Gaugush, Capital Improvement Projects Technician Accept the bid of $360,000, from Gilbert A. Stayner and Christian A. Stayner, for the sale of the Miles C. Bates House, located at 73-697 Santa Rosa Way, Palm Desert, California (APN 627-102-024), Property 2(b) pursuant to the Long Range Property Management Plan and authorize the Executive Director to execute the related documents appropriate to complete the transaction. Recommendation Waive further reading and adopt Resolution No. OB - 172 Background Analysis The property located at 73-697 Santa Rosa Way, Palm Desert, identified as property 2(b) on the Long Range Property Management Plan ("LRPMP"), is currently owned by the Successor Agency to the Palm Desert Redevelopment Agency ("SARDA") and must be sold according to the disposition strategy approved on the LRPMP. In January 2017, an appraisal was done for the property using two situations, one being in an "as is" condition, and one being a hypothetical value for the property if it were granted historical designation. The appraised value of the property in an "as is" condition was $320,000. With a historical designation, the value increased to $340,000. On January 11, 2018, the property was given a City of Palm Desert Landmark Designation as a local historic landmark. February 24, 2018, a live public auction took place at the University of California at Riverside Palm Desert Campus Auditorium. The high bid received was from Gilbert A. Stayner and Christian A. Stayner, an architectural team from Sherman Oaks, California, in the amount of $360,000, $20,000 above the appraised value shown on the LRPMP. The recommended action will approve the sale to the high bidder and allow staff to complete all administrative actions necessary to effectuate the transaction. BATES HOUSE LOCATED AT 73697 SANTA ROSA WAY, PALM DESERT, CA (APN 627- 102-024) PURSUANT TO THE LONG RANGE PROPERTY MANAGEMENT PLAN AND TAKING RELATED ACTIONS RECITALS: A. Pursuant to AB X1 26 (enacted in June 2011) and the California Supreme Court's decision in California Redevelopment Association, et al. v. Ana Matosantos, et al., 53 Cal. 4th 231 (2011), the former Palm Desert Redevelopment Agency (the "Former Agency") was dissolved as of February 1, 2012, the Successor Agency to the Palm Desert Redevelopment Agency (the "Successor Agency"), as the successor entity to the Former Agency, was constituted, and an oversight board of the Successor Agency (the "Oversight Board") was established. B. AB X1 26 added Part 1.8 (commencing with Section 34161) and Part 1.85 (commencing with Section 34170) to Division 24 of the California Health and Safety Code ("HSC") (such Paris 1.8 and 1.85, including amendments and supplements enacted after AB X1 26, being referred to herein as the "Dissolution Act"). C. Pursuant to the Dissolution Act, the Successor Agency is tasked with winding down the affairs of the Former Agency. D. Pursuant to HSC Section 34175(b), all real properties of the Former Agency transferred to the control of the Successor Agency by operation of law. E. On May 5, 2014, the Oversight Board adopted Resolution No. OB-073, approving a Long -Range Property Management Plan (the "Original LRPMP") which addresses the disposition of the real properties owned by the Successor Agency. F. On June 2, 2014, the State Department of Finance (the "DOF") approved the Original LRPMP. G. On September 21, 2015, the Oversight Board approved an amendment to Original LRPMP (the "LRPMP Amendment"), allowing the Miles C. Bates House -- Property 2(b) of the LRPMP (APN 627-102-024) (the "Miles C. Bates House Property") -- to be sold on the open market. (The Original LRPMP, as amended by the LRPMP Amendment, is referred to herein as the "LRPMP.") H. On December 9, 2015, the DOF approved the LRPMP, as amended. -1- RESOLUTION NO. OB - 172 I. Pursuant to HSC Section 34191.3, the DOF-approved LRPMP shall govern, and supersede all other provisions of the Dissolution Act relating to, the disposition and use of the real property assets of the Former Agency. J. In January 2018, the Successor Agency released a Notice Inviting Bids regarding the Miles C. Bates House Property for receipt of bids at a public auction. K. The materials made available to the potential bidders included the form of a Purchase and Sale Agreement, to be executed by the Successor Agency and the winning bidder, subject to changes to reflect the terms of the winning bid. L. Per the result of the public auction conducted on February 24, 2018, the winning bid was in the amount of $360,000 (the "Winning Bid"), received from Gilbert A. Stayner and Christian A. Stayner (the "Winning Bidders"). M. The Oversight Board is adopting this Resolution to approve the sale of the Miles C. Bates House Property pursuant to the LRPMP, the Winning Bid and the related Purchase and Sale Agreement. NOW, THEREFORE, THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The above recitals, and each of them, are true and correct. Section 2. The Oversight Board hereby approves and directs the acceptance of the Winning Bid and the sale of the Miles C. Bates House Property to the Winning Bidders. The Oversight Board hereby approves and authorizes the Successor Agency's execution and delivery of the related Purchase and Sale Agreement, the Grant Deed and any other documents necessary or appropriate to consummate the sale of the Miles C. Bates House Property to the Winning Bidders. Section 3. The members of this Oversight Board and the staff of the Successor Agency are hereby authorized, jointly and severally, to do all things which they may deem necessary or proper to effectuate the purposes of this Resolution and the Purchase and Sale Agreement. Date: April 2, 2018 Time: 1:30 P.M. or as soon thereafter as the matter may be heard Place: Administrative Conference Room, located at Palm Desert City Hall, 73-510 Fred Waring Drive, Palm Desert, California NOTICE IS HEREBY GIVEN that at the meeting of the Oversight Board (the "Oversight Board") of the Successor Agency to the Palm Desert Redevelopment Agency (the "Successor Agency") to be held on April 2, 2018, at 1:30 P.M., or as soon thereafter as possible, the Oversight Board will consider the adoption of a resolution directing the Staff to accept the bid for the Miles Bates House located at 73697 Santa Rosa Way, known as APN: 627-102-024, Property 2(b) pursuant to the Long Range Property Management Plan and authorize the Chair, Vice -Chair or the Executive Director to execute the Purchase and Sale Agreement and all related documents necessary or appropriate to complete the transaction. Such Long Range Property Management Plan has been approved previously by the Oversight Board and the California State Department of Finance. Interested persons are invited to attend this meeting and be heard regarding this matter. An individual who challenges any decision regarding the proposed action in court may be limited to raising only those issues such individual or someone else raised at the meeting described in this notice or in written correspondence delivered to the Oversight Board at, or prior to, the meeting. Due to the time constraints and the number of persons wishing to give oral testimony, time restrictions may be placed on oral testimony at the meeting regarding the proposal. Any interested person may wish to make comments in writing to assure that the relevant views are expressed adequately. Written comments may be submitted to the Oversight Board prior to the time set for the meeting, to the attention of the Secretary of the Oversight Board at 73-510 Fred Waring Drive, Palm Desert.
