Rec: By Minute Motion, authorize staff to defer fees
for a one-year period.
0. REQUEST FOR AUTHORIZATION TO ADVERTISE & CALL FOR BIDS for
Private Sector Traffic Signal Maintenance (Contract No.
00-255).
Rec: By Minute Motion, authorize the City Clerk to
advertise for bids.
Mr. Ortega asked that items "A" and "1" be removed for
continuance to the next meeting.
Councilman Crites asked that Item "N" be removed for discussion
under Section IX, Consent Items Held Over.
• Upon motion by Crites, second by Snyder, the Consent Calendar, with
the exception of Items A, 1, and N, was approved as presented by
unanimous vote of the Council.
VI. ORAL COMMUNICATIONS - A
MR. VIC VILLENEUVE, 43-339 Martini Court, Palm Desert,
addressed the Council regarding the Civic Center Master Plan.
Me said he knew about it only because he had read an article in
the employee newsletter and that as homeowner in the property
adjacent to the Civic Center, he was upset that he and his
neighbors had not been allowed an opportunity to review it and
give input. He suggested a subcommittee be formed which he
offered to chair.
Mayor Kelly informed Mr. Villeneuve that the City Council had
not yet seen the plan inasmuch as a subcommittee, which was
already formed and had been for several months, was reviewing
it and meeting with representatives of the College of the
Desert to get their input as co -tenants in the plan. He
pointed out that the plan would be reviewed by the Parks 8
Recreation Commission and in public hearings by the Planning
Commission and the City Council at which time adjacent property
owners would be notified and asked for input.
Councilman Snyder said he was on the subcommittee, made up of
two members of the Council, two of the Planning Commission, and
staff, which was reviewing the plan. He said nothing about the

plan was set in concrete and that public testimony would be
welcomed at the appropriate time or in the public hearings.
VII. RESOLUTIONS
A. RESOLUTION NO. 87-95 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, RESCINDING RESOLUTION
NO. 86-57 AND AMENDING RESOLUTION NO. 85-121 BY INCREASING
THE MEMBERSHIP ON THE CIVIC ARTS COMMITTEE FROM 11 TO 13.
Mayor Kelly stated that when the Council interviewed
prospective members of the Civic Arts Committee, the
applicants were so outstanding that it seemed a shame not
to let all of them Join the committee and add their
expertise. With that in mind, he had approached the
Committee about expanding the membership from 11 members
to 13 members, and the Committee unanimously endorsed the
concept. He recommended the Council adopt the proposed
resolution which would accomplish this expansion.
Upon motion by Wilson, second by Snyder, Resolution No. 87-95 was
adopted by unanimous vote of the Council.
VIII. ORDINANCES
For Introduction:
A. ORDINANCE NO. 519 - AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM _DESERT, CALIFORNIA, REGULATING THE
PARKING OF TRUCKS AND RECREATIONAL VEHICLES.
Mr. Allen reviewed the staff report and recommendation
noting that the proposed ordinance came as a result of
numerous complaints. He said that country clubs were not
allowing their property owners to park these vehicles on
the private streets therein and therefore they were being
parked outside the walls and on public streets which
brought complaints from those residents. He added that
RV's could still be parked in driveways if moved regularly
and that they could be stored in rear yards and
recommended introduction of the ordinance.

Council Comments
Crites: We're playing a shell game and prohibiting them
on streets will not be any better. It will just bring out
a different group of people.
Mayor Kelly: Agreed the ordinance would not solve the
problem, but it was another stab at it.
Upon motion by Snyder, second by Benson, Ordinance No. 519 was
passed to second reading by unanimous vote of the Council.
For Adoption:
A. ORDINANCE NO. 514 - AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AMENDING TITLE 27,
GRADING, OF THE PALM DESERT MUNICIPAL CODE.
Mr. Folkers asked for a two -week continuance to allow
staff time to make a more thorough report.
Upon motion by Benson, second by Crites, and unanimous vote of the
Council, consideration of the adoption of Ordinance No. 514 was continued
to the meeting of November 12, 1987.
B. ORDINANCE NO. 517 - AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AMENDING TITLE 28 OF
THE PALM DESERT MUNICIPAL CODE RELATING TO THE PREVENTION
OF FLOOD DAMAGE.
Mr. Ortega stated that no input had been received since
first reading of the ordinance and recommended its
adoption.
Upon motion by Crites, second by Snyder, Ordinance No. 517 was
adopted by unanimous vote of the Council.

