Clrcuit Court of Ilppeals -- which ruled that the 16d acre li�iUtion per oNne�-fanner prortsions of the 1402 Reclamation Act do apply to tolor�do River liater supplted throuyh the All-American Canai and to users of feder�lir funded aater suppliea by the Colorado River Aqueduct for far�ninq Py1'�1pStf: i11d NHEREAS. enforcdnent of the 160 ac�e farm limitation is expected W crN te egrlcultural economic chaos in the Coachella Yailey; and WHEREAS. this C1ty and the other cities of Eastern Riverside County. betause of thei� i�terdependenct upon. and inte9ration with. the agricultural econanit structure. would suffer i►reparable fiscal and social damage from the enforcement of the fk t at a tfine ahen inflation and unemployment have alreadr eroded the dollar to a� alarniing low point. NOW. iHEREFORE, 8E IT RESOIYED. that the City Council of the City of Palm Desert does fiereby unamimouslr recomme�d and request that the 1902 Reclan�atlon Act be replaced with a daument meetinq the needs of modern agricultu�e and eioCern cfvilization: which respects the rights of private citilens to their owrt prope�ty: respects prior vested wate� rights; respects previous Goverrment contracts; and does not infringe on human, Co�stitutional. anE iegal rights of the p�ivate property rnmers xho happer� to be reteivinq tolorado River water.
