A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ANNOUNCING FINDINGS AND ASSUMING JURISDICTION
AND APPROVING, SUBJECT TO CONDITIONS, THE DEVELOPMENT CF
NINE 9) SINGLE-FAMILY RESIDENCES IN THE PORTOLA ESTATES
PROJECT, ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE
OF HAYSTACK ROAD. CASE NO. SOMF
WHEREAS, the C1ty Counctl of the C1ty of Pal Desert. California. did
eceive a verified appeal f an EUCLIO-BA L COMPANY of the Condltio s of Approval
adopted by the Palm Oesert Planning Commission for nine (9) single-family resi-
dentes 1n the Portola Estates project, on property located in the R-1-10,000
zone district. and situated on the south side of Haystack Road, easterly of High-
way 74. and the property being n+ore particula ly EescriDed as:
LOTS 2. 3, 4. 22. 23, 30. 31. 32. b 33

NHEREAS. saSd applicatio is exempt f►rom the equirements of the "City
of Palm Desert Environmenta) Quality Procedure Resolution No. 74-14"; and
WNEREAS, on December 14. 1916, the Palm Desert Planning Commission did
consider this request for Plot Plan approval and the applicant has filed a timely
appeal request; and
WHEREAS. upon receivin9 a d conside i y the testtmony a d a guments, if
s
any of all persons who desired to be heard. saiA City Council did find the fol-
lo►ving facts and reasons to exist to approve the project:
1) Existing pad elevations are not unnecessarily high ard will not
needlessly interfere Nith the scenic vie++ of adjacent property oNners.
2) Modification of the indicated roof pitches would not help to preserve
scenic vistas without adversely affecting architectural design.
3} Side++alk installation is needed alo g Haystack oad to ensu e the pro-
tection of the public health, safety, and general welfare.
NOM. THEREFORE. BE IT RESOLYED by the City Council of the City of Palm
Desert, Califo nia. as follovrs:
1) That the above recitations are true and correct ard constitute the
findings of the Council in *.his case.
2) That it dncs herebr approve Case No. 50MF, subject to the attached
eight (8) tond'.tions attacfied .

CONDITIONS Of APPROYAL

1. the develop�nent of this proJect shall conform substantially to all development
plans subniltted in behalf of this case (Exhibits A-P). and as revised accordinq
to Plenning CaraN ssfo� action. Any minor changes require approval by the
0lrecto� of Environmental Services. Any substantial change requires approval
by the Pla�ning Commission.
2. All requl►�ents of any law. ordinance. or regulation of the State. City.
and any other applicable governr,ent entity shall be complied Hith as part
of the developnent process.
3. This approval is applicab]e. subject to the development of this proiect.

8. 5ide�ralk shall be provided to the specifications of the City Enqineer.
AGREEMENT:
I accept and agree, prior to use of this permit or approval, to ca^ply with all
the condition5 Set f0�!h, and understand that the Departnent of Buildinq b Safety
will not issue a building permit or allow occupancy on the use perr�itted until CI115