N. REQUEST BY THE NEWMAN CENTER for Postponement of Fees.
Rec: By Minute Motion, authorize staff to defer fees
for a one-year period.
Councilman Crites said he had asked for discussion on this item
because he wanted to know if the Center had been required to
make off -site improvements in its approval, i.e. paving of its
parking lot. Mr. Diaz responded it was a condition of
approval, and Mrs. Gilligan added that this request was being
made to allow the Center to move forward with the paving by way
of a donation with permit fees postponed for a year.
Councilman Crites moved to authorize staff to defer fees for a one-
year period. and Councilman Snyder seconded the motion. Motion carried
by unanimous vote.
X. NEW BUSINESS
A. REQUEST FOR AWARD OF CONTRACT NO. 00-181C for Civic Center
Modifications.
Mr. Conlon referred to a memo to the City Council dated
October 20, 1987, which reflected the construction bids
received and a recommendation to:
1)
Award the construction contract to Kretz Construction
Co., the lowest responsible bidder, at the price of
$265,049.00, which included the work covered in the
base bid and alternate bid; and
2) To authorize the Director of Finance to appropriate
$304.806.35, which includes a 15% contingency. from
the New Construction Tax Fund to cover the cost of
the contract.
Councilman Crites stated that he had spent some time going
over the proposed modifications with architect John
Outcault and that if the work were going to be done, he

would recommend the following additions or changes to the
plans:
1. Apron - install microphone outlets and 110 volt
plugs;
2. Either eliminate sound curtain in open area in rear
or move to 1/4 coverage;
3. Decide where the aerial photo of the city is to be
hung and light it;
4. Sound material - go from oak to wood painted to match
the existing room. Back material should not be black
but beige.
5. Podium - install a new and expanded top so that
speakers can open a notebook on it;
6. TV monitors - either eliminate them and put up a wall
screen on the left wall or make them flush mount on
the desk tops so that space is not eliminated as it
is now.
7. Slides - make sure the angle of the screen from the
new Council seating is not severe.
Mr. Ortega recommended that, to insure the legality of the
bidding process, the Council award the contract as it was
bid without any extras and then consider a change order in
the future to accommodate these new additions.
Councilman Snyder moved to: 1) Award the construction contract to
Kretz Construction Co., the lowest responsible bidder, at the price of
$265,049.00, which included the work covered in the base bid and
alternate bid; and 2) to authorize the Director of Finance to appropriate
$304,806.35, which includes a 15% contingency, from the New Construction
Tax Fund to cover the cost of the contract. Councilmember Benson
seconded the motion. Motion carried by a 3-2 vote with Councilmen Crites
and Wilson voting NO for reasons previously stated (see Minutes of
September 24, 1987, meeting).
B. REQUEST FOR APPROVAL OF CITY PHYSICIAN SERVICES.
Mr. McAllister reported that the Council had approved a
contract for physician services in 1984 and that doctor
had now retired. He recommended that the City approve an
agreement with the Eisenhower Immediate Care Centers to
provide this service which dealt with employee physicals,
workmen's compensation injuries, and executive physicals.
Councilman Crites moved to, by Minute Motion, authorize staff to
retain the Eisenhower Immediate Care Centers to provide City physician
services. Councilman Snyder seconded the motion. Motion carried by
unanimous vote.

