A. RESOLUTION NO. 76-145 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING A
CITY PARKS AND RECREATION COMMISSION AND APPOINTING MEMBERS
Mr. Bouman explained that this resolution had been prepared
pursuant to numerous requests from the citizens of the com-
munity for the establishment of such a commission. Council-
man Seidler stated that this was discussed at length in
Study Session by Council and that they were in agreement
that setting up this commission was definitely in the best
interest of the community.
Councilman Seidler moved and Councilman Mullins seconded to
waive further reading and adopt Resolution No. 76-145. Motion carried
unanimously.
Mayor Brush advised that three members had been proposed for
the commission, those being Reverend Daryl Bjerke, Mr. John A. Hill, and
Mrs. Dolores Driskell, and he recommended their appointment. He further
stated that the remaining members would be appointed at the December 23,
1976, meeting.
Councilman Newbrander moved to approve the appointment of the
3 recommended individuals for membership on the Parks & Recreation
Commission. Councilman Mullins seconded the motion; carried unanimously.

VII. PUBLIC HEARINGS
A. CASE NO. C/Z 06-76: City Council Initiated Prezoning of
121 Acres of Land Being Annexed to the City of Palm Desert,
California, from R-1-12,000 (County) to 60 Acres of (UA)
S.I., S.P. (Service Industrial) and 60 Acres of (UA) O.S.
(Open Space).
Mr. Paul Williams outlined the background and justification
for the project. He stated that Section 25.39-6 of the
Zoning Ordinance establishes two methods for zoning property
about to be annexed by the City. In the first approach,
the property is automatically placed in the 'S' (Study)
Zone District on the date the annexation becomes effective.
The Planning Commission then has not more than one year to
recommend permanent zoning for the property to the City
Council. The other method, which is being utilized in this
case, calls for the City to pre -zone the subject site prior
to its official annexation. The pre -zoning approach is
considered by the staff to be appropriate in this case since
the potential uses of the site are clearly defined by the
General Plan.
The implementation policies of the Land Use Element strongly
support the continued development of Service Industrial in
this area, with the only provision that the zoning of indus-
trial areas match the absorption trends for industrial
uses in the Coachella Valley, The staff believes there is
more than enough demand at this time for additional S.I.
development.
The General Plan shows the Sand Dune Preserve west and north
of the Light Industrial area. The subject property extends
westernly halfway into the Sand Dune designation. The
staff therefore is recommending that the east half of
the property be zone (UA) S.I.,S.P. and the west half (UA)
O.S. The pre -zoning designation - UA (Upon Annexation)
is shown on the Zoning Map at this time. Once annexation
is completed, the UA prefix is removed.
Mr. Williams pointed out that the Planning Commission had
considered this pre -zoning on November 4, 1976, and had
recommended approval to the City Council by their Resolu-
tion No. 190.
Mr. Williams added that he had received a letter from Mr.
Harry Schmidt of the City of Indian Wells had sent him a
letter stating that Indian Wells had not been notified of
this prezoning and requesting an extension of time so that
they might be able to review it. It was noted that a letter
had been sent to Mr. Schmidt but for some reason, he did not
receive it.
Mayor Brush declared the public hearing open.
Mr. Charles Gibbs, 70673 Oroville Circle, Rancho Mirage,
addressed Council expressing his strong support for this
rezoning. He stated that this zoning was greatly needed
in Palm Desert as there was no other land so zoned. His
firm has a real need for storage space for numerous pieces
of heavy equipment as well as for large tree storage. He
clarified that this was not a nursery, but rather a place
to keep the large trees until they were ready for planting
in the various condominium developments being constructed.
Mr. George Ritter, 73-889 Highway 111, Palm Desert, addressed
Council opposing the rezoning in that he felt it was premature
to rezone the entire acreage. He felt that only a portion
of it being rezoned would be adequate.

Mr. Cliff Swanson, 45-529 Adams Street, Bermuda Dunes,
addressed Council in support of Mr. Ritter's statements.
