UTILIT1f FACILITIES.
WHEREAS, by City Council Resolution Pb. 75-135 a public hearing was
callcd frn^ Ja uaryr 8. 1976 to determine Mhether an Undergrounding District should
be establlshed on all or a portion of the property located southerly of E1 Paseo
bet +een San Luts Rey and Prickly Pear Lane; and
WNEREAS, said public hearing was helA and all persons Nishing to s eak
on said matter rere allowed to do so; and
WHEREAS, alt utflity companies affected and all p operty owners Mithin the
area rere notifieA of said public hearing; and
NHEREAS. a report was pre! ared and submitte pursuant to Section 3 of
Ordinance lio. 20 of the City of Palm Desert; and
NHEREAS, the Cfty Council found that the public safety requires the removal
and the i stallation of undergrourM utility facilities for the area described
below on the basis that the users of the two parking lots proposed to be con-
structed under the existin9 ove head facilities uwy place their users in jeopardy;
and the occupants of tvro existing motels ahich are located adjacent to the existing
overhead facilities may be in jeopardy because of this being a high Mind area
which could cause the overhead facilities to fall on the existing buildings or
parked vehicles, esuiting in a fire ahich could be harzardous; and
IIHERFAS, the City Cvuncil found the public welfare requires the removal
of the overhead facilities to imurove the aesthetics of the area.
ti0fi, THEREFORE, EE IT RESOLYED by the City Council of ti e City of Patm
Desert, California as foltows:
1. That the above represents the findings of the City Council in their
deliberations on this atter.
2. That it does hereby esWblish and declare Assessor's Parcels

4. The City Cterk 1s hereby directed to notify all affected utility ; ,

co�p�nies and all persons owning real property within this district Mithin 10 days �
�fter tMs date of the adoption of tMs Resolution. �
5. The City Clerk shalt also notify ati affected property oMne�s of the ;

necesslty that 1f they or any person occupying such property desires to continue �, ,
to receive etect�ical. co�rmunication or sin�ilar associated servlces, they o�
such acupant shall provide all necessary facility changes on their pre+nises so as
to recelve such servlce fran the supplying utility or utilities at a nea under-
ground location. This notification shall be made by �ailing a copy of this
Resolution and a copr of City Ordinance Tb. 20 W the affected property ovme� as
shown on the last equalized assessment role and to the affected utility companies.
6. The City Clerlc shatt also inform atl affected property a+n�rs that the
cost of u�dergrounding of the distribution lines along the mid-block property line
and along the San Luis Rey fronta9e will be an assess�ent against the property on the
basis of a per front foot of fronta9e of the propertr on the dist�ibution line �+hich
is due and payabie upon notice by the Citr vrithin five (5) days after the confirma-
tion of the assess�ent by the Council. If the assessn�ent is not paiA Mithin the
specified t1�ae. it shall become a lien upon the property against which the assess-
merit 1s a�ade by the City Councii or a perso� autho�ized by the City Council.
7. The Citr Clerk is autho�ized to take all necessary steps to accanp2ish
the requirements of OMi�ance tb. 20 as it applies to the imptementation of this
Utilitr Undergrounding District.