C. Informational Items:
1. Alternatives to Using Traffic Signals to Control
Traffic Flow.
City Council Comments
Wilson: Complimented staff on the "very comprehensive"
report. He asked whether or not it would be possible to
have these alternative methods considered in the approval
process of developments. Mr. Folkers advised that it
would noting that it would take more staff time.
Snyder: Concurred with Wilson there are better ways to
control traffic, and they should be explored.
Crites: Said Council had approved an experimental
alternative a year ago when it approved an application for
a grant which would install devices to keep signals
green/red for a two -minute period of time. He said this
procedure was being used on Monterey Avenue and Fred
Waring Drive right now, and a number of people were just
simply drawing the same conclusion he was that the signal
was broken and running it. He suggested that a press
release be issued advising people that this was an
experimental program so they would not run the lights.
Wilson: Said he had received compliments on this program
in that through traffic was moved more quickly. Mayor
Kelly said he thought the Council should worry about the
local people, not those using our city as a thoroughfare.
Kelly: Thought the flv-way had much potential for the
city down the road in that it would provide good access to
the interstate. Felt Council should take the report one
step further and set down some agreed -upon guidelines so
that when a project is processed. traffic objectives would
be reviewed in light of the guidelines. Suggested a
guideline that would prohibit stop signs within 1/2 mile
of each other.
Crites: Said he had attended a Riverside/San Bernardino
Counties Businessmen's Association meeting where the
Riverside County Director of Planning had discussed a
growth initiative to be brought before the voters next
year. Said it had great impact on the cities as to how
they would mitigate problems such as traffic and felt Palm
Desert should be taking steps to protect itself.

RE ';A ,•H Ni, FINANCIAL DISCLOSURE REQUIREMENTS.
Da v P Erwin said the City Council had a memo before them
which recommended that all commissions and committees
except the Parks F. Recreation Commission and the Police
Adv;,,ory Committee be required to file a disclosure
statement. He noted a survey prepared by staff which
showed what the other cities in the valley required as to
disclosures.
Council Comments 8 Questions:
Benson: Asked if the 730 form could be revised to be
specific to the individual committee responsibilities so
that people might be less offended at having to complete
one. Mr. Erwin responded it could, but the 730 was very
broad in scope as it was.
Wilson: Felt that the Parks 8 Recreation Commission
should be required to file inasmuch as its scope of
responsibility would be greatly expanded in the future
months. Councilmembers concurred.
Councilman Wilson moved to direct the City Attorney to follow the
comments made by the Council which would add the Parks & Recreation
Commission to the list required to file and to review the 730 form to see
if it could be revised to be specific to committee responsibilities.
Councilman Crites seconded the motion. Motion carried by unanimous vote.

A. CITY MANAGER
1. Report on Schedule of November/December Council
Meetings.
Mr. Ortega reported that the second Council meetings
in both November and December fell on holidays--

that staff felt the business at hand could be
conducted with only one meeting each month but if
something came up, an adjourned meeting would be
scheduled.
Mr. Ortega also advised that the State Transportation
Commission would be meeting in Palm Desert on
November 18th and that the City was working in
conjunction with CVAG and the Highway 86 Committee to
host a reception for it at the Desert Springs
Marriott. He said it might be necessary for staff to
come back with a request for additional funding of
about $750 to help pay for the reception.

XVII. AWARDS, PRESENTATIONS, AND APPOINTMENTS
A. PRESENTATION BY THE DESERT YOUTH SPORTS ORGANIZATION
Regarding Palm Desert Sports Activities and Related Items.
Mr. Al Durrett, President of DYSO, addressed Council in
support of his letter dated October 22nd (attached hereto
and made a part hereof as Exhibit "A") which had been
delivered to the members of the City Council. He
reemphasized his organizations' support of more lighted
ball fields, making the development of the Civic Center
and its recreational facilities a high priority,
supporting the development of 25• acres south of Hovl ey
Lane into lighted balifields for the whole valley, and to
thank the Council for its support of youth activities in
the past and for taking on what cities such as Rancho
Mirage and Indian Wells were failing to do.
The following additional speakers added comments relative
to the same topics:

Mayor Kelly thanked the speakers and assured them that the
Council heard their concerns and concurred with them.
B. CONSIDERATION OF APPOINTMENTS to Civic Arts Committee to
Fill Vacancies Created by Resignations of the Following
Members: Jane Leung (9/87); Michael Grossman (9/88); and
Barry White (9/90) (Continued from Meeting of August 27,
1987).
Upon motion by Crites and second by Benson, the appointments were
continued to the agenda for the November 12, 1987, meeting by unanimous
vote of the Council.

