Waive further reading and adopt Resolution No. OB -160 authorizing the Successor Agency to deconstruct the property located at 44-845 San Clemente Circle, Property 1(d) of the Long Range Property Management Plan; 2. Authorize the Executive Director to execute a contract for the deconstruction of 44-845 San Clemente Circle in the amount not to exceed $35,000 once bids are secured. (CONTRACT NO. SA35890) Background The Successor Agency owns the property located at 44-845 San Clemente Circle, which is listed as property to be sold on the approved Long Range Property Management Plan (LRPMP). The property has a 1,300 square foot home on a 16,500 square foot parcel. The site was originally acquired to facilitate the Alessandro West Improvement Project. The rear 27 feet has been transferred to the City of Palm Desert as right-of-way. The remainder parcel has a dilapidated home that has been vandalized and broken into several times. Staff has cleaned up and re -hoarded the doors and windows on numerous occasions (see attached photos). Staff has received complaints from residents in the area concerning the condition and ultimate disposition of the property. The disposition of the property has been placed on hold until the Alessandro West Improvement Project is complete. The home requires significant repair to make it habitable and its value is primarily as a vacant lot. The property has become a public nuisance and requires immediate attention. Oversight Board Staff Report 44-845 San Clemente Circle Deconstruction January 30, 2017 Page 2 of 2 Discussion Staff is seeking approval from the Oversight Board to move forward with deconstruction of the residence. The residential structure is uninhabitable and requires significant investment to restore it to a safe condition. In the condition the residence currently stands, the value of the property is in the land only. The land has an estimated value of $128,000. Staff recommends that the Oversight Board authorize staff to seek bids to deconstruct the property. Staff also seeks authorization to enter into a contract in an amount not to exceed $35,000.00, once the bids are secured. After the property is deconstructed, the parcel will be placed on the market to be sold once the Alessandro West Improvement Project is complete. The proceeds of the sale will be distributed to the taxing entities, pursuant to the LRPMP. Fiscal Analysis If the Successor Agency receives approval to deconstruct the residence from the Oversight Board and the State Department of Finance, funds to complete the deconstruction are available in the ROPS 2016/17 (B), Line 190 Costs Associated with Disposition of Assets. OB - 160 A RESOLUTION OF THE OVERSIGHT BOARD OF DIRECTORS FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY AUTHORIZNG THE DECONSTRUCTION OF SUCCESSOR AGENCY PROPERTY LOCATED AT 44-845 SAN CLEMENTE CIRCLE, ALSO KNOWN AS PROPERTY 1(d) OF THE LONG RANGE PROPERTY MANAGEMENT PLAN RECITALS: A. Pursuant to Health and Safety Code Section 34179(3), all actions taken by the Oversight Board for Successor Agency to the Palm Desert Redevelopment Agency (Oversight Board) shall be adopted by resolution. There has been presented to this Oversight Board for approval authorizing the deconstruction of the single family residence located at 44-845 San Clemente Circle APN 627-071-070, Property 1(d) listed on the Long Range Property Management Plan (LRPMP). NOW, THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this Resolution. Section 2. The Oversight Board hereby adopts Resolution No. OB - 160 approving and authorizing the deconstruction of the single family residence located at 44-845 San Clemente Circle APN 627-071-070 Property 1(d) listed on the Long Range Property Management Plan (LRPMP). Section 3. The staff of the Successor Agency is hereby directed to provide the State Department of Finance ("DOF") written notice and information regarding the action taken by the Oversight Board in Section 2 of this Resolution. Such notice and information shall be provided by electronic means and in a manner of DOF's choosing. Section 4. The officers of the Oversight Board and staff of the Successor Agency are hereby authorized and directed, jointly and severally, to do any and all 1 RESOLUTION NO.
