A RESOLUTION OF THE CI1'F COUNCIL OF THE CITY OF
PALh4 DESERT, CALIFORNIA, SETTING FORTH ITS FI�D-
INGS AND APPROVING A TEI�TTATIVE h4AP WHICH i4'OULD
CREATE A 2-LOT SUBDIVISION TO PROVIDE FOR 100
AIR-SPACE CONDOr4I�'IUn4S AND RECREATIONAL Ab�ENITIES
ON APPROXTbSATELY 10 ACRES �ti'ITHIN THE PR-7 ZONE
LOCATED NORTH OF IRONTREE DRIVE, WEST OF b4ARIPOSA
DRIVE AND SOUTH OF FOXTAIL LANE.
CASE NO. TT 12784
«'HEREAS, the City Council of the City of Palm Desert, California,
did hold a duly noticed Public Hearing held on the lOth of August, 1978,
to consider the application of SILVER SPUR ASSOCIATES requesting ap-
proval of a Tentative b2ap to create a 2-lot subdivision to provide for
100 air -space condominiums and recreational amenities on approximately
10 acres tivithin the PR-7 (Planned Residential maximum 7 du/acre) zone
located north of Irontree Drive, west of It2ariposa Drive and south of
Foxtail Lane, more particularly described as:
APN 631-250-007 and a portion of
APN 631-270-018 and APN 631-270-022
�1'HEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental QuaZity Procedure Resolut.ion
No. 78-32," in that the Director of Environmental Services has deter-
mined that the project is exempt; and, �'
iti'HE REAS, the City Council did take into consideration the Tenta-
tive hiap as submitted, and the reports of the various revie�ving agencies;
and,
iYHEREAS, the City Council did find that the subject Tentative n4ap
does substantially comply with Chapter 26 of the City af Palm Desert
Tiunicipal Code, and the State of California Subdivision I+iap Act, as
amended; and,
�VHEREAS, the City Council did find that the subject Tentative 114ap
does comply with the adopted General Plan and the Palm Desert Zoning
Ordinance; and,
��'HEP,EAS, the City Council did find that the site is physically
suitable for the type of development proposed; and,
�tiHEREAS, the City Council did find that the site is physically
suited for the proposed density of the development; and,
jVHEREAS, the City Council did find �hat the design of the sub-
division and the proposed improvements are not likely to cause substan-
tial environmental damage or serious health problems.
NO�V, THEREFORE, BE IT RESOLVED by the Ciiy Council of the City of
Palm Desert, as fo�lows:
l. That the above rec-itations are true and correct and consti-
tute the findings of the Council in this case;
2. That it does hereby approve the above described Tentative
I�iap No. 12784 subject� to fulfillment of the attached conditions.

Standard Conditions:

l. The development of the propertl� descrzbed herein shall be subject
to the xestrzctions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal sta.tutes
no�v in force, or �vhich hereafter may be in force.
2. Full public improvements including traffic safety lighting as re-
quired Uy Ordinance and the Director of Public i'�orks, shall be
ins�alled in accordance with City standards.
3. The C.C.R.R's for this development shall be submitted to the Director
of Public �1'orks for review and approcal prior to the issuance of
any building permits, Prior to recordation of the final subdi��ision
map, the applicant shall submit to the Director of Public �`orks:
a. The document to convey iitle.
b. Covenants and restrictions to be recorded.
c. lianagement and maintenance agreement to be entered into �vith
ihe o�i�ners of the units of the project.
4. Impro�-ement plans for water and se«�er system shall meet the re-
quirements of the respective service districts.
5. Area shall be annexed to appropriate Tmprovement Districts ha�-ing
jurisdiction over the subject area.
6. Al1 dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City
and free of all liens and encumbrances.
7. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealAd from vie��� except certain
appurtenances as may be approved by the Director of Environmental
Services.
8. Complete plans and specifications shall be submitted as required
bq OI"Cinance to the Director of Public �Gorks for checl�ing and ap-
proval before construction of any improvements is commenced. The
subdi��ider shall submit "as-built" plans prior to acceptance of
the subdi�,�ision impro�•ements by the City.
9. In order to maintain reasonable fire protection durinb the construc-
tion neriod, the subciivider shall maintain passable �ehicular ac-
cess to all buildings. An adequate number of fire hydrants «�ith
required fire flo�vs shall be installed as recommended by the Fire
1larshal.
10. All requirements of the City Fire :�iarshal shallbe met as part of
the development of this tract per attached memorandum.
11. Drainage shall be subject to approval of the Director oi Public
�'�orks. Applicant shall px�ovide enbineered data as requested.
12. The total number of lots shall be Iimiied to 2,

14. Applicant shall pay fees into the Palm Desert Planned Local
Drainage Facilities Fund in an amount to be determined by
the provisions of Ordinance nTo. 175.
Special Conditions:
l. Traffic safety lighting shall be installed in accordance with
the approval of the Director of Public R'orks.
2. Al1 development shall conform to the Development Plan for the
subject property known as Case No. 134MF as appxoved by Plan-
ning Commissian Resolution No. 390.

Due to the lack of sufficient fire protection in the area of the proposed
development, we request that this tract be denied until such time that the
new fire station is constructed.
In the event this tract �s approved, the following fire protection will be
required:
1. Install a water system capabie of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of ineasurement.
2. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shali be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire Marshal
for rev�ew.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certif�cation: "I certify
that the design of the water system in Tract No. 12784 is in accordance with
the requirements prescribed by the Fire Marshal." Upon approval, the orig-
inal plan will be returned to the developer.
