MINUTES of the Adjourned Regular Riverside County Palm Desert Financing Authority Meeting of July 10, 2006. Rec: Approve as presented. Upon a motion by Kelly, second by Wilson, and 3-0 vote of the Authority Commission Board, with Parrish ABSENT, the Consent Calendar was approved as presented. V. CONSENT ITEMS HELD OVER None VI. NEW BUSINESS None MINUTES REGULAR MEETING OF THE RIVERSIDE COUNTY PALM DESERT FINANCING AUTHORITY VII. CONTINUED BUSINESS AUGUST 7, 2006 A. REQUEST FOR ACCEPTANCE OF WORK FOR CONSTRUCTION OF THE COACHELLA VALLEY ANIMAL CAMPUS (CONTRACT NO. RCPDFA 22130) (Continued from the meetings of March 13, and July 10, 2006). Mr. Conlon said the minor items that came up at the last meeting had been corrected. He further offered that he had a copy of the air balance report and would be delivering it to the Shelter to Doug Austin's attention. Once the Notice of Completion is filed, he and Commissioner Ortega would meet with the contractor to work out the remaining items, including liquidated damages, and the project would be considered complete. Vice President Wilson commented that County staff had serious concerns with improper exit lighting; the architect (WLC) brought it to their attention that about eight lighted "Exit" signs were not properly placed. It was his understanding that the contractor was aware but has yet to do anything about it. Mr. Conlon responded that staff consulted the plans, and the "Exit" signs installed by the contractor were done per the plan. He acknowledged that the architect had previously requested some changes, which he proposed be done after the subject contract was closed. In further response to question, he said part of the issue with the "Exit" signs was their being hardwired into junction boxes in the masonry walls of the structure; for this reason, it was difficult to change the signs. He noted that both the Fire Department and County Building & Safety Department signed off on the project as is; but if there were some "Exit" signs that needed to be changed or revised, it can be done later. At this point, he said it would be undesirable to do another Change Order with Wang Milestone Construction. Commissioner Ortega acknowledged that the County operators of the facility had several issues, one being the air conditioning and air exchanges/hour, but he didn't think there was anything else prohibiting the Authority Commission Board from issuing a Notice of Completion based on the contractor's compliance with the contract documents and specifications. Mr. Conlon reiterated that the existing "Exit" signs were installed exactly per the plans. If necessary, he recommended using a separate contractor to relocate the signs and offered to assist with the process. In response to question about claims from subcontractors, he said there were some stop notices that the contractor had posted bonds to cover. The contractor 2 MINUTES REGULAR MEETING OF THE RIVERSIDE COUNTY PALM DESERT FINANCING AUTHORITY AUGUST 7, 2006 provided assurance that once the retention funds were released, he would pay the subcontractors with those funds. Acting President Kelly moved to, by Minute Motion, accept the project as complete and authorize the President to sign and the Secretary to file the Notice of Completion with the Riverside County Recorder's Office. Motion was seconded by Ortega and carried by a 2-0-1 vote, with Vice President Wilson ABSTAINING due to his concerns about the exit lighting and Commissioner Parrish ABSENT. Commissioner Ortega expressed appreciation to Mr. Conlon for the efforts he expended on this project, which had taken much more time than initially anticipated. VIII. OLD BUSINESS None XI. REPORTS AND REMARKS A. PRESIDENT Responding to Acting President Kelly's question, it was noted that the project list was still being finalized by the County, particularly the Sheriffs Station. Vice President Wilson felt the County needed to be closer with actual designs for the proposed projects before a bond issue could be considered. He hoped some of the County's pass -through funds with the City could be utilized to obtain the necessary designs and plans in the meantime, anticipating that they would be ready for the bond issue in approximately one year. Mr. Gibson said it would be necessary for the County to take an action to authorize the Financing Authority to utilize the pass -through funds for the aforementioned purposes. In further response to question, Vice President Wilson said he hoped the community parks proposed for Bermuda Dunes and the East Valley would get priority. Acting President Kelly emphasized the need for such parks. B.
