HomeMy WebLinkAboutCC RES 78-171RESOLUTION N0. 78-171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO CREATE A 384 LOT RESIDENTIAL CONDOMINIUM SUBDIVISIOPJ. CASE N0. TT 13407 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of December, 1978, hold a duly noticed Public Hearing, to consider the request of D. K. Kavanaugh Enterprises/Covington Brothers, Inc., for approval of a Tentative Tract Map to create a 384 lot condominium subdivision to allow 380 residential units and common open space on approximately 80 gross acres within the PR-5 (U.A.) (Planned Residential, max. 5 du/acre, Upon Annexation) zone east of Cook Street and North of Hovely Lane (extended), more particularly described as: A portion of SW 4, Sec. 10, T5S, R6E WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the subject project has been previously assessed under C/Z 11-78 and DP 14-78, and no further evaluation is deemed necessary; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. 7hat it does hereby approve the above described Tentative Map No. 13407 for the reasons set forth in this Resolution and subject to the attached conditions. ThE development of the propert5 described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limi�ations, and restrictions of all municipal ordinances and State and Federal statutes now -- in force, or �vhich hereafter may be in force. 2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final :�1ap, the applicant shall provide � the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. 4. Access ri�hts shall be offered to the City as a�dedication on the Final �iap, on Hovely Lane. � , 5. The C.C.&R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. bianagement and maintenance agreement to be entered into with the o�cners of the units of the project. � 6. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. � �. All on-site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from vie�v except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of th� subdivision im- provements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flotvs shall be installed as recommended by the Fire ti�arshal. '12. Prior to recordation of the Final hiap, the developer shall furnish -- the original and three (3) copies of the water system plan to the Fire ti4arshal for review. — -- -- 13. All requirements of the City Fire P,4arshal memo dated Nov. 20, 1978 shall be met as a. part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the folloa�ing certification: "I certify that the design of the water system of Tract No.13407 is in accordance �vith the requirements prescribed by the City Fire liarshal." � RESOLliTIOV N0.78-171 Sta.ndard Conditions: (Cont. ) 15. 16. Pa�e Ttiree Drainage shall be subject to approval of the City Engineer. Ap- plicant shall pro��ide engineered data as requested. All private streets shall be inspected by the Engineerina Depart- ment and a Standard Inspection Fee shall be paid. 17. All requirements of the Planning Commission action on the Develop- ment Plan z4-78 shall be met as a part of the development of this tract. i 18. The total number of lots shall be limited to 384.. 19. The applicant shall have twelve (12) months from the date of the appro��al or conditional approval of the tentative map for filing of the final map unless an extension of time of up t'o eighteen (18) months is granted by a Resolution of the City Council. 20. Drainage and Si�nalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final '�iap. 21. Developer shall dedicate land, pay a fee in lieu thereof, or a combination of both, at the option of the City Council, as a con- dition of the Final 1iap, for park and recreation purposes. The City shall commit the use of any such fees received within a five S�ear period. Special Conditions: e 1. The street improvements required in PD-i 13406 shall`be installed prior io any de��elopment of this tract. 2• Each phase shall be served by full. pri�•ate street improvecnents and that any phasin� sho���n on the final map shall reflect this condition. 3. EYcept for street and emergency entrances to the tract, the entire perimeter shall be bounded by a six (6) foot high �vall to be in- stalled in the first phase as approved through the Design Revie�� process. 4. -The detail of the entrance connection with private street 'A' shall be as appro�ed throubh the Design Review process.' 5 � That suitable �vindbreak/blowsand treatment be provided alonb the tract perimeter, as approved through the Design Review process. Safety street lightinb shall be installed at the intersection of Hovely Lane and Street 'A'. 7. This tract shall pay $19,000 to the signalization fund of the City of Palm Desert. � 8.
