CASE NO. TT 12556 tiVHEREAS, the City Council of the City of Palm Desert, California, did receive a verified application from TRANSCOPIC DEV�LOPMENT CORPORATION requesting approval of a Tentative Tract b•iap to create an Sl-lot subdivi- sion to provide for 80 condominium units and common open space from a parcel approximately 13.5 acres in size within the PR-6, S.P. (Planned residential, maximum 6 du/acre, scenic preservation overlay) zone at the northwest corner of Cook Street and 44th Avenue, more particularly ciescribed as : APN 621-500-009 �1'HEREr'�S, said application has complied with the requirements of the "City of Palm Desert Environmental �uality Procedure Resolutian No. 78-32," in that the Director of Environmental Services has determined on April 17, 1978, that the project will not have a significant adverse effect on the environment and the appeal period has expired; and, �1'HEREAS, the City Council did take into consideration the Tenta- ti��e hiap as submitted, and the reports of the various reviewing agencies; and, jNFiEREAS, the City Council did find that the subject Tentative D4ap does substantially comply with Chapter 26 of the City of Palm Desert 1lunicipal Code, and the State of California Subdivision A-1ap Act, as amended; and, j9�iEF�EAS, the City Council did find that the subject Tentative hlap does comply with the adopted General Plan and the Palm Desert Zoning Ordinance; and, jVHEREAS, the City Council did find that the site is physically suitable for the type of development proposed; and, Z9I�EI�EAS, the City Council did find that the site is physically suited for the proposed density of the development; and, �yHEREAS, the City Council did find that the design of the sub- division and the proposed improvements are not likely to cause sub- stantial environmental damage or serious health problems. N0�9, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: l. That the above recitations are true and correct and consti- tute the findin�s of the Council in this case; 2. That it does hereby require that the applicant pay a fee in an amount determined under the Ordinance provisions in order to comply «•ith Article 26.15 of the City`s Subdivision Ordinance re�arding the public facilities requirement; c RESOLUTION N0. 78-74 Page Two 3. TT 12556 _l � S Standard Conditions: Pa�e Three 1. The development of the property described herein shall be sub- ject to the restrictions and limitations set forth herein «•hich are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighiing as re- quired by Ordinanee and the Director of Public �tiorks, shall be installed in accordance with City standards. 3. Access rights on Cook Street and 44th Avenue shall be offered to the City as a dedication on the Final 11ap. 4. The C.C.&R's for this development shall be submitted to the Director of Public Works for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map the applicant shall submit to the Director of Public S'�orics: a. The document to convey title. b. Covenants and restrictions to be recorded. c. b7anagement and maintenance agreement to be entered into �vith the owners of the units of the project. 5. ` 6. 7. � Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on-site utilities, including cable TV, shall be placed un�er- ground and shall be completely concealed from view except cercain appurtenances as map be approved by the Director of En�-ironmental Services. 9. Complete plans and specifications shall be submitted as required by Ordinance to the Director of Public �Vorks �or checking and ap- proval before construction of any impro�ements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 10. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular ac- cess to all buildings. An adequate number of fire hydrants with re�uired fire flows shall be installed as recommended by the Fire Marshal. 11. 12. 13. 14, All requirem�nts of the City Fire Marshal shall be met as a part of the development of this tract per attached memorandum. Draina�e shall be subject to approval of the Director of Public i�orks. Applicant shclll provide en�ineered data as requ�sted. All requirc�ments of the Plannin�; Commission action on related case No. llP 06-78 shall be met as a pa.rt of the develo�ment of this tract. The applicant shall have t�velve (12) months from the date of the appor��al or conditional approval of the tentative map for filing of the final map unless an e�tension of time of up to ei�hteen (18) months is gra,nted by a Resolution of the City Council. 16. Applicant shall pa.y fees into the Palm Desert Planned Local Drainage Facilities Fund in an amount to be determined by the _ provisions of Ordinance No. 175. 17. Applicant shall pay a fee in an amount determined under the Ordinance provisions in order to comply with Article 26.15 of the City's Subdivision Ordinance regarding the public facilities requirement. Special Con.ditions: l. Applicant shall contribute $9,000.00 to the signalization fund of Palm Desert. 2. Applicant shall provide for drainage at the corner of the subject site adjacent to Lot 58. 3. Traffic safety lighting shall be provided at both entrances to this subdivision. r 4. All improvements shall conform to the standard draw�ings and specifi- cations of the City of Palm Desert. 5. Rights-of-way shall be dedicated along 44th and Cook Streets to enable a 55 foot right-of-way for one half street section. 6. The street widths as indicated are acceptable provided a 5 foot easement ic shown on each sicie of the street. 7. A right-of-way dedication of 25 feet shall be provided on the westerly boundary of this tract to enable the liaster Storm Drainage plan to be implemented; namely, the Toro Peak No, One Outlet into the Whitewater Wash. 8. Install a water system capable of delivering 250o GPM fire flow from any fire hydrant for a two hour c�uration in addition to domestic supply. ?he cor�putation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. 2. Install Riverside County super fire hydrants located at each street intersection (a} but not greater than 40o feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer sh�c�ll furnisn the origiral and three (3) copies of the water system plan i:o the Fire Marshal for revie��. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, a�ith the follawing certification: "I certify thai the design of the water system in Tract No. 12556 is in accordance with the requirements prescribed by the Fire Marshal."
