HomeMy WebLinkAboutCC RES 76-092RESOLUTION NO. 76-92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INSTRUCTING THE SUPERINTENDENT OF STREETS TO NOTIFY THE PROPERTY OWNERS OF ALL LOTS LACKING CURB, GUTTER AND SIDEWALK WITHIN CERTAIN SECTIONS OF THE COMMERCIAL AREA TO CONSTRUCT OR CAUSE TO BE CONSTRUCTED CURBS, GUTTERS AND SIDEWALKS IN CONFORMANCE WITH CITY STANDARDS. WHEREAS, the City Council has recognized that there are many sections within the commercial area which do not have adequate curbs, gutters and sidewalks; and WHEREAS, under the provisions of Chapter 27 of the Improvement Act of 1911 in the Streets and Highways Code of the State of California, the City Council can require the construction of curbs, gutters and sidewalks; and WHEREAS, the City Council believes it will be in the best interest of the City to have the remaining improvements installed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California as follows: 1. The Superintendent of Streets is hereby authorized and instructed to notify the owners of those properties noted on the attached Exhibit A" to construct curb, gutter, sidewalk and any necessary paving as appropriate to City Standards within sixty 60) days from the date of the notice. 2. The notice shall be mailed and posted in accordance with the requirements of Section 5870 et. seq. of the Streets and Highways Code.
