A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PAL?�1 DESERT, CALIFORNIA, SETTING FORTH ITS
FIiVDINGS AND APPROVING A TENTATIVE P,1AP TO SUB-
DIVIDE APPROXIA4ATELY 8.41 ACRES TO CREATE 4

�tiHEREAS, the City Council of the City of Palm Desert, California,
did on the 30th day of November, 1978, hold a duly noticed Public Hearing
to consider the application of ROGER BOYAR DEVELOP�,IENT C0. for approval
of a Tentative Tract Map to subdivide an 8.41 acre area within the PR-7
(Planned Residential, max. 7 du/acre) zone into 4 lots, the subject
property generally located west of Highway 74, within the Kings Point
Condominium Project, more particularly described as:
Lot 9, Tract 4380-1 and Parcel 2, PAf 11050
�1'H�REAS, at said Public Hearing, upon hearin� and considering
all testimony and arguments, if any, of all persons desiring to be
heard, said City Co�::icil ,�id find the following facts and reasons to
exist to recommend approval of the Tentative Tract 11ap:
1. The subject Tentative D1ap does substantially comply with
Chapter 26 of the City of Palm Desert I�Sunicipal Code, and
the State of California Subdivision Diap Act, as amended.

The subject Tentative hiap does comply �vith the adopted
General Plan and the Palm Desert Zoning Ordinance.
The site is physically suitable for the type of develop-
ment proposed.
The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage
or serious health problems.
NO�U, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Council in this case.
2, That it does hereby approve the above described Tentative
^,iap No. 13323 for the reasons set forth in this Resolution and subject
to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert City Council held on this 30th day of November, 1978, by the
following�vote, to wit:

1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein �vhich are in
addition to all municipal ordinances and State and Federal statutes
no�v in force, or �vhich hereafter may be in force.
2. Full public improvements including traffic safety li�hting as re-
quired by Ordinance and the Director of Public �'�'orks, shall be in-
stalled in accordance with City Standards.
3. The CC�.R's for this development shall be submitted to the Director
of Public �ti'orks for review and approval prior to the issuance of any
building perinits. Prior to recordation of the final subdivision map,
the applicant shall submit to the Director of Public «'orks:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. ".ianagement and maintenance agreement to be entereci into �vith
the o���ners of the units of the project.
4. Improvement plans for water and sewer system shall meet the require-
ments of the respective service districts.
5. Area shall be annexed to appropriate Improver:7ent Districts having
jurisdiction over the subject area.
6. All dedicated land and/or easements required by this approval s11a11
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
7. Al1 on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from vie�c etcept certain
appurtenances as may be approved by the Director of Environmental
Services.
8. Complete plans and specifications shall be submitted as required by
Ordinance to the Director ol Public L9orks for checking and approval
before construction of any improvements is commenced. The sub-
divider shall submit "as-built" plans prior to acceptance of the
subdivision impro��ements by the City.
9. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildinbs. An adequate number of fire hydrants �rith required
fire flows shall be installed as recommended by the Fire bSarshal.
10. Al1 requirements of the City Fire :Iiarshal shall be met as a part of
the development of this tract per attached letter dated Oct. 23, 1978.
11. Drainabe shall be subject to approval of the Director of Public
�9orks. Applicant shall provide engineered data as requested.
12. All requirements of the Planning Commission action on related Case
No. DP 08-78 shall be met as a part of the development of this tract.
13. The t.otal number of lots shall be limited to 4.
1�. The applicant shall have twelve (12) months from the date of the
approval or conditional appro��al of the tenta.tive map for filing of
the final map unless an e�tension of time of up to eighteen (18)
months is granted by a Resolution of the City Council.
15. The tract map shall be subject to City required constributions to
Drainage and Sibnalization funds, at a fee to be determined by the
Director of Public �1'orks.
