D. REQUEST FOR AUTHORIZATION to Revise Close of Escrow Date
Contained Within Disposition and Development Agreement Between the
Palm Desert Redevelopment Agency and Dervieux, Inc.
Rec: By Minute Motion, authorize changing the date by which escrow must
close from November 30, 2002, to January 15, 2003, in the subject
Disposition and Development Agreement dated July 11, 2002.
Upon motion by Spiegel, second by Benson, the Consent Calendar was approved
as presented by a 5-0 vote.

VIII. RESOLUTIONS
A. RESOLUTION NO. 457 - A RESOLUTION OF THE PALM DESERT
REDEVELOPMENT AGENCY, APPROVING A REPORT REGARDING
EXCESS TAX INCREMENT REVENUES AND MAKING FINDINGS
RELATED THERETO.
Mr. Ortega reviewed the staff report and recommendation.
Member Spiegel moved to waive further reading and adopt Resolution No. 457.
Motion was seconded by Benson and carried by a 5-0 vote.
IX. NEW BUSINESS
A. REQUEST FOR APPROVAL OF ACTIONS APPROVING PAYMENT BY
THE PALM DESERT REDEVELOPMENT AGENCY FOR CERTAIN
HILLSIDE OPEN SPACE AND THE CONVEYANCE OF SUCH OPEN
SPACE TO THE CITY (HOMME/ADAMS PARK) (JOINT CONSIDERATION
WITH THE PALM DESERT CITY COUNCIL).
Mr. Ortega reviewed the staff report and offered to answer any questions.
Upon question by Mayor/Chairman Kelly, Mr. Yrigoyen responded that the
staff report did not indicate the amount paid for the land; however, staff was
recommending transfer of the land from the Redevelopment Agency to the
City. He said staff could provide to the Agency Board at a later date the
amounts for the several parcels on the hillside purchased from Mr. Homme.
Councilman/Member Ferguson asked if staff meant that the Agency had
already bought the property, and the property would now be transferred from
the Agency to the City, and Mr. Yrigoyen agreed.

Councilman/Member Crites moved to waive further reading and adopt: 1) City
Council Resolution No. 02-142, approving payment by the Palm Desert Redevelopment
Agency for certain hillside open space and the conveyance of such open space to the City;
2) Redevelopment Agency Resolution No. 455, approving payment by the Agency for
certain hillside open space and the conveyance of such open space to the City of
Palm Desert. Motion was seconded by Ferguson and carried by a 4-0 vote, with
Mayor/Chairman Kelly voting NO.
B. REQUEST FOR APPROVAL OF PAYMENT BY THE PALM DESERT
REDEVELOPMENT AGENCY FOR ALL OR PART OF THE VALUE OF THE
LAND FOR AND THE COST OF THE INSTALLATION AND
CONSTRUCTION OF CERTAIN PARK AND RECREATION FACILITY
IMPROVEMENTS AND CERTAIN PUBLIC PARKING IMPROVEMENTS
(LAND LOCATED BETWEEN EL PASEO AND HIGHWAY 111, EAST OF
MONTEREY AVENUE) (JOINT CONSIDERATION WITH THE
PALM DESERT CITY COUNCIL).
Mr. Ortega reviewed the staff report and recommendation.
Councilman/Member Spiegel noted that the Shell Station at Highway 74 and
Monterey Avenue was owned by the same woman who sold this land to the
Agency, and he suggested that someone talk to her to see if she would be
willing to sell the Shell Station to the City.
Councilman/Member Ferguson stated that in reading the staff report,
especially if the Shell Station is involved, this is property right outside his
office window, and he would, therefore, abstain from voting on this matter.
Councilman/Member Spiegel moved to waive further reading and adopt: 1) City
Council Resolution No. 02-143, approving payment by the Agency for all or a part of the
value of the land for and the cost of the installation and construction of certain park and
recreation facility improvements and certain public parking improvements;
2) Redevelopment Agency Resolution No. 456, approving payment by the Agency for all
or a part of the value of the land for and the cost of the installation and construction of
certain park and recreation facility improvements and certain public parking improvements,
with staff directed to investigate the potential for acquiring the adjacent property, which was
formerly the site of a Shell gas station. Motion was seconded by Crites and carried by a
4-0-1 vote, with Councilman/Member Ferguson ABSTAINING.

