A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND APPROVING A TENTATIVE MAP TO CREATE
65 LOTS TO PROVIDE FOR A CONDOMINIUM HOTEL, 7
SINGLE-FA14ILY RESIDENCES AND 57 CONDOMINIUM UNITS
ON APPROXIMATELY 17.8 ACRES OF LAND, GENERALLY
LOCATED BETWEEN HIGHWAY III AND CANDLEWOOD STREET,
WEST OF THE PALM DESERT-INDIAN WELLS CITY LIMIT
LINE.

WHEREAS, the City Council of the City of Palm Desert, did re-
ceive a verified application from U. S. LIFE SAVINGS AND LOAN ASSOC.,
requesting approval of a Tentative Tract Map to create 65 lots to
provide for a condominium hotel, 7 single-family residences located
between Highway 111 and Candlewood Street, west of the Palm Desert -
Indian Wells City Limit Line within the P.C.(4), S.P. (Planned Com-
mercial Resort, Scenic Preservation Overlay) and PR-6 (Planned Resi-
dential, maximum 6 d.u./acre) zones on property more particularly
described as:

WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 77-7", in that the Director of Environmental Services has deter-
mined on January 10, 1978, that the project will not have a significant
adverse effect on the environment and no further documentation under
the provisions of the State guidelines for the implementation of CEQA;
and,
WHEREAS, the City Council did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies; and,
WHEREAS, the City Council has received a recommendation of ap-
proval of the subject tentative map from the Planning Commission as
indicated in Planning Commission Resolution No. 330; and,
WHEREAS, the City Council did find that the subject Tentative
Map does substantially comply with Chapter 26 of the City of Palm Desert
;Municipal Code, and the State of California Subdivision Map Act, as
amended; and,
WHEREAS, the City Council did find that the subject Tentative
hiap does comply with the adopted General Plan and the Palm Desert Zon-
ing Ordinance; and,
WHEREAS, the City Council did find that the site is physically
suitable for the type of development proposed; and,
WHEREAS, the City Council did find that the site is physically
suited for the proposed density of the development; and,
WHEREAS, the City Council did find that the design of the sub-
division and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Council in this case;

2. That it does hereby require that the applicant pay a
fee in an amount determined under the Ordinance provisions in order
to comply with Article 26.15 of the City's Subdivision Ordinance re-
garding the public facilities requirement:
3. That it does hereby approve the above described Tentative
iiap No. 11883, subject to fulfillment of the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the
Palm Desert City Council held on this 23rd day of February 1978,
by the following vote, to wit:

1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein ,%:hich are
addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes
in force, or which hereafter may be in force.
2. Full public improvements including; traffic safet; lief tier; as
required by Ordinance and the Director of Public Works, shall be
installed in accordance with City standards.
3. Prior to submittal of the Final tilap, the applicant shall pro,:ide
the Department of Environmental Services with a list of proposed
street names with at least three alternatives. The approval of
the final street names shall be made by the Director of Environ-
mental Services.
4. access rights on the Frontage Road and the proposed street connec-
tion between Driftwood Drive and Shadow Hills Road shall be offered
to the City as a dedication on the Final Map.
5. The C.C.KR's for this development shall be submitted to the City
En-ineer for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the Director of Public Works:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with
the owners of the units of the project.
6. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City
and free of all liens and encumbrances.
9. All on -site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required
by Ordinance to the Director of Public Works for checking and ar,-
proval before construction of any improvements is commenced. The
subdivider shall submit "as -built" plans prior to acceptance of tine
subdivision improvements by the City.
11. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with required
fire flo,.%,s shall be installed as recommended by the Fire Marshal.
12. All. requirements of the City Fire !.Iarshal shall be met as a part
of th�2 development of this tract per attached memorandum.

15. The total nu:nber of lots shall be limited to 65.
16. The applicant shall have twelve (12) months from the date of
approval or conditional approval of the tentative man f,-)r f=='_r
of the final man unless an extension of time of up to ei-Thte_--n
(1S) months is granted by a Resolution of the City Council.
Special Conditions:
1. All improvements, curbs, gutters, sidewalks and tie-in paving,
shall be installed on Candlewood Street in front of Lots 2 throug

from Shadow Hills Road to Driftwood Drive, and on the access ease-

3. Applicant agrees to contribute S15,000 towards city-wide drain-ge.
This money shall be deposited into the Pal^ Desert Drainage Fund.
4. The necessary right-of-way shall be dedicated to make Candlescood
Street a 60 foot street.
5. The proposed access easement shown connecting. Driftwood Drive a:
Shadow Ilills Road shall be dedicated to the Citv of Palm Desert.
6. In compliance with Article 26.15 of the City's Subdivision Ordi-
nance, the public facilities requirement shall be met by the pay -
in;; of a fee in an amount determined under the Ordinance provi-
sions.

Gentlemen:
Provide the following fire protection:
1. Install a .pater system capable of delivering ?.;nn GP 1 fire flc:r frcT any
fire hydrant for a taro hour duration in addition to dcmestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressu,e
in the supply main from which the flo,:r is measured at the timme of TEasure-.c ,t.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surfac of hydrant barrels and heads shall be painted chrome yel;c•:r,
and the tops and nozzle caps shall be painted green.
B. Cur's shall be painted red 15 feet in either airection from, each hydrant.
3. Pr -,-or to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for reviei:r.
4. The grater system plan shall be signed by a registered civil engineer and anpr=red
by the grater company, with the folic,:ring certification: "I certify that the
desicn of the water system in Tract Flo. 1128?3 is in accordance with the
requirements prescribed by the Fire 1,1arsha l . " Upon approval, the on g i ral pl:::'
