TRACT 5795. 1 T WHEREAS, the City Council of the City of Pal Oesert did recieve a ; , i , • rt !" - i ` i verified application fraa SILYER SPUR ASSOCIATES, requesting approval of a 12•month tlme extenslon of the tentative map for a pta ned residential development on 11 ac -es of land, located in the R-2-8000 zone and situated south of Portola Avenue and east of Mariposa Drive, aare particularly desc ibed as: a portton of the NE 1/4 of Section 32, Tormship 5 South, Range 6 East, S8a M; and a portion of Lot B, Tract 4685 WNEREAS, said application haA complieA with the require+nents of the "City of Palm Desert Envirornnentat Quality Procedure Resolution Number 74-14", in that an Envtronmental Assessme t fonn was submitted and a Negative Oeclaration was made by the Director of Enviro me tal Services on November 21, 1975, and the appeal pe iod has expired; end WHEREAS, the City Council did take into consideration the TenWtive Map as submitted, and the reports of the va ious reviewi g agencies; and MHEREAS, the City Cou cil did fir d that the subject Tentative Map does substantially comply with the City of Paln Desert Code (County Ordinance Number 460), and the State of Califo nia Subdirision t+lap Act, as amended; and MNEREAS, the City Council did find that the subject Tentative Map does comply with the adopted fenerat Plan. NOW, THEREFORE, BE IT RESOLYEO by the City Council of the City of Palm Desert as folla+s: (lj that the abore recitations are true and correct and constitute the findings of the Council in this case; (2) that it dces hereby approye the above described Tentative Map No. 5795, subject to ful- fitlinent of the attached conditions. i . If the subdivider does any tot 9rading, he shall suba�it o�e reproducible bro+mline and four prints of a comprehensive gradin9 plan to the Riverside County Surveyor's Offite. Prints of the grading plan will subsequently be transmitted frvm the �-' Surveyor's Office to the Flood Control Oistrict and DeparG�nent of Building and Safety for rerieN and approval and shall be in corr.piiance with the Unifon� Building Code. Chapter 70, as ar�mnded by Ordinance 457. . 4. The subdivider shall submit for approval a soils report for stability and geological study to the Riversi�e County Su�veyor's Office prior to recordation of the final map. S. Street names for the proposed subdivision shall be subject to approval by tfie Director of Environmental Services. 6. A vrate� and sewer system shall be installed in accordance with the provisions set forth in the Riverside County 1lealth Department letter dated May 13, 1974, a copy of Khich is enclosed. 7. Prior to rerordation of the final subdivision map, the applicant shall submit to the Comaission the folla►+ing documents which shall demonst�ate to the satisfaction of the Comnission that the total project ++ill be developed and main W ined in accord- ar�ce with the intent and pu�pose of the approval: a. b. t. Interior drives shall not be dedicated. Curb, gutter and tie-in paving shall be installed along Mariposa �rive at a grade and align.�nent subject to approral by the County Road Commissioner. The approred documents shall be �ecorded at the same time that the subdirision �aap is reco�ded. 9. The mana9ement �o�ny shall have the right to lien the uoits of the amers who default in the paysnent of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the a�anage+nent company. 10.
