Background In December of 2013, the Oversight Board of the Successor Agency to the Palm Desert Redevelopment Agency (Oversight Board) and the State Department of Finance approved the current ROPS which lists routine maintenance services on Successor Agency properties as an obligation. On June 4, 2012, the Oversight Board authorized the Executive Director to execute contracts under $5,000 for routine maintenance, recurring services, and emergency maintenance services required to maintain the Successor Agency properties until disposition. Pursuant to Health and Safety Code Section 34179(3), all actions taken by the Oversight Board for Successor Agency to the Palm Desert Redevelopment Agency (Oversight Board) shall be adopted by resolution. There has been presented to this Oversight Board for approval to receive and file the Executive Director's summary of executed contracts for routine maintenance and emergency maintenance services for obligations listed on the Recognized Obligation Payment Schedule (ROPS). NOW, THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY, HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this Resolution. Section 2. The Oversight Board hereby adopts Resolution No. OB - 043 receiving and filing the Executive Director's summary of executed contracts for routine maintenance and emergency maintenance services for obligations listed on the Recognized Obligation Payment Schedule (ROPS). Section 3. The staff of the Successor Agency is hereby directed to provide the State Department of Finance ("DOF") written notice and information regarding the action taken by the Oversight Board in Section 2 of this Resolution. Such notice and information shall be provided by electronic means and in a manner of DOF's choosing. Section 4. The officers of the Oversight Board and staff of the Successor Agency are hereby authorized and directed, jointly and severally, to do any and all 1 RES. NO. Wohlmuth, Executive Director From: Ryan Gayler, Project Administrator Date: June 11, 2013 Subject: University Site Maintenance Services On June 5, 2013, you authorized the purchase of 2,000 feet of wind fence to address the dust problem at the University Site. The wind fence is designed to reduce the amount of dust that leaves the site. However, the processes of installing the fence, and other maintenance efforts at the site, have disturbed the soil. The property owner is required to seal any disturbed area with a chemical soil stabilizer. In preparation for the chemical stabilizer the City crews will expend 64 labor hours at a cost of approximately $2,400.00. A notice inviting bids was posted on the bulletin board and sent to three prospective bidders for the soil stabilization. All contractors indicated they were interested, but only one submitted a bid for the work. The Land Stewards provided a quote in the amount of $1,870.00 for the stabilization of approximately 220,000 square feet of the University Lot. Public Works recommends that the Executive Director authorize the expenditure of labor and the stabilization of 220,000 square feet of soil. The total cost of labor and soil stabilization is $4,270.00. On June 24, 2013, the matter will be presented before the Oversight Board for ratification of the expenditure for the work. The costs are eligible to be paid out of the approved Recognized Obligation Payment Schedule, line item 43 (Agency owned property carrying costs prior to disposition). Wohlmuth, Executive Director From: Ryan Gayler, Project Administrator Date: June 5, 2013 Subject: University Site Maintenance Services On May 10, 2013, the Public Works Department received a Notice to Comply from the South Coast Air Quality Management District (AQMD) for the property owned by the Successor Agency to the RDA north of Frank Sinatra Drive and south and west of Gerald Ford Drive. The 122 acre property came to the AQMD's attention due to the complaints of several residents of Avondale Country Club. During the winds we have experienced this spring, dust has blown off of virtually every lot in the valley and this property has been no exception. However, the standard that property owners are required to meet is that no dust may leave the property. The reason we received the Notice to Comply is because we have not adequately prevented dust from leaving the site. To address these issues, the Public Works department has proposed the installation of wind fence to reduce the amount of dust leaving the site. The effort will focus primarily on the southeast corner of the property. First, two rows of wind fence will be installed or repaired along the frontage of Frank Sinatra and Gerald Ford. A double row of wind fence will also be installed transverse to the prevailing wind behind the retention basin on the corner. Public Works recommends that the Executive Director authorize the purchase of approximately 2,000 feet of wind fence from a Council -approved vendor. The total cost of procuring the wind fence is $5,000.00. On June 24, 2013, the matter will be presented before the Oversight Board for of the expenditure for the work. The costs are eligible to be paid out of the approved Recognized Obligation Payment Schedule, line item 43 (Agency owned property carrying costs prior to disposition).
