A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, DENYING A REQUEST FOR AN AMENDMENT
OF THE PALM DESERT ICAP TO DELETE A PROPOSED PARKING LOT
ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF
THE INTERSECTION OF DE ANZA WAY AND STATE HIGHWAY 111
CASE NO. ICAP AMENDMENT 05-74
WHEREAS, the Planning Commission did on the 2nd day of
December, 1974, hold a duly noticed Public Hearing to consider
an Interim Core Area Plan amendment application, filed by B.
GIOGA to delete a proposed parking lot on property generally
located at the northeast corner of the intersection of De Anza Way
and State Highway 111, and more particularly described as:
Lot 18, Palma Village Unit No. 11, which is a
portion of the SA of the NE/ of Section 20,
T.SS, R.6E, S..B.B. &M
Then said Planning Commission, by its Resolution No. 20, did
recommend denial of such amendment, and;
WHEREAS, said application has complied with the requirements
of the City of Palm Desert Environmental Quality Procedure
Resolution Number 74-14", in that this amendment is considered
an on-going project of the Interim Core Area Plan and is there-
fore covered under the Negative Declaration given to the Plan,
and;
WHEREAS, the City Council, on the 9th of January, 1975
the testimony and arguments, if any, of all persons desiring to
be heard, said City Council did find the following facts and
reasons to exist which make the denial of the ICAP AMENDMENT
necessary:
1. The parking lot is needed to alleviate the critical
shortage of off-street parking spaces in that part of the City.
2. The proposed amendment does not insure the protection of
the public health, safety, and general welfare.
3. The proposed amendment is not needed since the proposed
parking lot could be located on the subject lot or an adjacent
lot and meet the concepts of the Core Area Plan. Therefore, the
subject lot could be developed commercially.