He asked if it would not be more appropriate to issue a
zoning variance for the amount of land required rather
than rezone all of it.
Mr. Harry Schmidtz, representing the City of Indian Wells,
addressed Council stating that they had not received their
letter advising them of this proposed prezoning. He there-
fore requested that the City Council continue the matter
until his Planning Commission and City Council had had
an opportunity to do so.
Councilman Seidler asked assuming that the Council were to
approve the rezoning and assuming the applicant did ask for
prezoning, what additional guidelines would he have to work
under and is he fully aware of these? Paul Williams responded
that the applicant must have a development plan including
roads, undergrounding standards specified in the S.I. zone,
etc. and all of that would have to occur before any develop-
ment began. Councilman Seidler asked about the 24 hours
of noise which would occur with such development, and Mr.
Williams responded that those problems would be addressed
as part of a development plan. Councilman Seidler asked
if there was any other S.I. zoning within the City limits,
and Mr. Williams advised that there was not.
Mayor Brush declared the Public Hearing closed.
Councilman McPherson emphasized that he would hope that
in the spirit of cooperation between neighboring cities,
that Council would accept Staff's recommendation to con-
tinue the hearing. City Attorney, Dave Erwin, stated that
if this were to be done, the Mayor should reopen the hearing.
Mayor Brush declared the Public Hearing reopened.
Councilman McPherson moved and Councilman Mullins seconded to
continue the hearing to the meeting of January 13, 1976. Motion carried
unanimously.
VIII. RESOLUTIONS
A. RESOLUTION NO. 76-142A- A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND AUTHORIZING THE DESTRUCTION OF FILES FROM THE
DEPARTMENT OF BUILDING & SAFETY THAT HAVE BEEN MICROFILMED.
Mr. Bouman explained that this was a routine housekeeping
resolution allowing the Building Department to destroy
many of their bulky sets of papers that have now been
microfilmed for record.
Councilman McPherson moved and Councilman Seidler seconded to
waive further reading and adopt Resolution No. 76-142. Motion carried
unanimously.
B. RESOLUTION NO. 76-143 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM DESERT, CALIFORNIA, AUTHORIZING A
REFUND OF AN OVERCHARGE OF A WEED ABATEMENT TAX LIEN AND
AUTHORIZING A BUDGET TRANSFER THEREFOR.
Mr. Bouman explained that this was a rather unusual situa-
tion in that the citizen involved was out of the country
and did not receive his notification of the need to abate
the nuisance on his property. A substantial fee was
involved, well in excess of $700. Under the circumstances,
the Staff feels that the 25% administrative fees should be
refunded. The amount involved is $138.63.

Councilman Newbrander moved and Councilman Mullins seconded to
waive further reading and adopt Resolution No. 76-143. Motion carried
unanimously.
C. RESOLUTION NO. 76-144 - A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM DESERT, CALIFORNIA, REJECTING THE BIDS
FOR CONTRACT 1003, COMMUNITY PARK LIGHTING, RECEIVED ON
NOVEMBER 22, 1976, AND AUTHORIZING THE CITY CLERK TO
READVERTISE.
Mr. Bouman explained that three bids had been received
for the Community Park Lighting Project in the amounts
of $21,000, $16,000, and $13,000. All three bids were
considerably in excess of the engineer's estimate and
Staff thinks that the project should be readvertised.
Mr. Cook added that in discussing this with potential
bidders, they expressed the opinion that we could get
lower bids.
Councilman Mullins moved and Councilman McPherson seconded to
waive further reading and adopt Resolution No. 76-144. Motion carried
unanimously.
IX. ORDINANCES - For Introduction:
A. ORDINANCE NO. 134 - AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, DEALING1 WITH UNIFORII
TRANSIENT OCCUPANCY TAX IN SAID CITY.
Mr. Erwin stated that all of the following ordinances were
being presented as a result of the City's codification of
their ordinances. These changes were necessary to incor-
porate other changes made, updating, and uniformity.
