HomeMy WebLinkAboutCC RES 74-080RESOLUTION NO. 74-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING A POLICY ON THE RE- QUIREMENT OF THE INSTALLATION OF CURB AND GUTTER AS A PART OF DEVELOPMENT WHEREAS, the City Council believes that drainage and nui- sance water is one of the major problems in the City of Palm Desert, and; WHEREAS, the City Council is of the opinion that the installa- tion of curb and gutter throughout the City is one of the major solutions to these problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, that it hereby establishes as policy the following: 1. Al1 new development hereafter constructed shall include either: (a) Curb and gutter tie-in paving installed on all pub- lic street frontage of the property under construc- tion, or (b) The developer shall provide a cash deposit in an amount equal to the cost of the installation of curb and gutter and tie-in paving along all public street frontage of the property under construction. These monies will be deposited in a special fund or restricted to the expenditure for curb and gutter and tie-in paving. 2. The City Council hereby appoints the Director of Environ- mental Services as the person who determines which of the above alternatives shall be utilized. 3. The Director of Environmental Services shall use the following criteria to make this determination: (a) Installation of curb and gutter shall be required where the curb grades have been established and permanent curbs and gutters can be installed at the time of construction. RESOLUTION NO. 74-80 (b) Curb and gutter shall be required when sub-section (a} is met and the ultimate half-street width adja- cent to the property under construction presently exists. (c) If the ultimate half-street width does not exist adjacent to the property under construction, the developer as a part of construction in addition to the installation of or posting cash for curb and gutter and tie-in paving, shall dedicate the neces- sary right-of-way to obtain the ultimate half-street width of any public street adjacent to the property under construction. The City Clerk is hereby directed to cause this Resolution to be posted in three (3) public places in accordance with Reso- lution No. 74-17 and Section 36933 of tr�e Government Code of the State of California, and shall take effect and be in force thirty days after its adoption.
