Recommendation
That the Oversight Board waive further reading and adopt a Resolution No.
OB -039 receiving and filing the Executive Director's summary of
executed contracts for routine maintenance and emergency maintenance
services performed in February and March 2013 for obligations listed on the
Recognized Obligation Payment Schedule (ROPS).
Background
On April 9, 2012, the Oversight Board of the Successor Agency to the Palm Desert
Redevelopment Agency (Oversight Board) approved the ROPS which lists routine
maintenance services on Successor Agency properties as an obligation.
On June 4, 2012, the Oversight Board authorized the Executive Director to execute
contracts under $5,000 for routine maintenance, recurring services, and emergency
maintenance services required to maintain the Successor Agency properties until
disposition.
Below is a summary of the contracts executed by the Executive Director in the months
of February and March for maintenance services on Successor Agency properties:

A RESOLUTION OF THE OVERSIGHT BOARD OF DIRECTORS FOR
THE SUCCESSOR AGENCY TO THE PALM DESERT
REDEVELOPMENT AGENCY RECEIVING AND FILING THE
EXECUTIVE DIRECTOR'S EXECUTED CONTRACTS FOR FEBRUARY
AND MARCH 2013, FOR ROUTINE MAINTENANCE AND
EMERGENCY MAINTENANCE SERVICES FOR OBLIGATIONS
LISTED ON THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE
(ROPS)
RECITALS:
A. Pursuant to Health and Safety Code Section 34179(3), all actions taken by
the Oversight Board for Successor Agency to the Palm Desert Redevelopment Agency
(Oversight Board) shall be adopted by resolution.
There has been presented to this Oversight Board for approval to receive and file
the Executive Director's summary of executed contracts for routine maintenance and
emergency maintenance services for obligations listed on the Recognized Obligation
Payment Schedule (ROPS).
NOW, THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR
AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY, HEREBY FINDS,
DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS:
Section 1. The above recitals are true and correct and are a substantive part
of this Resolution.
Section 2. The Oversight Board hereby adopts Resolution No. OB- 039
receiving and filing the Executive Director's summary of executed contracts for routine
maintenance and emergency maintenance services for obligations listed on the
Recognized Obligation Payment Schedule (ROPS).
Section 3. The staff of the Successor Agency is hereby directed to provide the
State Department of Finance ("DOF") written notice and information regarding the action
taken by the Oversight Board in Section 2 of this Resolution. Such notice and
information shall be provided by electronic means and in a manner of DOF's choosing.
Section 4. The officers of the Oversight Board and staff of the Successor
Agency are hereby authorized and directed, jointly and severally, to do any and all

Subject: 44-889 San Clemente
Staff discovered damage to an existing in -ground water meter box located at 44-889
San Clemente Circle, adjacent to Alessandro Alley. This property is owned by the
Successor Agency and the water meter serves the existing mature palm trees located
on the vacant property.
With your approval, staff will authorize Garza Landscaping, our existing maintenance
vendor to replace the damaged water meter box in the amount of $250.00. This
expenditure will be charged to Account No. 451-4341-433-4001 and the City may
receive reimbursement for this expenditure from the ROPS, Project Area 1, line 43, if
the property is sold or transferred back to the Successor Agency.

Subject: Successor Agency Property Maintenance (120 acres)
In June 2012, the Oversight Board authorized the Executive Director to approve
contracts up to $5,000, for routine maintenance or emergency services on Successor
Agency properties. Staff recently become aware of required maintenance on two
vacant parcels owned by the Successor Agency, adjacent to Windflower Court (see
attached map and photographs).
Below is a list of the individual properties and the cost to clean up miscellaneous debris
and litter. Quality Landscape, Inc. has submitted individual proposals for each property
(see attached) and is a licensed and insured vendor. The proposed expenditures are
eligible to be paid out of the approved Recognized Obligation Payment Schedule, line
item 43, Project Area 1.

• Routine Landscape Maintenance.
Concerning routine landscape maintenance agreement as defined in Liberty Landscaping, Inc.
"Landscape Management Specifications" attached hereto section I through VII.
1. In addition to the routine landscape maintenance described, monthly contract price includes
two annual color changes 12 flats per change and renovation of turf in the fall.

LANDSCAPE MANAGEMENT SPECIFICATIONS
Liberty Landscaping, Inc. Federal Tax Id 33-0820-545 (hereinafter referred to as LLI) agrees to fiunish
all the materials, supplies, and equipment needed to perform the said maintenance as specified for the
Owner.

Lawn Mowing.
1. Turf and ground areas, will be inspected for litter and debris prior to each mowing
and dispose of it.
2. Turf will be mowed one time per week during active growing periods, and as often
as required during slow periods of growth to maintain a neat healthy manicured
appearance.
3. Mowing height for all lawn areas will be no less than 1 'A" and no more
than 2 V2", except for Bermuda turf. Mowing equipment is to be kept sufficiently
sharp and properly adjusted through daily servicing to provide a cleanly cut grass.
Grass blade bruising, tearing is to be prevented. Clippings will be isolated and/or
collected and walks will be blown clean at conclusion of each visit.
Edging & String Trimming.
All sidewalks, curb lines, concrete slabs, tree circles, bed edges, signs and any
poles will be edged and/or string trimmed as often as necessary to maintain a neat
appearance.
SHRUBS
A. All Landscaped areas will be monitored throughout the growing season for weeds, litter,
and other debris.
B. Planters will be cultivated and groomed to promote an attractive, clean appearance. Weeds
shall be removed as needed.

