CASE N0. TT 13008 W��EREAS, the City Council of the City of Palm Desert, California, did, on the 30th day of November, 1978, hold a duly noticed Public Hearinq to consider a request by COVE CONSTRUCTION COMPANY for approval of a Tentative Tract Map to create 161 sinqle-family residential lots on approximately 64.4 acres within the R-1 12,000 (Sinc�le-family residential, min. 12,000 sq. ft. lot area) and R-1 12,000, S.P. (Sinc�le-family residential, min.12,000 sq. ft. lot area, Scenic Preservation Overlay) zones qenerally located east of Hiqhway 74, south of Homestead Road, more particularly described as: APN 631-02�8, APN 631-03-1, 2, 3, APN 631-04-13, 14, APN 631-11-1, 2, 3, 5, 7, 8, 9, 14, & 15 IJHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental �uality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that this project will not have a significant effect on the environment and no further documentation will be required; and, I�HEREAs, at said Public Hearin�, uoon hearinc� and considerinn all testimony and arquments, if any, of all oersons desirinq to be heard, said City Council did find the followinq facts and reasons to exist to recommend aoproval of the Tentative Tract Map: l. The subject Tentative Man does substantially comply with Cha�ter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Man Act, as amended. 2. The subject Tentative Map does comply with the adopted �eneral Plan and the Palm Desert Zoninq Ordinance. 3. The site is physically suitable for the type of development or000sed. 4. The desiqn of the subdivision and the proposed improvements are not likely to cause substantial environmental damaqe or serious health problems. NOW, THEREFORE, BE IT RES�LVEO by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitu+e th� findings of the City Council in this case; 2. That it does hereby require that the applicant pay a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision �rdinance renardin� the nublic facilities requirement; 3. The developrnent of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes -no�� in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lightinb as required by Ordinance and the Director of Public �tiorks, shall be �installed ir. accordance with City Standards. 3. The tract shall be subject to the payment of drainabe and signali- zation fees as required by the City of Palm Desert. 4. The CCS.R's for this development shal� be submitted to the Director of Public �Vorks for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Public i�"orks: 5. � a. The document to convey title. b. Covenants and restrictions to be recorded. c. bSanagement and maintenance agreement to be entered into cvith � the o«�ners of the units of the project. Improvement plans for water and se�cer system shall meet the require- ments of the respective service districts. Area shall be anneYed to appropriate Improvement Distri�cts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on-site utilities, including cable TV, shall �e placed under- ground and shall be completely� concea�ed from vie�v e�cept certain appurtenances as may be approved by the Director of Environmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public ��'orks for checl�ing and approval before construction of any improvements is commenced. The sub- di�-ider shall submit "as-built" plans prior to acceptanc� of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection durinb the construc- _ tion period, the subdi�ider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with the re- quired fire flo�vs shall be installed as recommended by the Fire blarshal . 11. Al1 requireMents of the City Fire ;l-iarshal shall be met as part of the development of this tract per the attached letter dated October 23, 1978. 12. 13. Drainage shall be subject to approval of the Director of Public ��'orks. Applicant shall provide engineered data as requested. The total number of lots shall be limited to I61 «lith a minimum area of 12,000 sq. ft. 14. The applicant shall have tw�el�e (12) months from the date of the approval or conditional approval of the tentative map�for filin; of the final map unless an eYtension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 15. Engineering calculations shall be submitted for all drainage structures to substantiate the design of the proposed open concrete channels. 2. The developer shall be responsible for improvements of off-site streets to upgrade their water carrying design, inciuding the installation of cross-gutters and swales, as required by the Director of Public Works. 3. The developer shall make a contribution according to the signali- zation Ordinance of the City of Palm Desert in the amount of $8,050.00. 4. The tract shall be bounded by a six (6) foot high masonry wall, as required by the Director of Environmental Services. Said wall shall be of decorative character adjacent to public streets. _ 5. Proposed improvements, as expressed in Exhibit B, shall be installe as part of the subdivision improvements, except sidewalks shall be provided on both sides oi �7esa View Drive. 6. Applicant to provide acceptable easements to accommodate drainage from Section D& H onto the property. 7. Single easements shall be applied betcveen lots, where appropriate. 8. '�iesa View Drive shall be lully improved as part of the first phase. �
