CALL TO ORDER Mayor Wilson called the Special Meeting of the City Council to order at 9:45 a.m. II. PLEDGE OF ALLEGIANCE - Councilman Romeo S. Puluqi IIl. INVOCATION - Mayor Pro-Tempore Alexis D. Newbrander IV. ROLL CALL Present: Excused Absence: Mayor Pro-Tempore Alexis D. Newbrander Councilman Romeo S. Puluqi Councilman Walter H. Snyder Mayor 5. Roy Wilson Also Present: Councilman James E. McPherson Ramon Diaz, Director of Environmental Services Jeff Patterson, Deputy City Attorney Barry McClellan, Director of Public Works Joe Palomino, Acting Director of Building a( Safety Paul Byers, Director of Finance Sheila Gilligan, City Clerk V. OLD BUSINESS A. CONSIDERATION OF A REQUEST TO REJECT ALL BIDS RECEIVED FOR THE CONSTRUCTION OF THE CIVIC CENTER. Mr. Diaz stated that the reason for the Special Meeting of the Council was to consider Staff's recommendation to reject all bids on the proposed civic center and instruct staff to negotiate with previous bidders. He noted that the Council, after reviewing the contractors' bids at its May 20, 1982, Study Session, had instructed Staff and consultant to: A) Evaluate reducing cost using "or equal" substitutions; or B) Negotiate with the lowest bidder or bidders to reduce the overall cost of the civic center project to within budgetary limitations. He stated that at this point, it was clear that Alternative (A) did not result in the overall reductions designated. The City Attorney had advised Staff that any alterations beyond the "or equal" can only be done by firstly rejecting all bids and negotiating with either the low bidder or all firms submitting bids on the project (Alternative B). He said that in order to accomplish the alternative in the shortest time period, a Special Meeting of the Council was duly noticed and convened. In order to reject all bids and negotiations with previous bidders, he noted a 4/5 vote of the Council would be necessary. Instruct Staff and consultant to meet and discuss the project with all bidders. 3. Said discussion to be designed to bring the civic center project to within acceptable budgetary limitations (i.e. $2.4 Million or less). 4. Bidders should be requested to submit the alternate proposals for cost reduction to be reviewed by the City no later than 10:00 a.m. on June 8, 1982. 5. As part of Item 4, said bidders should submit a project cost which the City shall use to determine the contract bid. Mr. Diaz concluded by stating that Staff was working towards a deadline so the City could award the contract at its June 10, 1982, Regular City Council Meeting. However, in the event these time limitations presented an undue constraint, the Council could award the contract at its June 24, 1982,, meeting, and still have the contract awarded prior to June 30, 1982, or the end of the fiscal year. Mayor Wilson asked for input from the consultant. MR. JOHN BALLEW, Ballew/Arbuckle/Martin, addressed Council stating that he felt they, the consultant, should be allowed to reevaluate the existing plans and specifications to determine if "or equal" reductions could bring the project within the budgetary limitations. He felt his firm had been employed to do this job and should be allowed the opportunity to complete it. Council discussion with staff and the consultant followed relative to "or equals" and who should be responsible for bringing the project into budgetary limitations. Councilman Snyder moved to give the architect (consultant) time to compile data and submit it to the City Staff so that a decision could be made by the Council at its June 10, 1982, meeting. Councilman Newbrander seconded the motion. Motion carried by unanimous vote of the Councilmen present. VI. ADJOURNMENT Upon motion by Snyder, second by the Mayor, and unanimous vote of the Councilmen present, Mayor Wilson adjourned the Special Meeting at 10:35 a.m. ATTEST: SHEILA R.