C. Trimming, edging, and weeding of all shrubs and ground cover areas will be done as
needed to contain perimeter growth and maintain a natural yet neat appearance.
1. Prune shrubbery and hedges at established maintenance height.
2. All planted areas shall be kept free from grasses, weeds, leaves, and other debris.
TREES
A. Tree trimming is included for trees up to 12 feet in height. All trees will be "canopy" as
needed to allow 12 feet clearance from ground.
1. Pruning to be performed by LLI staff who have been trained and demonstrate
in proper pruning techniques.
2. Monitor trees that are staked, replace as need. Loosen and/or remove supports
when appropriate to encourage root development for support.
FERTIIZATION
A. LLI will provide all labor and materials to fertilize lawn, shrubs and ground cover to
maintain maximum plant health.
1. Turf, shrub and ground cover areas will be fertilized with specially formulated
products based on plant type and season.
WEED, PEST And DISEASE CONTROL
A. Broadleaf weed control is applied as needed to maintain a virtually weed free environment.
Spray applications for pest and diseases in all landscaped areas arc applied as needed to
maintain a healthy plant environment as well.
B. All applications are directly applied and/or supervised by a certified pest control applicator
(QAC). Every effort is always made to apply the lowest toxicity use product and ensure
the personal safety of our customer while obtaining the desired effectiveness needed.
C. Material Safety Data Sheets (MSDS) for all chemicals used on site (s) are available from
LLI to clients in accordance with EPA and OSHA regulations, upon request.

D. LLI will at all times be in compliance with requirements for hazardous communications
programs. Pest control specialist are trained and supervised in the safe application,
storage, and disposal of chemicals in accordance with EPA, OSHA and DPR regulations.
E. Weeds in shrub, planter beds, ground cover areas, tree circles, and sidewalk adjacent to
landscaped areas will be controlled by a manual weeding or by the use of selective
herbicides, including pre -emergent herbicides.
F. All landscape areas will be monitored for insect and disease infestations. Moles, gophers,
and other rodent activity will be monitored. Notification of problems and
recommendations for timely appropriate, control measures will be made.
G. Labor and materials for snail control included.
VI. IRRIGATION
A. Irrigation inspections and all controllers adjustments are done on a weekly basis by
qualified technician to maximize water usage. Programs will be adjusted as determined by
weather and plant requirements. Controllers will be shut off during periods of rain.
B. Adjust the sprinkler system to provide the best coverage possible. Monitor for leaks or
malfunctioning parts, and adjust for proper spray arc and maximum system efficiency.
C. Upon inspection, any accidental damage or vandalism caused by others shall be reported to
owner promptly. Repair and/or replacement of any damaged or malfunctioning
components will be submitted as an extra. Damage caused to the irrigation system by LLI
shall be repaired and at no charge to customer.
D. Labor (not components) for minor irrigation repairs included.
VII. OTHER CONDITIONS
A. LLI wherein accord, will provide uniformed staff supervised by fully trained Supervisors.
Cellular phone communication is in use during regular business hours and emergency
after-hours communication is available. Emergency calls received after business hours
are subject to extra charge.
B. Concrete and asphalt swales to be kept clear of miscellaneous dirt and debris.

C. Debris generated by landscape activities will be removed from the site unless prior
arrangements are made.
D. Inspection of site (s) will be made regularly and problems, if found, will be discussed by
LLI with the Owner. Written, comprehensive inspection reports will be provided upon
request.
E. LLI provides all payment of wages, worker's compensation insurance, social security tax,
employment compensation tax, employer's liability insurance, and all other requirements
of federal, state, and local government.
F. All work to be performed as per landscape specifications. LLI is not liable for losses due
to natural disorders, acts of God, or vandalism. (example: rain, freeze, wind, fire, etc.)
LLI will carry the following types and amount of insurance, at a minimum:

. Worker's Compensation Statutory/Limits
VIII. WORK PERFORMED AT AN ADDITIONAL FEE
The both parties agree that the following work will be performed by LLI unless contracted
for on a separate basis. Extra work will need prior permission from the Owner. All extra
work will be billed at LLI's standard hourly rate plus materials.
A. Trimming of trees over 12' in total height. Except otherwise specified here -in.
B. Chemicals/materials for rodents, diseases or pests on lawns, trees or shrubs.
C. Parking lot sweeping or litter pickup (except for debris that LLI generates).
D. Aerating with cord removal, scalping or renovation of lawn areas.
E. Correction of pre-existing conditions such as dead or dying plant materials.
F. Cleaning and/or repairing from acts of vandalism, natural disorders, or acts of God
(example: rain, freeze, wind, fire, etc.)
G. Irrigation repairs, except as other wise specified herein.
H. Color will be $22.00 per flat including
