OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
APPOINTING A CITY ATTORNEY AND PROVIDING FOR
THE DUTIES OF THE SAME .
The City Council of the City of Palm Desert, California,
DOES HEREBY RESOLVE as follows:

SECTION 3
There is hereby created the position of City Attorney of the
City of Paim Desert.
The City Attorney shall receive as a retainer for the fiscal
year ending June 30, 1972, a sum to be determined by the
City Council, payable monthly.
In the fiscal years following the fiscal year ending June 30,
197 , the City Attorney shall receive as compensation such
sum as may be fixed by the Council in adopting the annual
budget.
SECTION 4. For said retainer, the City Attorney shall perform the
fo!lowing duties and services:
A. Attend meetings of the City Council and Planning Commission.
B. Keep the City Council informed as to legislation affecting the
City Government.
C. Render legal opinions when requested by the City Council or
City Administrator.
D. Supply legal advice to the various City department heads.
E. Prepare cesolutions and ordinances requested by the City Council.
F. . R eview and give his opinion of City contracts, agreements, and
irtiher legal documents .
SECTION 5. The City Attorney shall be paid additional compensation at the
rate of $50.00 per hour when assigned to perform the following
duties or services:
A. Representing this City at places outside the Coachella Valley.
B. Preparation of municipal bond issues.
C. Promulgation of assessment districts.
D. Litigation, including defending or prosecuting actions and the
preparation therefor in the Municipal, Superior, Appellate and
Federal Courts.
E. Proceedings initiated or undertaken under special improvement acts.
F. Preparation of State and Federal legislation.
SECTION 6. The City Attorney shall be reimbursed for all sums necessarily
incurred or paid by him in the performance of his duties,
except as hereinbefore provided, or incurred when traveling

on business pertaining to the City under the direction of the
City Council; reimbursement shall only be made, however,
when a verified, itemized claim, setting forth the sums
expended for such business for which reimbursement is
requested, has been presented to the City Council for approval
and has been so approved .
SECTION 7. The City Attorney shall serve at the pleasure of the Council.
The City Attorney shall have the right to resign upon thirty
(30) days' written notice to the Counci I.
SECTION 8. The City Clerk shall deliver a certified copy of this resolution
to the City Attorney.
SECTION 9. The City Clerk shall certify to the passage and adoption of
this resolution; shall enter the same in the book of resolutions
of this City, and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City
Council of this City, in the minutes of the meeting at which the
same is passed and adopted.
