CALL TO ORDER Mayor Pro-Tem Ed Mullins called the meeting to order at 7:00 p.m. on Thursday, July 8, 1976, in City Hall Council Chambers. II. PLEDGE III. INVOCATION IV. ROLL CALL Present: Councilman Newbrander Councilman Seidler Mayor Pro-Tem Mullins Absent: Mayor Brush Councilman McPherson Also Present: Harvey L. Hurlburt, City Manager David J. Erwin, City Attorney Paul A. Williams, Director/Environmental Services V. AWARDS, PRESENTATIONS, AND APPOINTMENTS A. APPOINTMENT of Representative and One Alternate to the Southern California Association of Governments. Mr. Hurlburt pointed out that the representatives prior to the March election had been Mayor Henry Clark and Mayor Pro-Tem Noel Brush as alternate. He stated the importance of Palm Desert's participation in this organization. Councilman Newbrander moved and Councilman Seidler seconded that Mayor Noel Brush be appointed as the delegate to SCAG and that Mayor Pro-Tem Ed Mullins be appointed as the alternate delegate. Motion carried unanimously. VI. CONSENT CALENDAR A. MINUTES of the June 24, 1976, Meeting of the City Council. B. MINUTES of the June 29, 1976, Adjourned Meeting of the City Council. C. MINUTES of the June 30, 1976, Adjourned Meeting of the City Council. D. CASE ZOC 04-76, BILL HUNTER, APPLICANT: Report from the Planning Commission that a Business Involved in the Sales, Assembly, Storage, and Distribution of Solar Energy Systems, Would Be Acceptable in the C-1, S-I, P-I, and PC(3) Zoning Districts. O'DONNELL for the TRANSYLVANIC RESTAURANT CORPORATION, 72-820 El Paseo, Palm Desert, California. Rec: Receive and file. F. LETTER from Mrs. Rosalie Rojas, 44-795 San Juan Avenue, Palm Desert, California, Requesting Street Improvement for San Juan Avenue in Palm Desert and City Manager's Reply. Rec: Receive and file. G. LETTER from Mrs. W. Coy FILMER (Jeanne W.) Regarding Support for the Caravan Cab Company. Rec: Receive and file. H. LETTER from Mr. and Mrs. Roy A. Koehler, 44-710 San Benito Circle, Palm Desert, California, Commending Frank Allen, Code Enforcement Supervisor. Rec: Receive and file. Councilman Seidler requested that Item D be removed from the Consent Calendar and held over for a two week period to be placed on the July 22, 1976, Consent Calendar. Council agreed to the action. Councilman Newbrander moved that the Consent Calendar be approved with the removal of Item "D". Councilman Seidler seconded the motion. Motion carried unanimously. VII. PUBLIC HEARINGS A. REVIEW of the Final Environmental Impact Report on the New Sign Ordinance for the City of Palm Desert, California. Mayor Pro-Tem Mullins declared the public hearing open. Mr. Williams reviewed the particulars of the Final Environmental Impact Report for Council and offered to answer questions if there were any. Mayor Pro-Tem Mullins stated that this and the Sign Ordinance itself were probably the most controversial items Council would face and serious study and consi- deration should be made before action was taken. Councilman Seidler stated his agreement with this. Mayor Pro-Tem Mullins asked for comments from the audience in favor of the EIR and there were none. Mayor Pro-Tem Mullins asked for comments against the EIR and there were none. Councilman Newbrander moved to continue the Public Hearing on the Final Environmental Impact Report on the New Sign Ordinance to the meeting of July 22, 1976; Councilman Seidler seconded the motion. Motion carried unanimously. B. CASE NO. ZOA 02-76, SIGN ORDINANCE: Public Hearing on the Adoption of a New Sign Ordinance for the City of Palm Desert, Amending Section 25.38 of the Palm Desert Municipal Code. Mayor Pro-Tem Mullins declared the Public Hearing open. Mr. Williams reviewed the Sign Ordinance for Council and offered to answer questions. July 8, 1976 Page 2 Mayor Pro-Tem Mullins asked for input from the audience in favor of the Sign Ordinance and there was .none. Mr. Jim Ingle, Imperial Sign, addressed Council in opposi- to the Sign Ordinance stating that the Ordinance was too restrictive. He pointed out that electrical signs were limited in size; that the size of signs on vehicles was limited and that internally lit signs were restricted too much. No other input was offered. Councilman Seidler moved to continue the hearing to the meeting of July 22, 1976, and Councilman Newbrander seconded the motion. Motion carried unanimously. VIII. RESOLUTIONS A. RESOLUTION NO. 76-90 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPOINTING A REPRESENTATIVE TO THE FEDERAL AID URBAN PROGRAM PROJECT ADVISORY COMMITTEE. Mr. Hurlburt presented the provisions of the resolution. Councilman Newbrander moved to waive further reading and adopt Resolution No. 76-90 appointing the City Engineer as representative to the Federal Aid Urban Program. Councilman Seidler seconded the motion; carried unanimously. B. RESOLUTION NO. 76-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING RIGHT-OF-WAY CONTROL AT VARIOUS INTERSECTIONS. Hunter Cook, City Engineer, explained that the inter- sections covered in this resolution were among many that were being studied by the Engineering Department. He further stated that it was his recommendation that "Yield" Signs be placed at the listed intersections rather than "Stop" Signs in that it was appropriate and less citations would result from this action. Councilman Seidler moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No. 76-91; carried unanimously. IX. ORDINANCES For Introduction: None For Adoption: A. ORDINANCE NO. 123 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING COUNTY ORDINANCE NO. 421 RELATING TO SWIMMING POOL ENCLOSURES. Mr. Hurlburt pointed out that this was a second reading and that he would answer questions if Council had any. Councilman Seidler moved to waive further reading and adopt Ordinance ko. 123. Councilman Newbrander seconded the motion; carried unanimously. X. CONSENT ITEMS HELD OVER None XI. CONTINUING BUSINESS None July 8, 1976 Page 3 XII. NEW BUSINESS None XIII. OLD BUSINESS A. CONSIDERATION of a Revised "Committee Composition" for the Solar/Energy Committee. Mr. Hurlburt stated that this was a change in the make up of the Committee and since it was Mayor Brush's suggestion to take this action, Mr. Hurlburt recommended that Council hold the item over until the Mayor was present. Council agreed to continue the item to the meeting of July 22, 1976. XIV. ORAL COMMUNICATIONS Any person wishing to discuss any item not otherwise on the Agenda may address the City Council .at this point by stepping to the podium and giving their name and address for the record. Remarks shall be limited to a maximum of five (5) minutes unless additional time is authorized by the City Council. None XV. REPORTS AND REMARKS A. City Manager None B. City Attorney None C. Mayor and City Council None XVI. ADJOURNMENT. Councilman Newbrander moved and Councilman Seidler seconded to adjourn the meeting. Carried unanimously.
