HomeMy WebLinkAboutCC RES 74-072RESOLUTION N0. 74-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING A POLICY FOR THE UNDER- GROUNDING OF UTILITIES THROUGH THE USE OF UNDERGROUNDING DISTRICTS AS PROVIDED FOR IN CITY COUNCIL ORDINANCE N0. 20 WHEREAS, the City Council believes that there is a relation- ship between the appearance and aesthetic appeal of the community and the existence of overhead utility lines, and WHEREAS, City Council Ordinance No. 20 establishes means by the use of utility districts to place existing utility lines under- ground. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert that it does hereby adopt as policy the following priorities for the utilization of utility undergrounding districts in the City of Palm Desert: l. Utility undergrounding funds shall not be used to place utilities underground on undeveloped property except on a tem- porary basis subject to reimbursement. 2. Vacant lots located in areas where utility undergrounding funds have been used to place the utility lines underground shall not be developed unless the amount of money used to underground the utility lines is reimbursed to the City of Palm Desert as a part of the issuance of a building permit. Funds reimbursed under this section shall be placed in an underground district fund to be utilized at the discretion of the City Council for additional un- dergrounding of utility lines in other areas of the cor.imunity. 3. High priority shall be given to utilizing utility under- grounding districts to place existing utility lines underground in the established and built-up commercial Core Area of the community. 4. High priority shall be given to utilization of utility undergrounding districts within areas of the commercial Core where pro�erty owners are willing to provide 50% of the cost of the undergrounding. 5. Priority will be established in the order of requests by property owners in the Core Area for the creation of utility undergrounding districts, the availability of funds from the utility companies, and the immediacy of the availability of funds from the requesting property owners. RESOLUTION N0. 74-72 6. The Council may, in its discretions, divert funds to areas where they elect to take the initiative in having utility lines placed underground, irrespective of previously established priorities. The City Clerk is hereby directed to cause this Resolution to be posted in three (3) public places in accordance with Resolution No. 74-17 and Section 36933 of the Government Code of the State of California, and shall take effect and be in force thirty days after its adoption.