C. REQUEST FOR DIRECTION FROM AGENCY BOARD REGARDING
PROVISION OF OFFICE SPACE FOR THE PALM DESERT CHAMBER OF
COMMERCE.

RSK Next item is a request for direction from Agency Board regarding provision
of office space for the Palm Desert Chamber of Commerce.

Mr. Mayor, you do have a complete report on the recommendation of the
Entrada Del Paseo Steering Committee. You also have a letter from the
Chamber of Commerce. Staff is asking that the City Council/Agency Board
give staff direction on how to proceed with the building of the Visitors and
Information Center.
RSK I have a blue card from someone who would like to speak to this item.
Leon Bennett.
LB Yes, thank you. Honorable Mayor and Councilmembers, I'm Leon Bennett.
I live at 48-350 Crestview Drive in Palm Desert. Business -wise I'm
associated with Classic Party Rentals, and I'm here as a volunteer and the
Chairman of the Building Committee for the Palm Desert Chamber of
Commerce. This is an important issue to us. Also joining me tonight but not
speaking are Sarah Seils, Chairman of our Board, Bob Stark, Sid Wise,
Michael Bernard, Ray Rodriguez, and staff member Susie Harvey. The
Building Committee has met a number of times, and the Board has gone on
record (inaudible) to request the City to put us on the Entrada Del Paseo site.
We have suggested the possibility of us being part of the building on the
second restaurant site. Palm Desert visitors come to town with preconceived
notions of where to get information. Some will look to the Visitors Center,
and some will come to the Chamber of Commerce. In fact, when I was at the
office this afternoon at 3:30, a lady from Connecticut came in looking for
information, getting maps, and that type of thing. She actually came to the
Chamber office, which is very hard to find these days. Clearly the most user-
friendly way to service our visitors is to be a one -stop destination for

information while simplifying the issue of where this type of geographical
unity (inaudible) lead to an increase in crossover referrals with just steps
between the units, not an auto drive away. Occasionally, the
proximity...operationally, the proximity of both organizations will no doubt lead
to even more efficient levels of cooperation between the two organizations
and the City. The Palm Desert Chamber is eager to continue contributing to
the team concept that is so much a part of our City's success. Finally, there
has been some discussion as to who is and who isn't a member of the Palm
Desert Chamber of Commerce. Palm Desert boasts the largest Chamber of
Commerce in the Coachella Valley and the second largest in the Inland
Empire. The membership is composed of major transient occupancy tax
generators such as Marriott's Desert Springs, Residence Inn, Courtyard by
Marriott, Embassy Suites, Marriott Fairfield Inn, just to name a few. Also,
some of our sales tax generators that are important to the City include such
entities as Westfield Shoppingtown, The Gardens on El Paseo, Costco,
Staples, Target, Best Buy, Office Depot, and Office Max and a whole lot of
other businesses, too, but those are some of the largest ones. Also,
restaurants produce a lot of sales tax, and some of our members include
Morton's, LG's, Ruth's Chris, Tommy Bahama, Kaiser, Cuistot - who I
understand are going to be on the same site, and Mamma Gina. The City of
Palm Desert has long recognized the vital contributions the Chamber makes,
not only to our local businesses but the City of Palm Desert itself. We ask
the City continue this tradition in cooperation and support by securing the
— optimal location which we feel is on the same site with the Visitor and
Information Center so we can position ourselves for our future service and
growth to the community. Thank you for your (inaudible). If you have any
questions, we'll answer any questions, too.
RSK Thank you. Anyone else like to speak to that? Seeing no one, the Council,
or Redevelopment Agency I guess this is, isn't it? Guess we've discussed
this a lot of times over the past year.
JMB Or two or three.
RSK If we don't get into a long discussion, the audience should know that we've
been discussing this for a year, and we constantly come up with only four
members of the Council and aren't able to come up with a decision. So this
is decision hour.
BAC I move the staff recommendation.
JMB I second it.
RSK Please vote.

