�iHEREAS, said application had com�plied with the requir�ts
of the "City of Palm Desert Enviro�►ental Qualit� Procedure
Resolution Number 74-14". in that an Snviro��tal Assesament
form vas submitted and a Negative Declaration was made by the
Director of Environmental Services and the appeal period has
expired. and;
WHEREAS. the City Council did take into coneideration the
Tentative I�Iap as submitted. and the reports of the various
revieaing agenciea. and;
NHEREAS. the Planning Co�ission did find that the subject
Tentative I�Sap does not substantiall� comply vith the City of Palm
Desert Code (County Ordinance Number 460). and the State of
California Subdivision Map Act. aa amended:
WHEREAS, the City Council did find that 1) the project
does not compl� vith the adopted General Plan in that it does
not present methoda of preservation of the date grove appearance;
2) the project does not camply to the existing or propoaed zoning
ordinance in that there ia insufficient parking and a shortage
of usable opea space; 3) three years have eacpired since the original
tract map �►as presented and conditions have changed sufficiently
to Marrant a n�► development plan for this area; and.
