A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
ITS APPROVAL OF A REVISED TENTATIVE MAP TO ALLO�V FOR
DEVELOPt�4ENT TO 209-UNIT CONDOMINIUM PROJECT ON 33.6
ACRES OF LAND, GENERALLY LOCATED 1.5 MILES SOUTH OF
STATE HIGHWAY 111, ON THE WEST SIDE OF STATE HIGHWAY
74. CASE NO. TRACT N0. 4442.
j9HEREAS, the City of Palm Desert did receive a verified
application from ENVIRONDIENTAL DEVELOPb�ENT COMPANY, requesting
approval of a 209-unit condominium project on 33.6 acres of land,
located in the R-2-7000 zone and situated 1.5 miles south of State
Highway 111, on the west side of Highway 74, more particularly
described as:
being a portion of government Lot 1 in
the NW4 of Section 31, and a portion of
the tiV� of the NE� of Section 31, T.5.S,
R.6E, S.B.B. & M.
WHEREAS, said application was exempt from the require-
ments of the "City of Palm Desert Environmental �uality Procedure
Resolution Number 74-14", in that the project was initiated prior
to the effective date of the California Environmental �uality Act
and is therefore considered to be exempt as an on-going project,
and;
�UHEREAS, the Planning Commission has considered the
request and does by Planning Commission Resolution No. 9 recommend
approval subject i;o conditions, and;
WHEREAS, the City Council did hold a duly noticed Public
Hearing on October 10, 1974, and at that time did take into con-
sideration the Tentative Map as submitted, and the reports of the
various reviewing agencies and the Planning Commission recommend-
ation, and;
�UHEREAS, the City Council did find that the subject
Tentati.ve Map does substantially comply with the City of Palm
Desert Code (County Ordinance No. 460), and the State of California
Subdivision Map Act, as amended;
`9HEREAS, tYie City Council did find that the subject
Tentaiive Map does comply with the adopted General Plan, and;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Desert as follows:
l. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That it does hereby approve the above described
Tentative Map No. 4442, subject to fulfillment of the following
conditions (copy attached):
PASSED, APPROVED AND ADOPTED at a regular meeting of
the Palm Desert City Council held on the lOth of October, 1974,
by the following vote, to wit:

1. All improvements shall conform with County Subdivision Standards Schedule
"A" unless r.�odified by these conditions.
?. a. All street improvements shall be designed and constructed in confor-
nance with RiverSide County Road Improvement Standards.
Street improvements and requirements shall be as follows:
1) State Highway 74 shall be improved with asphalt concrete paving
and concrete curb and gutter located 38 feet from the centerline
caithin a 50 foot half width dedicated right of way.
2) Access onto Highway 74 shall be restricted and so noted on the
f inal map.
3. If the subdivider cloes any lot grading he shall submit one reproducible
brow•nline and four prints of a comprehensive grading plan to the F.iverside
County Surveyor's Office. Prints of the grading plan will subsequently be
transmitted rro^� the Surveyor's Office to the Flood Control D�strict and
Departr��e!:t or Euildii;�� and Safety for review and approval and shall be in
co�r�pli�.,^.ce i:ith the tiniform Building Code, Chapter 70, as amended by Ordin-
ance 457.
:�. The subdivi.der sha11 submit for approval a soils report for stability and
geological stud} to the Riverside Count}� Surveyor's Office, prior to recor-
dation of the final r::ap, unless ���aived by the Director of Building a:�d
Safety.
:. Street na�:es for the proposed subdivision shall be subject to approval by
the Cit}• Engineer and Director ot Environmental Services.
.. As 2 part of construcr_ion, new units shall be connected to the se�•�er s}s-
te� in a nanner accentable to the Coachella Valley County j�'a�er District.
7. Prior to racord�tion of the final subdivision map the applicant shall sub-
�it to tt;e Director of Environ-nental Services the followin� documents �JY11.C�7
shall demonstrate to the satisfaction of the Director of Environn:ental Ser-
vices that the total project wi11 be developed and maintained in accordance
with the intent and purposes of the approval:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. rianagezaent and m,sintenance agreement to be entered into with the owners
of the units of tiie project.
The approved documents shall be recorded prior to occupancy of any dwellin�
unit.
_, A Home O�aners Assn. with the unqualified right to assess the owners of the
individual units for reasonable maintenance costs shall be 2stablished and
continuously r.iaintained. The Home Ocaners Assn. shall have the right to
lien the units of ttie owners �aho default in the payment of their assessments.
Such lien shall not be subordinate to any encumbrance other than a first
deed of trust provided such deed of trust is made in good faith and for value
and is of record prior to the lien of the Home Owners Assn.
.. Provide easements for drainage facilities and utilities and dedicate on the
final map if �aithin tract boundary.
... The subdivider shall provide Schedule "A" fire protection. The California
Division of Forestry shall revie��r and approve the water plan map relative
to location, setting, spacing and installation of f ire hydrants pricr to
recordation of the final subdivision map.

11. A valid conditional use case conformin� to the approved tentative map shall
be in effect at the ti.me of recordation of the final map.
'_2. In re�ard to flood control protection Che Coachella Va11ey County Water
District letter dated December 9, 1971, states Chat this tract may be con-
sidered safe from stormwater flows except in rare instances.
_3. An application should be processed through L,A.F.C, for a new County Service
Area or for annexation to an eYisting service area if street lighting is re-
quired.
:4. All requirements of any applicable la�v, ordinance or regulation of the State
of California, City of Palm Desert, and any other agplicable goverruaental
entity shall be complied with as a part of construction.