Mr. Erwin explained that the changes involved in Ordinance
No. 134 involved Section 2 (B), Definitions, Section 2 (G),
Tax Administrator, and the violation section of the ordinance.
Councilman Newbrander moved to waive further reading and pass to
second reading and Councilman Mullins seconded the motion; carried unani-
mously.
B. ORDINANCE NO. 135 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 118,
RELATING TO THE UNIFORM BUILDING CODE OF SAID CITY.
Mr. Erwin explained that the only major change here was the
deletion of reference to Chapter 16 of the 1973 Edition of
the Uniform Building Code, Uniform Code Standards and their
appendices. He advised that it did not change the ordinance.
Councilman Mullins moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No. 135 to second reading.
Motion carried unanimously.
C. ORDINANCE NO. 136 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 110
OF SAID CITY, RELATING TO CHARITABLE, RELIGIOUS AND NONPROFIT
SOLICITATIONS.
Mr. Erwin explained that this changed the penal processes
and made them uniform to the rest of the ordinances.
Councilman McPherson moved and Councilman Mullins seconded to
waive further reading and pass Ordinance No. 136 to second reading.
Motion carried unanimously.

D. ORDINANCE NO. 137 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 92,
REGULATING POLITICAL SIGNS IN SAID CITY.
Mr. Erwin explained that this amendment modified Paragraph 9
of the ordinance in that it provided for a separate account
for political sign removal. It merely expands the ordinance.
Councilman Newbrander moved and Councilman Mullins seconded to
waive further reading and pass to second reading Ordinance No. 137.
Motion carried unanimously.
E. ORDINANCE NO. 138 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 116
OF SAID CITY, PROVIDING FOR THE ADMINISTRATION OF DISASTER
OPERATION AND RELIEF IN THE CITY OF PALM DESERT, CALIFORNIA.
Mr. Erwin explained that this was merely the addition of a
clause "in carrying out the provisions of this ordinance."
to Section 7.1 of the ordinance and that it protected the
City's liability in the event of disaster.
Councilman McPherson moved and Councilman Seidler seconded to
waive further reading and pass to second reading Ordinance No. 138.
Motion carried unanimously.
F. ORDINANCE NO. 139 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 11,
RELATING TO REAL PROPERTY DOCUMENTARY TRANSFER TAX.
Mr. Erwin explained that the amendment provided for
Section 5 "Government and its Agencies Not Liable" and
Section 5.5 "Tax Inapplicable to Deed, Instrument or
Writing Taken in Lieu of Foreclosure".
Councilman McPherson moved and Councilman Mullins seconded to
waive further reading and pass to second reading Ordinance No. 139.
Motion carried unanimously.
G. ORDINANCE NO. 140 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 121,
RELATING TO DOGS AND OTHER DOMESTIC ANIMALS IN SAID CITY.
Mr. Erwin pointed out that it merely added "sheriffs" as
officers whose duty it would be to carry out the provisions
of the ordinance.
Councilman Newbrander moved and Councilman Mullins seconded to
waive further reading and pass to second reading Ordinance No. 140.
Motion carried unanimously.
H. ORDINANCE NO. 141 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 58,
RELATING TO TAXICABS AND RENT CARS.
Mr. Erwin explained that this modified the definition of
rent cars providing exception for charter buses regulated
by Public Utilities Code, Section 5351.
Councilman McPherson moved and Councilman Mullins seconded to
waive further reading and pass Ordinance No. 141 to second reading.
Motion carried unanimously.
I. ORDINANCE NO. 142 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 84,
RELATING TO REGULATION OF COLLECTION, SOLID WASTES.
Mr. Erwin explained that this amendment provided within the
ordinance the definition of "health officer".

waive further reading and pass Ordinance No. 142 to second reading.
Motion carried unanimously.
J. ORDINANCE NO. 143 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 37,
RELATING TO ABATEMENT AND REMOVAL AS PUBLIC NUISANCES OF
ABANDONED VEHICLES.
