ADMINISTRATIVE CONFERENCE ROOM - PALM DESERT CIVIC CENTER 73-510 FRED WARING DRIVE, PALM DESERT, CALIFORNIA 92260 This Oversight Board has been created pursuant to § 34161 through 34190 of the Health and Safety Code for the sole purpose of overseeing the actions of the Successor Agency to the Palm Desert Redevelopment Agency. In accordance with Health and Safety Code § 34179(h), all Oversight Board actions shall not be effective for five (5) business days, pending a request for review by the State Department of Finance ("Department"). In the event that the Department requests a review of a given Oversight Board action, it shall have 40 days from the date of its request to approve the Oversight Board action or return it to the Oversight Board for reconsideration, and such Oversight Board action shall not be effective until approved by the Department. In the event that the Department retums the Oversight Board action to the Oversight Board for reconsideration, the Oversight Board shall resubmit the modified action for Department approval, and the modified Oversight Board action shall not become effective until approved by the Department. ORAL COMMUNICATIONS None IV. APPROVAL OF MINUTES OCTOBER 17, 2016 A. MINUTES of the September 26, 2016, Adjourned Regular Meeting of the Oversight Board of the Successor Agency to the Palm Desert Redevelopment Agency. Vice Chair Buck moved to waive further reading and adopt Resolution No. OB - 151, approving Minutes of the September 26, 2016, Adjourned Regular Meeting of the Oversight Board of the Successor Agency to the Palm Desert Redevelopment Agency. Motion was seconded by Member Pack and carried 6-0 (AYES: Buck, Jonathan, Pack, Rodriguez, Stendell, and Spiegel; NOES: None; ABSENT: Kinnamon). V. NEW BUSINESS A. ACTIONS/MINUTES OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY. Vice Chair Buck moved to waive further reading and adopt Resolution No. OB - 152, receiving and filing Minutes of the Successor Agency to the Palm Desert Redevelopment Agency Meetings of August 25 and September 8, 2016. Motion was seconded by Member Jonathan and carried by a 6-0 vote (AYES: Buck, Jonathan, Pack, Rodriguez, Stendell, and Spiegel; NOES: None; ABSENT: Kinnamon). B. REQUEST FOR APPROVAL OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY HOUSING AND NON -HOUSING TAX ALLOCATION REFUNDING BONDS, SERIES 2017, AND RELATED ACTIONS. Staff reviewed the printed report contained in the agenda packets and offered to answer questions. Member Jonathan moved to waive further reading and adopt Resolution Nos.: 1) OB - 153, approving the Successor Agency's issuance of Tax Allocation Refunding (Housing) Bonds and taking related actions; 2) OB - 154, approving the Successor Agency's issuance of Tax Allocation Refunding (Non -Housing) Bonds and taking related actions; 3) OB - 155, approving the use of moneys from Fiscal Year 2016-17 Redevelopment Property Tax Trust Fund ("RPTTF") disbursements for Refunding Bond Debt Service. Motion was seconded by Member Pack and carried by 6-0 vote (AYES: Buck, Jonathan, Pack, Rodriguez, Stendell, and Spiegel; NOES: None; ABSENT: Kinnamon). 2 MINUTES ADJOURNED REGULAR MEETING OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY VI. CONTINUED BUSINESS OCTOBER 17, 2016 A. MINUTES OF THE NOVEMBER 2, 2015, REGULAR MEETING OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY (Continued from the meetings of January 25, April 4, August 1, and September 26, 2016). Staff noted that two Oversight Board Members had changed since these Minutes were taken, and a quorum of four (4) Members needed to vote in favor to approve them. However, it would never be the same four who were present at the November 2 meeting. If those on the Board presently had read the Minutes and felt them to be in order, it would be appropriate to move and vote for their adoption. Vice Chair Buck moved to waive further reading and adopt Resolution No. OB - 136, approving Minutes of the November 2, 2015, Regular Meeting of the Oversight Board of the Successor Agency to the Palm Desert Redevelopment Agency. Motion was seconded by Member Rodriguez and carried by 6-0 vote (AYES: Buck, Jonathan, Pack, Rodriguez, Stendell, and Spiegel; NOES: None; ABSENT: Kinnamon). VII. OLD BUSINESS None VIII. MEMBERS OF THE OVERSIGHT BOARD Members congratulated and welcomed new City Manager/Successor Agency Executive Director Lauri Aylaian to her first Oversight Board Meeting. C. SUCCESSOR AGENCY EXECUTIVE DIRECTOR Ms. Aylaian graciously acknowledged the welcome and said she was pleased to be here. 3 MINUTES ADJOURNED REGULAR MEETING OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY IX. ADJOURNMENT OCTOBER 17, 2016 Prior to adjournment, staff noted that there were not any items pending for a November 7 Regular Oversight Board Meeting, and it would likely be canceled. Subsequent meeting to follow was scheduled to be held Monday, December 5, 2016. With Oversight Board concurrence, Chair Spiegel adjourned the meeting at 1:37 p.m. OBERT A.