XVIII. PUBLIC HEARINGS
A. CONSIDERATION OF A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT AND CHANGE OF ZONE FROM HILLSIDE PLANNED
RESIDENTIAL (HPR) TO GENERAL COMMERCIAL (C-1) FOR THAT
APPROXIMATELY 7,000 SQ. FT. PORTION OF APN 640-02-003
DIRECTLY ADJACENT TO THE WEST SIDE OF HIGHWAY 111, EAST OF
THE TOE OF SLOPE AND WEST OF THE PARKVIEW/HIGHWAY Ill
INTERSECTION.
Mr. Diaz reviewed the staff report and recommendation.
Mayor Kelly declared the Public Hearing open and invited
testimony in FAVOR of the request, and none was offered. He
invited testimony in OPPOSITION to the request, and none was
offered. He declared the hearing closed.
Councilman Crites moved to waive further reading and pass Ordinance
No. 520 to second reading. Councilman Wilson seconded the motion, and
the motion carried by unanimous vote.
Chairman Kelly convened the Redevelopment Agency meeting at 7:25
p.m. for Joint Public Hearing with the City Council.

B. CONSIDERATION OF THE USE OF TAXES TO BE ALLOCATED AND PAID TO
THE AGENCY FOR THE PURPOSE OF PAYING ALL OR PART OF THE VALuF
OF THE LAND FOR AND INSTALLATION AND CONSTRUCTION OF A PROPOSED
SHERIFF'S SUBSTATION.
Mr. Ortega stated that Redevelopment law provides that before
the tax increment is spent to finance buildings, a public
hearing must be held. He noted that at this time, it was

staff's recommendation that the Council and .Agency postpone
taking action on the proposed resolution because final word had
not yet been received from the County of Riverside as to its
input on the proposed facility. He suggested that since the
public hearing had been legally advertised that public
testimony be received and then the item continued.
Mayor/Chairman Kelly declared the public hearing open and invited
testimony either in FAVOR or in OPPOSITION to the request. None was
offered. He declared the public hearing closed.
Upon motion by Wilson, second by Snyder, the item was continued to
the November 12, 1987, meeting by unanimous vote of the Council/Agency.
Chairman Kelly suggested that the Agency Board finish its agenda
before adjourning the Agency meeting. Members concurred.
111. CONSENT CALENDAR
A. MINUTES of the Meeting of the Redevelopment Agency of
September 24 and October 8, 1987.
Rec: Approve as presented.

The Desert Youth Sports Organization IDYSO) was formed on
April 1, 1985, with the primary purpose of assisting youth
sports programs in the Cove Communities areas. We are
funded partially by the Coachella Valley Parks and Recreation
Department and donations through fundraising activities. DYSO
is non-profit and tax exempt and has an office centrally lo-
cated in Palm Desert. There is a paid Administrator who works
with the various sports organizations in helping to organize
and register participants and fulfill any other needs that
may be required in youth sports.
In 1977, soccer was organized in the Palm Desert area and
was comprised of six teams representing approximately 90
children. By 1982, the Cove Communities Youth Soccer Asso-
ciation had been formed and there were approximately 200
children participating. In 1985, the number grew to 610;
in 1986, to 680; and in 1987, to 750. In five years, the
increase has been nearly 4001 and there are currently 550
more children playing soccer than there were in 1982. Of
the 750 children registered for soccer, 520 reside within
Palm Desert. This means that 69% of the children playing
soccer live in the Palm Desert area. The remaining children
from outside of the area come from Rancho Mirage and Bermuda
Dunes primarily, and a handful from the other surrounding
communities.
The baseball organization known as the Palm Desert Youth
Sports Association was started in 1977 and the number of
participants was 330 in 1978. By 1985, the number had grown
to 730; in 1986, to 850; and in 1987 to 950. This represents
approximately a 300% growth in nine years. Of the 950 chil-
dren registered for baseball this past year, 742 resided in
Palm Desert. The children that participated outside of Palm
Desert were primarily from the Bermuda Dunes and Rancho Mirage
areas. This means that 78% of the participants in baseball
are residing in Palm Desert.

