A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALT7 DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND APPROVING A TENTATIVE R4AP TO CREATE 13
LOTS TO PROV I DE FOR 12 CONDOD7IN I UI�i UN I TS AND C014-
hiON AREA ON APPROXIDSnTELY 1.39 ACRES GENERALLY
LOCATED ON THE EAST SIDE OF OCOTILLO, SOUTH OF
TUb•1BLE�UEED ,

�4'HEREAS, the City Council of the City of Palm Desert, did
receive a verified application from LINSCO AGENCIES, LTD., requesting
approval of a 13 lot subdivison to provide for 12 condominium units
and common area on approximately 1.39 acres generally located on the
east side of Ocotillo, south of Tumbleweed , more particularly des-
cribed as:
Lots 10, 11 and 12 in
Block G oi Palm Desert
Unit No. 3
�1'HEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Ruality Procedure Resolution
No. 77-7", in that the Director of Environmental Services has deter-
mined on February 13, 1978, that the project will not have a signifi-
cant adverse effect on the environment and the appeal period has ex-
pired; and,
jb'HEREAS, the City Council did take into consideration the Tenta-
tive b4ap as submitted, and the reports of the various reviewing agencies;
and,
�1'HEREAS, the City Council did find that the subject Tentative
Alap does substantially comply �vith Chapter 26-of the City of Palm
Desert Municipal Code, and the State oi California Subdivision b�ap Act,
as amended; and,
�VHEREAS, the City Council did find that the subject Tentative
:�Iap does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance; and,
�4HEREAS, the City Council did find that the site is physically
suitable for the type of development proposed; and,
iti'HEREAS, the City Council did find that the site is physically
suited for the proposed density of the development; and,
�ti�HEREAS, the City Council did find that the design of the sub-
division and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems.
NOL9, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Council in this case;
2. That it does hereby require that the applicant pay a fee in
an amount determined under the Ordinance provisions in order to com-
ply with Article 26.15 of the City`s Subdivision Ordinance regarding
the public facilities requirement;

3. That it does hereby approve the above described Tenta-
tive niap No. 12050, subject to ful�illment of the attached conditions:
PASSED, APPROVED, and ADOPTED at a regular meeting of the
PaIm Desert City Council, held on this 23rd day of March ,
1978, by the following vote, to wit:

4. The C.C.&R's for this de�-elopmer�t shall be sub:i:itted to the Dir�c�or
of Public til'or'_cs for re�-ie��T and appro�-al prior to the issu� nce o� any
buidin� permits. Prior to recordation of the final subdivision �r:�n.
the applic�,nt shall submit to the Director of Public �`�orks:
a. The docur.?ent to conve5� title.
b. Covenants and restrictior.s to be recorded.
c. '�Ianage:nent and maintenance a�reement to be entered into �vith
the owners of the units of the project.
5. Improve^:ent plans for water and s�ner system shall meet the re-
quirements of the respective service districts.
6. Area shall be anneYed to appropriate Ir�provement Districts ha�-in�
jurisdiction over the subject area.
7. Al1 dedicated land and/or ease:�ents required by this appro�•al sn�ll
be granted to the City of Palm Desert, �cithout cost to the Cit�-
and free of all liens and encumbrances.
8. All on-siie utilities, incluclinb cable TV, shall b� placed under-
grou^d and shall be cornpletely concealed from vie��� except certain
appurtenances as may be appro��ed by the Director of En�rironmental
Services.
J. Complete plans and specifica.tions shall be subraittecl as required '���
Ordinance to the Director of Public j'tiorks for chec;{in� and appro�-al
before construction of any imnro��ements is comTM�enced. The sub-
divider shall submit "as-built" plans prior to acceptance of tt:e
subdivision ir^pro��ements by the City.
