Dear Paul; ,is I indicated at the Park Sc Recreation Commission meeting, I had been invited to meet with a group of students at Palm Desert :"riddle School, sj onsored by the Government Class of Mr. Rutlege. There were several requests and statements made by the students in regard to 'liesure-time' of the young reoplem. One of their big complaints was about the movie theaters : Cost to high, Couldn' t attend because some kids had done damage, Could attend only on an every other week end schedule. The Teen Center was also represented at the meeting, they re- quested at the Teen Center: Free Games , 3uildng and Center to small and not enough games to go around to all the kids in attendance , another "BIG" item, they wanted more week end Opportunities for act- ivities. I asked them to "Dream" about the future and what they would like to see our city plan for them as far a recreational activities and facilities. PETITION OF PROTEST Relative to Motorbike Nuisances in the City of Palm Desert , Particularly In the Grapevine Street - Desert Lily Area, and Manager ' s Response . Mayor Mullins asked Mr. Bouman to read the response he transmitted to the petition in for the benefit of the audience. In addition , Mr . Bouman read a letter from Mrs. Kay Craig relative to a motorbike nuisance she was experiencing in the Homestead Road area ( letter attached and made a part of these minutes as Exhibit "A" ) . Mr . Bouman thanked Mrs. Craig for her letter indicating that this is exactly what the Sheriff ' s Department needs to resolve the problem and assuring that a copy would be sent to Captain Adkins for proper action . The Sheriff ' s Department has been very busy in trying to apprehend these young offenders , and Mr. Bouman stated he was glad to report that he had received word that they were being successful in new approaches to the problem. V1RS. KATHY KRONNEMEYER, 43-750 Buena Circle , Palm Desert , addressed Council stating disagreement with the complaints . She pointed out that a motorbike can be a very constructive form of entertainment for young people, and there was just no place for them to ride anymore. Furthermore , she pointed out that the Sheriff ' s Department had become so adamant in their attempts to curtain the problem that it was becoming a form of harrassment to the children . If there is no place for them to ride, why not spend some time on creating a place . This may be a solution to the problem. Councilman McPherson arrived at this time (7 : 35 p.m. ) and was counted as present . Councilman Wilson commented that he felt Mrs . Kronnemeyer ' s comments were most appropriate , and he recommended that the Parks & Recreation Commission investigate such a possibility. MR. JOHN SANDBORNE, Member of the County Parks Commission , addressed Council indicating that he was there on another matter , but was glad to be able to present the County ' s side . He stated that a site had been proposed not too long ago on Edham Hill ; however , residents had been so opposed to it that the County Council had denied the request . He offered his services to the City and its Park & Recreation Commission . He also encouraged Mrs. Kronciemeyer to con- tinue with her petition so that it could be presented to the County Board of Supervisors . MRS . MARGARET KAY , Homestead Road , Palm Desert , addressed Council stating that these children are only 9 - 12 years old and she feared that one of them would be killed before any action was taken . Councilman Wilson moved to refer the matter to the City ' s Park &- Recreation Commission and instruct them to get in touch with the Riverside County Parks Commission , letting them know of our concern about a place of this type and asking their assistance in establishing - one. Shelton 73-110 Grapevine Palm Desert, California 92260 Dear Mr. Shelton: I am in receipt of your petition to Mayor Ed Mullins dated February 1 , 1978, relative to young motorbike riders creating a nuisance in your neighborhood. Believe me, I am in sympathy with your plight, since I live very close to the intersection of Salt Cedar and Desert Lily, and am thus not only plagued by the noisy motorbikes on the streets but on the desert directly behind my home. I certainly agree that they are a source of annoyance. _ With regard to the noise, I don' t believe that it is necessary for the City of Palm Desert to have an ordinance dealing with motor vehicle exhaust noise levels. Such noise emission is well covered under the California Vehicle Code, and the County Sheriff (our police department) can enforce those provisions. With regard to the age of the youngsters operating the vehicles , again there are requirements under the California Vehicle Code making it mandatory that they be licensed both for off-street and on-street operation. There are some ambiguities in the law with regard to what constitutes a motorcycle as opposed to a motor-driven cycle. However, I believe we should be primarily concerned with the noise and the annoyance rather than the age and licensing of the opera- tors. I 'm not sympathetic with these uncontrolled youngsters , yet personally, if I could solve the noise problem, I would be satisfied. I must be frank, however, and tell you that apprehending the youngsters is not a simple thing for the Sheriff's deputies. Many of the bikes are unlicensed (which is also illegal if operated on a public street) and difficult to iden- tify. Usually, by the time the Sheriff's deputies can be called and respond, the violators are far distant. Nevertheless , I can assure you that we have reported this problem to the Sheriff's Department many times and that they are making a strong effort to cope with it. I 'm convinced that it is simply not practical to have the Sheriff patrol streets waiting for the motorbikers to come along. It requires , therefore, that with each and every incident, the Sheriff' s Office be notified. Dear Mayor: The following residents of palm Desert located in the rranevine Street - Desert Lily area would like to point out to you an irritating problem that exists in many locations in the City . We are unset by the number of young motorbike riders who travel through our neighborhood, across nrivate vacant lots , with loud unmufflered exhausts of their motorbikes . Through their noise these youngsters invade the nrivacy of our neighborhood. Does the City of Palm Desert have an ordinance that establishes motor vehicle exhaust noise levels? We believe that most of the youngsters who ride the very loud motorbikes are too young to obtain legal vehicle operators ' licences . Yet they seem to ride through our area without re- straint by the sheriff's representatives in our City . These young motorbike riders , to ,our view, violate at least two laws--of-the-land : first , most of them seem to be underage for a vehicle license , and second, the motorbike youngsters ride fre- ouently across nrivate nronertv . Whether these motorbike youngsters violate a City anti--noise ordinance we do not know. Perhans it is time for the City of Palm Desert to consider adoption of a vehicle anti-noise ordinance .
