Background On June 2, 2014 the State of California Department of Finance (DOF) approved the Long Range Property Management Plan (LRPMP) for the Successor Agency to the Palm Desert Redevelopment Agency. The LRPMP contains properties for the Joslyn Senior Center Expansion located at 73697 Santa Rosa Way, also known as Property 2(b) and 44214 San Pascual, also known as Property 2(a) that are designated for governmental use. As authorized on the LRPMP, the properties were deeded to the City of Palm Desert on June 16, 2014. After further analysis, it was determined that only the southern, vacant portion of the property 2(b) would be needed for Government Use and the future expansion of the Joslyn Center. The remaining northern portion of Property 2(b) can be sold on the open market. A parcel map waiver separating the original property (see site plan) was completed and the new grant deed was recorded on May 12, 2015. Property 2(b) (Parcel 1) now contains only the northern portion of the original property with the existing residential structures. Property 2(a) (Parcel 2) now includes the original vacant property along 44214 San Pascual and the southern -most vacant Economic Development Manager aul S. Discussion: The amended LRPMP that is attached to the resolution now reflects that Property 2(b) is to be sold on the open market and the proceeds of the sale will be distributed as property taxes to the affected taxing entities and Property 2(a) will remain designated as Government Use. Since Property 2(b) is to be sold, it was transferred back to the Successor Agency to the Palm Desert Redevelopment Agency on August 27, 2015. Property 2(b) will be available for sale once the DOF approves the amendment to the LRPMP. Fiscal Analysis The LRPMP requires that all proceeds of the property sales be distributed as property taxes to the affected taxing entities, in accordance with the terms of the California Health and Safety Code, Section 34191.5 (c)(2)(B). Each taxing entity including the City will receive a portion of the proceeds based on their respective tax rate. OB - 130 A RESOLUTION OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY APPROVING AN AMENDMENT TO THE LONG RANGE PROPERTY MANAGEMENT PLAN AND TAKING CERTAIN ACTIONS IN CONNECTION THEREWITH RECITALS: A. Pursuant to Health and Safety Code Section 34175(b) and the California Supreme Court's decision in California Redevelopment Association, et al. v. Ana Matosantos, et al. (53 Ca1.4th 231(2011)), on February 1, 2012, all assets, properties, contracts, leases, books and records, buildings, and equipment of the former Palm Desert Redevelopment Agency (the "Agency") transferred to the control of the Successor Agency to the Agency (the "Successor Agency") by operation of law; and B. Pursuant to Health and Safety Code Section 34191.5(b), the Successor Agency must prepare a Tong -range property management plan which addresses the disposition and use of the real properties and interests in real property of the former Agency, and which must be submitted to the Oversight Board for the Successor Agency (the "Oversight Board") and the Department of Finance (the "DOF") for approval no later than six months following the issuance by DOF to the Successor Agency of a finding of completion pursuant to Health and Safety Code Section 34179.7; and C. Pursuant to Health and Safety Code Section 34179.7, DOF issued a finding of completion on May 15, 2013; and D. On May 5, 2014, the Oversight Board adopted its Resolution No. OB - 073 approving the Successor Agency's long-range property management plan (the "LRPMP"), which LRPMP addresses the disposition and use of the real properties and interests in real property of the former Agency and includes the information required pursuant to Health and Safety Code Section 34191.5(c); and E. The DOF approved the LRPMP by letter dated June 2, 2014; and F. The LRPMP, as approved by the DOF, provides for the transfer to the City of Palm Desert certain properties (collectively, the "Governmental Use Properties") including Property 2(b) located at 73697 Santa Rosa Way (APN No. 627-102-019) and Property 2(a) located at 44215 San Pascual (APN 627-102-017, which parcels the LRPMP describes as being needed for the Joslyn Senior Center Expansion; and G. On June 16, 2014, the Oversight Board adopted its Resolution No. 080 directing the Successor Agency to complete the transfer of the Governmental Use Properties to the City pursuant to the LRPMP; and 12812-0001 \1859774v2.doc Resolution No. OB - 130 Page 2 H. The Successor Agency transferred the properties to the City by Quitclaim Deed dated June 16, 2104, and the City executed a Certificate of Acceptance with respect to such transfer; and I. On May 12, 2015, Property 2(b) was divided into two portions (Property 2(b) now contains a house and apartment complex, and the southern -most vacant portion is now contained within Property 2(a) pursuant to a lot line adjustment and the recordation of a Grant Deed; and J. The City transferred Property 2(b) to the Successor Agency by Quitclaim Deed dated August 27, 2015 because it was no longer needed for the Joslyn Senior Center Expansion or any other governmental use; and K. To facilitate the sale of Property 2(b) for fair market value by the Successor Agency, the Successor Agency has prepared and submitted to the Oversight Board the Amendment to the Long -Range Property Management Plan attached hereto as Exhibit A (the "Amendment") which Amendment addresses the disposition of Property 2(b); and L. Pursuant to Health and Safety Code Section 34180(j), at the same time the Successor Agency submitted the Amendment to the Oversight Board, the Successor Agency submitted the Amendment to the County Administrative Officer, the County Auditor -Controller, and DOF; and M. Pursuant to Health and Safety Code Section 34181(f), the public was provided with at least 10 days' notice of the date of the meeting at which the Oversight Board proposes to consider approval of the Amendment; NOW, THEREFORE, THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this resolution. Section 2. The Oversight Board hereby approves the Amendment to the LRPMP as presented by the Successor Agency and attached hereto as Exhibit A. Section 3. The staff of the Successor Agency is hereby directed to transmit to DOF this resolution together with written notice and information regarding the action taken by this resolution. Such notice to DOF shall be provided by electronic means and in a manner of DOF's choosing. Section 4. The staff and the Board of the Successor Agency are hereby authorized and directed, jointly and severally, to do any and all things which they may 12812-0001 \1859774v2.doc Resolution No. OB - 130 Page 3 deem necessary or advisable to effectuate this resolution and any such actions previously taken are hereby ratified. Section 5. This resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA"). Pursuant to the State CEQA Guidelines (14 Cal Code Regs 15000 et seq.) (the "Guidelines"), the Oversight Board has determined that the approval of the Amendment to the LRPMP is not a project pursuant to CEQA and is exempt therefrom because it is an organizational or administrative activity of government that will not result in direct or indirect physical changes in the environment (Guidelines Section 15378(b)(5)). Further, it can be seen with certainty that there is no possibility that approval of the Amendment to the LRPMP may have a significant effect on the environment, and thus the action is exempt from CEQA (Guidelines Section 15061(b)(3)).
