A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND APPROVING A TE�'TATIVE MAP TO CON-
SOLIDATE 15 EXISTING LOTS TO CREATE 4 LOTS TO
PROV I DE FOR 21 CONDOr4I N I UM UN I TS AND COA4MON
OPEN SPACE ON PROPERTY GENERALLY LOCATED EAST
OF DEEP CANYON, BETWEEN SAGE BRUSH DRIVE AND
DRIFT`VOOD DRIVE .

WHEREAS, the City Council of the City of Palm Desert, did re-
ceive a verified application from DANIEL RUSSIE, requesting approval
of a Tentative Tract Map to consolidate 15 existing lots to create 4
lots to provide for 21 condominium units and common open space on
property generally located east of Deep Canyon, between Sage Brush
Drive and Driftwood Drive, more particularly described as:
Lots 15-29 Shadow Hills Estates
�VHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32," in that the Director of Environmental Services has deter-
mined that the project is exempt from further documentation as a Nega-
tive Declaration was issued for a related project, Case No. CUP 19-77;
and,
WHEREAS, the City Council did take into consideration the Tenta-
tive I11ap as submitted, and the reports of the various reviewing agencies;
and,
� WHEREAS, the City Council did find that the subject Tentative
n4ap does substantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Subdivision Map Act,
as amended; and,
WHEREAS, the City Council did find ihat the subject Tentative
D7ap does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance; and,
�VHEREAS, the City Council did find that the site is physically
suitable for the type of development proposed; and,
�YHEREAS, the City Council did find that the site is physically
suited for the proposed density of the development; and,
tiUHEREAS, the City Council did find that the design of the sub-
division and the proposed improvements are not likely to cause sub-
stantial environmental damage or serious health problems.
NO�V, THEREFORE, BE IT RESOLVED by the City Council of the City
of Palm Desert, as follows:
l. That the above recitations are true and correct and consti-
tute the findings of the Council in this case;
2. That it does hereby require that the applicant pay a fee in
an amount determined under the Ordinance provisions in order to com-
ply with Article 26.15 of the City's Subdivision Ordinance regarding
the public facilities requirement;

3. That it does hereby require that the applicant pay fees
into the Palm Desert Planned Local Drainage Facilities Fund in an
amount to be determined by the provisions of Ordinance No. 175.
4. That it does hereby approve the above described Tenta-
tive Rsap No. I2450, subject to fulfillment of the attached condi-
tions.

of Public �ti'orks for revie�v and appro�-al prior to the issu�.nce �' any
building permits. Prior to recordation of the fina� subdi�•isic� map,
the applicant shall subrnit to the Director of Publ ic i�orl:s :

b. Covenants and restrictions to be recordecl.
c. 1lanagemen� and maintenance asreer�ent to be entered into wi��
the o«�ners of the units of the project.
Improvement plans for uater and se:rer s5�stem shall meet the re-
quirements of the respecti�-e service districts.
Area shall be anneYed to appropriate Improvement Districts hn�-i�„
jurisdiction over the subject area.
7. Al1 dedicated land andjor easements required by this a.ppro��al s�all
be granted to the City of Pa�:n Desert, n�ithout cost to the Cii�:
and free of all liens and er.cumbrances.
8. All on-site utilities, including cable TV, shall be placed unci�~-
grouncl and shall be completel�° concealed from vie�.r elcept ce=•t :_n
appurtena.nces as may be anproved by the Director of En�-ironr.:en�al
Services.
9. Cor:�plete plans and specifications shall be submitted as req��i;-F:::
