CASE N0. TT 12181-2 and 147MF WH�k3,EAS, the City Council of the City of Pa,lm Desert, California, did on the 28th da.y of September, 1978, hold a duly noticed�Public Hear ing, and:�a �ontinued Public Hearing on October 12, 1�J'78, to review an application from LE(NIS HOII�'S OF CALII�TIA requesting approval of a Tentative Tract and Pr�l.iminary Design �.eview for a 73 lot singZ•�-family subdivision on 18.5 acres of lanci, located in the R-2(5), S.P, anci tt-1 zones and situated at the southwest corner of the inter- section of Portola Avenue and Rutledge �9ay extended, more partic�larly described as: The southern portion of APN 621-360-004 �'VHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that the project would not have a significant impact on the environment and the appeal period did expire; and, �YHEREAS, the City Council did take into consideration the Tentative Diap as submitted, and the reports of the various reviewing agencies; and, ?VHEREAS, the City Council did find that the subject Tentative Map with 73 lots does substantially comply with Chapter 26 of the City of Palm Desert l�7unicipal Code, and the State of California Subdivision 1Zap Act, as amended; i9HER�AS, the City Council did find that the subject Tentative Uiap does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, �1'HEREAS, the City's Design Review Board did review the design as- pects of the request and did recommend approval. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That it does hereby approve the above described Tentative P,�ap No. TT 12181-2, subject to fulfillment of the attached conditions. 3. That it does hereby approve the Preliminary Design Review Case No. 147hiF subject to the attached conditions. The d�velopment of the property descriUed llerein shall be subject - to the resti•ictions and limitations set forth herein �vhich are in addition to all municipal ordinances and State and Federal statutes no�v in force, or �vhich herea.fter may be in force. 2. The C.C.&R's for this development shall be submitted to the Director of Public jYQrl�s �or revie�v and approval prior to the issuance of any buildinb permits. All dedicated land and/or e�.sements required by this appro�al shall be granted to the City of Palm Desert, �vithout cost to the City and free of all liens and encumbrances. 7. All on-site utilities, includir�g cable TV, shall be placed under- ground and shall be completely concealed from vie�v e:�cept certain appurtenances as may be approved by the Director of Enviror.mental Ser��ices. 8. Complete plans and specifications shall be submitted as required by Ordina.nce to the Director of Public Stiorks for checking and approval before construction of any ir�procements is commenced. The sub- divider shall submit "as-buil.t" plans prior to acceptance of the subdivision improvements by the City. - 9. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildinbs. An adequate nur;lber of fire hy�drants with the re- quired fire flows shall be installed as recommended by the Fire 11ar- shal. _ 10. { 11. � 12 Al1 requirements of the City Fire :�-Iarshal shall be met as a part of the clevelopment of this tract per attached memorandum. Drainage sha11 be subject to approval of the Director of Public �Yorks. Side«�alks shall be pro�-ided on all public streets to City� Sta.ndards. 2. A concrete block wall, 6 feet in height shall be required along � the Portola Frontage. • 3. All lots abutting Portola Avenue shall have a minimum depth of 110 ft. 8. A block wall 6 ft. in height shall be provided on the south and west boundary lines of the subdivision. 9. All lots shall have a minimum depth of 100 feet. 10. Length of Street "I" shall be shortened to provide for Lots 8& 9 to back up to the south property line in conformance with City Standards. � 11. San Pascual Avenue shall be improved and fully dedicated as a part of this subdivision up to 44th Avenue. ` Design Review Conditions: l. Prior to entering Plan Check, the applicant shall submit detailed construction drawings to the Design Review Board for consideration and approval. Said drawings shall comply to the Conditions of Approval herein, to the Conditions of all rela�ed City approvals and all liunicipal Codes. Said drawings shall be comprehensive as to their compliance with the submittal requirements as speci- fied in the Boards application form. The building permit, when issued, shall include all elements reviewed and approved by the Design Review Board. No certificate of use and/or final clearance shall be given by the Department of Environmental Services until construction is in total compliance with the approved plans, shall have been completed. 2. The proposed asphalt roof material is not approved. The applicant should consider a variety in tile colors and rock. 3. The applicant shall restudy elevation 2-D. 4. Al1 lots shall be fenced in accordance with City Standards. i 5. The developer is responsible for the installation of landscaping i and irrigation along all street frontages. Install a�rater system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a r�inimum of 20 psi residual operating pressure in the supply main from which the flotiv is measured at the time of measurement. 2. Install Riverside County super fire h��drants located at each street inter- section (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the origi- nal and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered c�vil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. 12181-2 is in accordance with the requirements prescribed by the Fire Marshal."
