II. ROLL CALL: MEMBERS PRESENT: Daryl Bjerke John Marman Jim Montoya STAFF PRESENT: Ramon A. Diaz Steve Smith Phil Joy Patricia Armitage III. CONSIDERATION OF MINUTES: On a motion by Commissioner Bjerke, seconded by Commissioner Marman, the minutes of the April 25, 1983, meeting were approved as written. Motion carried unanimously 3-0. IV. ORAL COMMUNICATIONS: NONE V. DISCUSSION ITEMS: 1. Sports Complex Agreement Update: Mr. Diaz distributed copies of the concept proposal for the maintenance and use of the sports complex and indicated the following revisions: 1. Clarification of exactly what the district's and the city's responsibility will be. 2. The city will not be receiving funding and will not be paying for utilities; therefore, the bills will go directly to the district. 6. If at any time the agreement becomes a problem, the city upon giving thirty days written notice can terminate the agreement and take the facility over entirely. Mr. Diaz indicated that item five seems to be causing the most concern. It states that "The control, use and scheduling of activities at the complex shall be the joint responsibility of the Coachella Valley Parks and Recreation District and the City of Palm Desert as may be set forth in subsequent agreements". In the latest verbal agreement it has been made clear that the city would receive priority in terms of use and that item six which states that "This agreement may be terminated by the City of Palm Desert upon a 30 day written notice being given to the Coachella Valley Parks and Recreation District" would give the city an alternative if it were not happy with the scheduling. If the city were to terminate the agreement with the district, then it would lose the $40,000 per year which the district would be contributing towards the maintenance. Chairman Montoya asked if the district could terminate the agreement with the city, if upon giving the city priority over the scheduling it finds that it is not getting enough use of the fields. Mr. Diaz felt that in terms of the agreement there would be no problem. If the district is not satisfied with it, then it would have to so indicate. - 1 - 4440-44.0, PALM DESERT PARKS AND RECREATION MINUTES MAY 23, 1983 Sports Complex Agreement Update (Continued): The district would like to pay for utilities and replacement of field lighting directly. Staff felt this would be acceptable. Chairman Montoya felt that adult use of the fields should also be taken into consideration by the district when it prepares the schedule. Commissioner Marman felt that it might be a good idea for staff to put together a year's schedule for the commission to review. He was afraid that the soccer teams would be forced to the edges of the fields again. Mr. Diaz indicated that at the present time there is no recreational schedule and there wasn't enough time to prepare one before the proposal is signed but he reminded Commissioner Marman that if there is a conflict, the local groups would receive priority. Commissioner Bjerke didn't feel the city should have to return the money to the district if it were forced to terminate the contract since it is the city's tax money to begin with. Mr. Diaz indicated that the city would have no jurisdiction over what the district does with the money. Commissioner Bjerke asked if there had been any trouble with vandalism at the sports complex so far. Mr. Diaz replied that some juveniles broke trees and damaged the roll-up door of the snack stand but the matter has been taken care of and the parents might be forced to pay for the damages. Commissioner Marman felt that if the parents are forced to pay for the damages it should be made public so that other kids will be deterred in the future. On a motion by Commissioner Bjerke, seconded by Commissioner Marman the commission voted to accept the proposal. Motion carried unanimously 3-0. Commissioner Marman asked if alcoholic beverages could be sold on the premises. Mr. Diaz replied that he didn't think they could be sold in a public facility but he would look into the matter. 2. College of the Desert Swimming Pools - Grant Application: Mr. Diaz indicated that the college is proposing to apply for a County Grant Program. Like any other program, they will have to compete against other agencies. What the council wishes to know from the commission is if it recommends that the city support the grant application applied for by the College of the Desert to refurbish the swimming pools or if they would prefer that the city apply for a separate grant for another purpose. Mr. Diaz indicated that it would be better to support a joint grant since there would be less of a chance of getting it if both parties are competing. Commissioner Bjerke felt the city should assist the College of the Desert because it would also help the community. - 2 - lettpvisti PALM DESERT PARKS AND RECREATION MINUTES MAY 23, 1983 College of the Desert Swimmining Pools - Grant Application (Continued): Commissioner Marman indicated that the college did permit the Coachella Valley Parks and Recreation District to use the pools in the summer and as far as he knew for the last four or five years they have not charged them. He felt that if they could get help from the city, it would be possible to open the pool to the public even more than at present. The pools are presently in very bad shape and if they aren't refurbished they will have to be closed down. Commissioner Bjerke asked if it would take long to get the grant. Mr. Diaz replied that it would take some time. On a motion by Commissioner Bjerke, seconded by Commissioner Marman the commission recommended that the city council support a joint grant application with College of the Desert for refurbishment of the college pools. Motion carried unanimously 3-0. VI. ADJOURNMENT: On a motion by Commissioner Bjerke, seconded by Commissioner Marman, the meeting was adjourned at 12:30 P.M. M A. DIAZ, cretary /pa - 3 - CONCEPT PROPOSAL AN AGREEMENT BETWEEN THE CITY OF PALM DESERT, CALIFORNIA, AND THE COACHELLA VALLEY PARKS AND RECREATION DISTRICT TO PROVIDE MAINTENANCE FOR THE PALM DESERT SPORTS COMPLEX. This Agreement, made and entered into this day of , 1983, by and between the City of Palm Desert, hereafter referred to as the City, and the Coachella Valley Parks and Recreation District, hereafter referred to as the District, to effect the establishment of a maintenance agreement for recreation facilities commonly referred to as the Palm Desert Sports Complex. WHEREAS, the City of Palm Desert has planned and developed approximately 10 acres of a 12 acre site located generally south of the Whitewater Channel on the westside of Cook Street as a Sports Complex; and, WHEREAS, the Coachella Valley Parks and Recreation District is desirous of executing a formal agreement for maintenance of the facility. NOW, THEREFORE, THE CITY AND THE DISTRICT HEREBY AGREE AS FOLLOWS: 1. The City of Palm Desert shall maintain all recreational equipment and facilities on said property except as otherwise set forth herein. 2. The Coachella Valley Parks and Recreation District shall be responsible for the following: a) Payment of all utility costs including but not limited to water, sewer, electricity, and gas. b) Replacement of field Lighting lamps. 3. City facility maintenance shall include but not be limited to the costs of mowing, paving, revitalization, fertilization, and trash collection. 4. Both parties shall hold the other harmless from any liability or claim of liability arising out of any use of facilities or activity while not under the control of the other. 5. The control, use, and scheduling of activities at the complex shall be the joint responsibility of the Coachella Valley Parks and Recreation District and the City of Palm Desert as may be set forth in subsequent agreements. 6. This agreement may be terminated by the City of Palm Desert upon 30 day written notice being given to the Coachella Valley Parks and Recreation District.