The board of DYSO, along with other concerned parents, realize
that a crisis exists due to the rapid expansion of participants
and lack of fields to play and practice on. The City had great
insight and took advantage of the Cook Street opportunity to
develop those fields which have been greatly utilized and
appreciated by both soccer and baseball participants. However,
the land is owned and controlled by the high school and they
will continue to utilize those. fields for their needs, thus
eliminating some of the availability that has been afforded to
youth sports. With the high school adding another year (the
senior class) next year, the increase will continue to expand
on these fields.
Even with the current plan that has been proposed on the Civic
Center site, these fields will essentially only replace the
lighted fields that exist at Cook Street. With the expansion
that has been demonstrated in the past and the growth that is
predicted for the future in the area, we feel that a major
sports complex needs to be developed to serve the future needs.
Enclosed with this letter is a copy of the Vital Statistics
printed in the Desert Sun on Thursday, October 15th. It shows
that between Sept. 7th and Oct. 1st, there were 134 children
born and that 36 of the births were from parents who live in an
area that would be eligible to participate in the soccer and
baseball programs. Assuming that this period covers approxi-
mately three weeks, the annualized increase in children eligible
to participate in sports in the Palm Desert area would be 623
per year. If this birth rate continues, on an annualized basis
2,322 would be brought into the area each year. This does not
take into account the many new families who are moving to the
desert. With the planned expansion of Palm Desert in the
northern sphere, we know that a significant increase in children
will occur.
We have heard that a developer has made a proposal to the City
to give the City 25 acres of land south of Hovley Lane and west
of Cook Street industrial park. Additionally, 30 acres in the
northern sphere valued at approximately $1,500,000 would be
given to the City in exchange for a variance on approximately
30 acres which is located just west of the 25 acre site on
Hovley Lane.
The board of directors of DYSO would like to recommend that the
City accept this proposal and master plan this land for youth
sports in connection with the Coachella Valley Parks and Recre-
ation Department. This is an excellent site that could be
lowered to help mitigate the light problem that seems to be a
problem in some areas. This site is excellent for the follow-
ing reasons:
1. It is centrally located.
2. It is bordered to the north by a golf course, to the east
by a commercial park, to the south by undeveloped property
and to the west by the proposed project of the developer.

3. It is in close proximity to the schools, and in the event
that the fields are able to be utilized at Cook Street,
it would be minimal driving time for parents who have more
than one child to commute between these locations.
We feel that the development of these fields immediately is
essential to meet the needs of the community. If there are not
funds available within the City, we would like to suggest the
sale of the land that is being offered by the developer in the
northern sphere to finance the construction of the fields.
The board of directors of the Desert Youth Sports Organization
is comprised of Warren Smith, Chris Carnes, Paul Beaty, Jim Pearce,
Ed Neumeyer, Lee Haven, Lee Schmidt, Lloyd Watson, Christina
Krages, Marc Homme, Bill Schoenbrun, Jack Stewart, Steve Rivera,
Larry Francois and myself. We have done studies and gathered
facts and had numerous meetings with both the Palm Desert Parks
and Recreation Commission and various members of the Coachella
Valley Parks and Recreation Board as well as the Palm Desert
Youth Sports Association (baseball) and the Cove Communities
Youth Soccer Association (soccer). We would like to ask the
City Council to:
1. Expedite the construction of the fields planned on the
Civic Center site.
2. Accept the developer's proposal as presented with whatever
modifications the City feels are necessary and to begin
master planning the 25 acres on Hovley Lane for youth fields.
If necessary, the funding could be secured from the sale of
the 30 acres also being offered by the developer which is
located in the northern sphere.
We wish to thank the City Council for the opportunity to appear
before them and make this presentation. The board of the
Desert Youth Sports Organization is interested in the long range
opportunities for youth in the area and feels that it is as
important as schools, roads or any other public services provided
for the citizens. We are fortunate that numerous volunteers
comprise the Palm Desert Youth Sports Association and the Cove
Communities Youth Soccer Association so that the burden of organ-
izing and operating and sponsoring these activities are borne
by the citizens and are not a burden to the City. Thank you
