CASE NO. TT 5553 WHEREAS, the City Council of the City of Palm Desert, California, did receive a verified applicaiion from SILVER SPUR ASSOCIATLS, request- ing approval of a Tentative Tract Map to create 71. single-family resi- dential lots from a parcel approximately 27.5 acres in size located within the PR-7 (Planned Residential, max. 7 du/acre) zone at Ironwood Country Club, and more particularly described as: APN 631-190-012 APN 631-240-006 APN 631-250-011 APN 631-260-011 WHER�AS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined that this project is exempt from further environmental documentation as an EIR for the entire project entitled "Silver Spur" was submitted in June, 1972 and the appeal period has expired; and, WHEREAS, the City Council did take into consideration the Tenta- tive n4ap as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the City Council did find that the subject Tentative I14ap does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision biap Act, as amended; and, WHEREAS, the City Council did find that the subject Tentative h4ap does comply with the adopted General Plan and the Palm Desert Zon- ing Ordinance; and, WHEREAS, the City Council did find that the site is physically suitable for the type of development proposed; and, WHEREAS, the City Council did find that the site is physically suited for the proposed density of the development; and, WHEREAS, the City Council did find that the design of the sub- division and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. N0�9, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: l. That the above recitations are true and correct and consti- tute the findings of the Council in this case; 2. That it does hereby require that the applicant dedicate land pursuant to the agreement between the applicant and the City Counoil in order to comply with Article 26.15 of the City's Subdivi- sion Ordinance regarding the public facilities rec�uirement; 3. That it does hereby approve the above described Tentative D4ap No. 5553 subject to fulfillment of the attached conditions. Except in those cases where a side-in garage is used, the front yard setback may be reduced to 16'. b) The rear yard setbacks shall be 25' on all lots except lots 61 through 70 and 42 through 52 where the rear yard setbacks shall be a minimum of 40'. c) The side yard setback shall be 12' except lots 61 through ?C' and 50 through 52 where the side yard setbacks shall be 15'. d) All residences shall be single-story. The maximum building height shall be 16' on all lots except lots described as lots 42 through 57 and lots 61 through 70 where the maYimum building height shall be 14', and further, said maximum may be increased to 18' where adjacent views shall not be affected, subject to review by the Design Review Board. e) The minimum house size shall be 2,000 sq. ft. f) Building pads for lots 42 through 57 and lots 61 through 70 shall be graded to conform with the existing ground as closely as possible consistent with good engineering prac- tice and the requirements of the City of Palm Desert. However, in no event will the building pads be raised more than two feet above the average existing ground on said lots. Portola Avenue shall have a left turn pocket installed westerly of Mariposa Avenue to accommodate a minimum of 4 cars. The drainage for the subject tract shall be engineered and approved by the Director of Public j1'orks. A left turn pocket shall be provided on Portola Avenue for traffic heading in a northerly direction to accommodate 2 cars "A" Street shall be 40 feet curb to curb. The additional width shall be taken from the south of the proposed street. Traffic safety lighting shall be installed in accordance with the Director of Public Works' recommendations. Curbs and gutters shall be in conformance with the City of Palm Desert Standard Plan R-1. A decorative wall, the design to be approved by the Design Review Board, shall be constructed on the north side of Portola and shall extend to the northern boundary of the Ironwood holdings. A block wall shall be built along the � Buckboard Trail boundary of Tentative Tract 5553. 12. Any maintenance of landscaping placed in the public right-of-c�-ay shall be the responsibility of the Homeowners' Association in perpetuity and shall be subject to an encroachment permit. 13. The long response times from our existing Palm Oesert Fire Stai:ion will cause fires that would normally be small to grow in size prior to fire depart- ment arrival, causing more damage and posing a greater risk to human lire. It is my opinion that a�e cannot allow the area south of Haystack Road to continue it's rapid rate of growth without providing additional fire/rescue protection. Ho�.�- ever, if the Palm Desert City Planning Commission decides to allow continued develop- ment in this area, the following conditions shall be met: 1. Install a water system capable of delivering 2000 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supoly main from which the flow is measured at the time of ineasurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 5Q0 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yello�•�, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original ard three (3) copies of the water system plan to the Fire t�arshal for revie�,i. 4. The water system plan shall be signed b� a registered civil engineer and aporoved by the water company, with the following certification: "I certify that the desigr of the water system in Tract �lo. TT 5553 is in accordance with the reauire- ments prescribed by the Fire Marshal." Upon approval, the original plan �•;ill be returned to the developer. Very trul� yours, David L.
