGREE AS
FOLLOWS:
1. The City shall maintain all recreational equipment and facilities on said
property.
2. The District shall provide to the City a minimum sum of $40,000 per year to
be advanced quarterly in ten thousand dollar increments, as follows:
a) July 1 - $10,000
b) October 1 - $10,000
c) January 1 - $10,000
d) April 1 - $10,000
3. The amounts set forth in Section 2 may be increased on a fiscal year basis;
but shall be determined no later than the last day of the preceeding fiscal
year.
4. The City shall submit to the district a quarterly record of maintenance
expenditures for the complex.
5. For purposes of this Agreement maintenance shall include but not be limited
to the costs of utilities, mowing, paving, revitalization, fertilization, and
trash collection.
6. The City shall reimburse to the district any portion of funds advanced per
this Agreement which are not expended during the fiscal year said funds are
advanced.
7. The City and the District shall each hold the other harmless from any
liability or claim of liability arising out of any use of facilities or activity
while not under the control of the other.
8. The, control, use, and scheduling of activities at the complex shall be the
joint responsibility of the District and the City otherwise set forth in this or
subsequent agreements.
9. The term of this Agreement shall coincide with the lease agreement for said
site between the City and the Desert Sands Unified School District or its
successors.
IN WITNESS WHEREOF, the parties hereto set their hand seal the date and year
above written.
