BROWN JR. • GOVERNOR 91 5 L STREET ■ SACRAMENT❑ CA ■ 95514-3705 ■ WWW.00F.CA.00V Subject: Objection to Oversight Board Action The City of Palm Desert successor agency (Agency) notified the California Department of Finance (Finance) of its February 8, 2013 Oversight Board (OB) action 2013-001 on February 8, 2013. Pursuant to Health and Safety Code (HSC) section 34179 (h), Finance has completed its review of your OB action, which may have included obtaining clarification for various items. Based on our review and application of the law, the Agency's OB resolution No. 033 related to the conveyance of parcels APN 627-101-038 and APN 627-101-039 to the City of Palm Desert for the construction of the additional lanes on Monterey Avenue and the turn pocked on Fred Waring Drive is not permitted. HSC section 34181 states the OB shall direct the Agency to transfer ownership of those assets that were constructed and used for a governmental purpose such as roads to the appropriate public jurisdiction. Since the two parcels are currently vacant and are not yet constructed for a governmental purpose, the transfer is not allowed. As authorized by HSC section 34179 (h), Finance is returning your OB action to the board for reconsideration. OB - 033 A RESOLUTION OF THE OVERSIGHT BOARD TO THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY AUTHORIZING AND APPROVING THE CONVEYANCE OF CERTAIN REAL PROPERTY KNOW AS A.P.N. 627-101-038 AND A.P.N 627-101- 039 TO THE CITY OF PALM DESERT RECITALS: WHEREAS, pursuant to Health and Safety Code Section 34179(3), all actions taken by the Oversight Board to the Successor Agency to the Palm Desert Redevelopment Agency (the "Oversight Board") shall be adopted by resolution. WHEREAS, AB X1-26 and AB X1-27 were signed by the Governor of California on June 29, 2011, making certain changes to the Community Redevelopment Law (Part 1 (commencing with Section 33000) of Division 24 of the California Health and Safety Code), including adding Part 1.8 (commencing with Section 34161) and Part 1.85 (commencing with Section 34170) ("Part 1.85"). WHEREAS, the City Council of the City of Palm Desert (the "City") made an election to serve as the successor agency for the Palm Desert Redevelopment Agency (the "Agency") under Part 1.85 (the "Successor Agency"). WHEREAS, the City Council, acting as the governing board for the Successor Agency, established rules and regulations applicable to the governance and operation of the Successor Agency, and pursuant to such resolution provided that the Successor Agency will be governed by a Board of Directors consisting of the members of the City Council of the City. WHEREAS, in response to a letter from the California State Controller ordering the City to return to the Successor Agency real property previously conveyed by the Agency to the City after January 1, 2011 (the "Letter"), and pursuant to Health and Safety Code Section 34167.5, the Board desires to execute and deliver to the City that certain Grant Deed in the form attached hereto as Attachment "A" (the "Deed") and conveying that certain real property described therein. WHEREAS, on January 24, 2013, the Successor Agency and City approved the conveyance and acceptance of that certain real property described in the Deed. RESOLUTION NO. OB - 033 NOW, THEREFORE, THE OVERSIGHT BOARD HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this Resolution. Section 2. The Oversight Board hereby authorizes the Successor Agency to execute and deliver the Deed to the City, and to take any such other action and to execute and deliver such other documents and instruments as may be necessary to effectuate the purpose of this Resolution, all under such circumstances and at such time as he deems appropriate upon the advice of legal counsel.