Mr. Erwin explained that the amendment made minor modifica-
tion to the dates involved the the ordinance and provided
a statement that "This section does not apply to those
vehicles exempt under Section 22660 of the Vehicle Code
of the State of California.".
Councilman Seidler moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No. 143 to second reading.
Motion carried unanimously.
K. ORDINANCE NO. 144 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 20,
RELATING TO UNDERGROUND UTILITY DISTRICTS IN SAID CITY.
Mr. Erwin stated that the changes were procedural to bring
our ordinance into conformance with the changes made in the
Streets and Highways code.
Mr. Kermit Martin, General Manager of the Southern California
Edison Company, Palm Desert, addressed Council indicating
that he had not had an opportunity to review this ordinance
and asked that it be held over to the next meeting.
Councilman Newbrander moved and Councilman Mullins seconded to
defer action on Ordinance No. 144 until the meeting of December 23, 1976.
Motion carried unanimously.
L. ORDINANCE NO. 145 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 57
OF SAID CITY, ESTABLISHING PENALTIES FOR ORDINANCE VIOLATIONS.
Mr. Erwin pointed out that this amendment will be used as
a general penalty provision for violation of all City ordi-
nances. It modified the City's existing Ordinance No. 57
substantially.
Councilman McPherson moved and Councilman Mullins seconded to
waive further reading and pass Ordinance No. 145 to second reading.
Motion carried unanimously.
M. ORDINANCE NO. 146 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, RELATING TO DEFINITIONS OF
THE LANGUAGE OF THE ORDINANCES OF SAID CITY.
Mr. Erwin explained that this ordinance was recommended by
the codification company in that it would make all terminology
and definitions in the City's ordinances of a uniform and
standard nature.
Councilman Mullins moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No. 146 to second reading.
Motion carried unanimously.
N. ORDINANCE NO. 147 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, SPECIFICALLY REPEALING
ORDINANCES IN SAID CITY.
Mr. Erwin explained that this ordinance went back to the
incorporatio31 of the City and picked up ordinances or
sections of ordinances that have been specifically repealed
and so lists them.

waive further reading and pass Ordinance No. 147 to second reading.
Motion carried unanimously.
O. ORDINANCE NO. 148 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, RELATING TO MUNICIPAL CAM-
PAIGN CONTRIBUTIONS AND EXPENDITURES AND AMENDING ORDINANCE
NO. 90 OF SAID CITY.
Mr. Erwin stated that the paragraph is this ordinance
restricting campaign expenditures had been suspended
previously by the former Council. However, now it
should be formally repealed.
Councilman Mullins moved and Councilman McPherson seconded to
waive further reading and pass Ordinance No. 148 to second reading.
Motion carried unanimously.
X. CONSENT ITEMS HELD OVER
F. PETITION from Homeowners on Tamarisk Street, East of Desert
Lily Drive Requesting Their Block Be Omitted from Any Forced
Proceedings to Require Curbs and Gutters.
Councilman Newbrander stated that she had requested this
item be removed in that there seemed to be grave concern
that citizens were being forced to put in curbs and
gutters. She pointed out that this had been suggested as
a voluntary solution to water problems and that at no time
had the City made any announcement that it was to be manda-
tory.
Mr. Bouman stated that the City had also received a letter
from the Palm Desert Property Owners Association requesting
that the City not make the installation of curbs and gutters
mandatory until a more comprehensive study could be made.
He continued that one of the grants that the City had made
applications for would, however, require $2,000,000 worth
of curbs and gutters in various places in the City. These
would not be at the property owners' expense, but people
should realize that this type of installation is as much
a protective measure as it is to control drainage. The
protection is for the streets and the investment we have
in them. People must understand that the City will find
times when it is forced to put in curbs and gutters for
this reason.
G. LETTER from Mrs. L. W. Scannel, 73-610 Grapevine, Palm
Desert, California, Protesting the Placing of Fill Dirt
on the Lot Adjacent to Her Home.