RDK Motion fails, with Councilman Spiegel, Councilman Ferguson, and
Mayor Kelly voting No.
RAS I will move that the Chamber of Commerce be located on the El Paseo pad
on 111 and not specifying location but asking staff to come back with the
design element.
JF Well, since we've been talking about it so long, why can't we specify the
location?
RAS Well, we can, but I'd like to see what staff comes up with, and we can say it
should be adjacent to the Visitors Center, it should be a separate building, or
whatever. We talked about it being in conjunction with the second
restaurant. There are a lot of different places it could go, so I'm not ready to
say where I want it right now without some kind of recommendations.
RSK I would like to see it adjacent to the Visitors' Center so that people could just
walk from one to the other.
JF Well, I had some figures in our staff report saying what each option would
cost, and, you know, we have been dragging this on and on and with it,
unfortunately, our staff. I hope we can come to a final resolution tonight and
just move on.
RSK Do you have a proposal?
JF Well, I would like to see the Chamber Center and the Visitors' Center under
one roof. I think it makes the most sense from a proximate standpoint and
from a cost standpoint, and like you, that's the way I feel. I'd like to just be
done with it and move on.
RAS
Well, I don't disagree with you, Jim. My only comment would be that as our
City grows, there may be more space needed, and it would be difficult to
expand either one if they were under one roof. That argument has come to
me.
BAC I think that...
RSK
It seems that the leaning is towards being near but I suppose
there's...adjacent to each other but a separation so there's room for
expansion.
BAC Are you saying separate buildings, then?

RSK Kind of separate but like a covered space in between them so you can walk
back and forth without getting out in the weather and share a break room.
BAC Then we're back to redesigning the whole structure, and we're back to
something that absolutely does not suit the staff needs for the future of our
City, in my humble opinion. Doing that, we're doing the worst of all possible
things.
JF
Well, how is building two buildings, two sets of restrooms, two break rooms,
basically doubling the infrastructure for both the worst possible thing for the
City?
BAC I agree. I think that's not a very good idea either. Obviously I'm in the
minority in what I thought was a better idea. But when you get down to the
second one, when we co -locate in there, we have postponed for a few years
an issue that will be right back again, which is how do you expand the needs
of these various things, and we're stuck in a combined building in which
expansion will only occur by somebody moving out, and we'll be right back
where we were.
RSK Councilman Ferguson, can you go along with the idea of located on that pad
and staff coming back with a recommendation of how?
JF When you say "pad," do you mean the Visitors' Center pad? For the site, the
12-acre site?
RSK The site. So then people could walk from one to the other.
JF I will do so, but without expressing any endorsement of the two -building
approach.
RSK So that's a second.
JF Uhm hmm.
RAS Okay.
RSK We have a motion. Please vote.
RDK Motion carries 3-2, with Mayor Pro-Tem Benson and Councilman Crites
voting NO.

RSK Next item is a request for midterm review of five-year implementation plan for
the Redevelopment Project Areas.
As a point of clarification, the motion was as follows: By Minute Motion,
authorized that the Palm Desert Chamber of Commerce be located on the
Entrada del Paseo site, asking staff to return to the Agency Board with a
design element for this arrangement.

Mr. Coleman reviewed the staff report and offered to answer any questions.
He noted that plans had been available for public review for the last ten days.
Chairman Kelly declared the public hearing open and invited testimony in FAVOR
of or in OPPOSITION to this request. With no testimony offered, he declared the
public hearing closed.
Vice Chairman Benson moved to receive and file the report. Motion was seconded
by Spiegel and carried by a 5-0 vote.
