HomeMy WebLinkAboutRes OB-176 (2)STAFF REPORT OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY Economic Development Department MEETING DATE: May 7, 2018 PREPARED BY: Martin Alvarez, Director of Economic Development REQUEST: Request for approval to utilize the Recognized Obligation Payment Schedule (ROPS) 2017/2018B and 2018/19, costs associated with disposition of assets for the appraisal of various Successor Agency to the Palm Desert Redevelopment Agency (SARDA) parcels listed on the Long Range Property Management Plan (LRPMP). Recommendation That the Oversight Board waive further reading and adopt Resolution No. OB- 176 approving use of ROPS 2017/2018B and ROPS 2018/19 costs associated with disposition of assets (line item 190) to conduct property appraisals associated with disposition of assets listed on the LRPMP. Background The SARDA's approved LRPMP requires the disposition of all of the properties listed on the plan. In order for staff to negotiate the sale of the properties remaining to be sold, the SARDA is required to appraise and determine fair market value. The appraisals will be utilized to prepare future purchase and sale agreements that will be brought back to the Oversight Board for consideration at a later date. Discussion SARDA staff requests approval to utilize existing ROPS 2017/2018B funds to cover the costs to appraise various properties listed on the LRPMP. Staff seeks approval to utilize funds to cover the appraisal services that have been completed and those that will arise in the future. For the appraisal service contracts that have been completed, staff followed the City of Palm Desert's purchasing ordinance and secured proposals from qualified appraisers. The City and SARDA entered into contracts with the following appraisal firms to perform individual fair market appraisals for the following sites: Oversight Board Staff Report Appraisal Contracts May 1,2018 Page 2of3 LRPMP Site: • Desert Willow Lot Pad - Site 12 (b) - $2,850 (City Contract / Capital Realty Analysts) • Desert Willow Lot Pad - Site 12 (c) - $2,850 (City Contract / Capital Realty Analysts) • Desert Willow Lot Pad - Site 12 (e) - $2,500 (SARDA Contract / Capital Realty Analysts) • 132 Acres — Site 11 (a-h) - $3,200 (SARDA Contract / Lidgard and Associates) Staff seeks approval to reimburse the City of Palm Desert for appraisal contract issued to Capital Realty Analysts for Sites 12 (b) and (c). In addition, SARDA staff seeks approval of the appraisal contract issued to Capital Realty Analysts by SARDA for site 12 (e). Excluding the sites listed above, the SARDA has the following LRPMP sites remaining to be appraised and sold: • Alessandro Alley — Sites 1 (a-d, f) — five single family lots • 170 Acres — Site 9 (a-m) • Desert Willow Lot Pad — Site 12(a) — 16 acres • Desert Willow Lot Pad — Site 12(d) - 15 acres SARDA staff seeks approval to appraise the remaining properties by utilizing one of the following qualified appraisers: 1. Capital Realty Analysts 2. Casey Merrill, LLC 3. Lidgard and Associates Staff will seek proposals from the above listed firms and the lowest responsive proposal will be utilized. Staff seeks approval to enter into four separate contracts with the cumulative amount not to exceed $20,000 for the above listed sites remaining to be sold. Therefore, staff recommends approval to utilize ROPS 2017/2018B costs associated with disposition of assets to cover the property appraisal costs rendered for the LRPMP Sites 12(b), (c), (d) and Site 11 (a-h). In addition, staff recommends authorization to utilize ROPS 2018/2019A/B for four remaining property appraisal contracts with the cumulative amount not to exceed $20,000, for the remaining sites to be sold. OB - 176 A RESOLUTION OF THE OVERSIGHT BOARD OF DIRECTORS FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY REQUEST APPROVAL TO UTILIZE THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE (ROPS) 2017/2018B AND 2018/2019, COSTS ASSOCIATED WITH DISPOSITION OF ASSETS FOR THE APPRAISAL OF VARIOUS SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY (SARDA) PARCELS LISTED ON THE LONG RANGE PROPERTY MANAGEMENT PLAN (LRPMP). RECITALS: A. Pursuant to Health and Safety Code Section 34179(3), all actions taken by the Oversight Board for Successor Agency to the Palm Desert Redevelopment Agency (Oversight Board) shall be adopted by resolution. There has been presented to this Oversight Board for approval to utilize the Recognized Obligation Payment Schedule (ROPS) 2017/2018B and 2018/19, costs associated with disposition of assets for the appraisal of various SARDA parcels listed on the LRPMP. NOW, THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this Resolution. Section 2. The Oversight Board hereby adopts Resolution No. OB - 176 approve to utilize the Recognized Obligation Payment Schedule (ROPS) 2017/2018B and 2018/19, costs associated with disposition of assets for the appraisal of various SARDA parcels listed on the LRPMP. Section 3. The staff of the SARDA is hereby directed to provide the State Department of Finance ("DOF") written notice and information regarding the action taken by the Oversight Board in Section 2 of this Resolution. Such notice and information shall be provided by electronic means and in a manner of DOF's choosing. 1 RESOLUTION NO. OB - 176 Section 4. The officers of the Oversight Board and staff of the SARDA are hereby authorized and directed, jointly and severally, to do any and all things which they may deem necessary or advisable to effectuate this Resolution.