Mrs. L. W. Scannel addressed Council expressing strong
concern over the fill dirt placed in the lot adjacent
to her. She indicated that when she purchased her home,
the lot next door was even with hers. Now it was at
least 5 feet higher. Her concern was that with the next
rain, she would have all of this dirt running through her
home and yard again.
Mr. Walter Curry, 73-706 Shadow Lane, Palm Desert, addressed
Council supporting Mrs. Scannel's complaint.
Mr. Ruston, 76-630 Grapevine, Palm Desert, addressed Council
with the same concerns and supporting Mrs. Scannel.
Mr. Bouman stated that the City now finds itself in some-
what of a dilema in that mistakes were made in the past
that we must now live with but that we must correct in the
future. In many places in town, you can see where building

pads were not properly elevated, particularly on the north
sides of the street, and serious drainage problems have
occurred. The City is now attempting to correct this
situation by requiring the elevation of building pads.
However, no elevation is being required wherein a neigh-
boring resident's property will be jeopardized by drainage
problems.
Mr. Jim Delaland, 73-702 Shadow Lane, Mr. Leo Scannel,
73-610 Grapevine, and Mr. Bill Hall, 73-335 Tamarisk,
also spoke relative to the problem of elevating building
pads.
Mr. Bouman assured Mrs. Scannel that the City Staff would inves-
tigate the situation at her home and felt that some of the Councilmembers
would also take a look at the situation.
XI. CONTINUING BUSINESS
XII. NEW BUSINESS
A. AGREEMENT WITH PALM DESERT POST for the Period of December 31,
1976, through December 31, 1977, to Act as Official Newspaper
for all City Legal Advertising.
Mr. Bouman reported that this was the same contract as
entered into the year before with the same rates applying.
He further pointed out that the Palm Desert Post was the
only local newpaper.
Councilman Newbrander moved and Councilman Mullins seconded to
approve the Agreement and authorize the Mayor to sign. Motion carried
unanimously.
XIII. OLD BUSINESS
A. REQUEST for Authorization for the Advertisement for Bids
for Curb, Gutter, and Sidewalk Installation in the Commer-
cial Area (Contract No. 1005).
Mr. Bouman explained that this was a step forward in action
already approved by Council wherein the curbs, gutters, and
sidewalks would be installed with the property owners'
cooperation. The City will have the work done and the
property owners will reimburse the City.
Councilman McPherson moved and Councilman Seidler seconded to
adopt Resolution No. 76-146 approving the plans and specifications for
Contract No. 1005 and establishing a date to receive bids. Motion
carried unanimously.
XIV. ORAL COMMUNICATION
None
XV. REPORTS AND REMARKS
A. City Manager
Mr. Bouman reported that a claim was hand delivered to
Sacramento earlier in the week. It was filed
under the Public Works Employment Act in the amount of
$450,000.00 and is for reimbursement of expenditures for
flood damage as well as additional monies for street
improvements, etc. If the grant is approved, the City
can expectiapproximately 75% of the money immediately,
with the remaining 25% paid following an audit. We
should know the status of the claim in 30-45 days.
The $2 million curb and gutter grant application and the
$5 million master drainage application are still pending
but the City should be notified on the first application
the week prior to Christmas.

B. City Attorney
Mr. Erwin presented a list a Claims filed against the City
which had been received after Agenda preparation. (This
list is attached and made a part of these minutes.) Mr.
Erwin advised that the Council take the same action as
in previous claims and deny them.
Councilman Newbrander moved and Councilman Mullins seconded to
deny the claims and direct the City Clerk to so advise the claimants.
Motion carried unanimously.
C. Mayor and City Council
Councilman Newbrander asked the other members of Council to
go and look at the situation on Grapevine.
XVI. ADJOURNMENT
Councilman McPherson moved and Councilman Seidler seconded to
adjourn the meeting. Motion carried unanimously. Mayor Brush adjourned
the meeting at 9:15 p.m.
