A RESOLUTION OF THE CITI' COUNCIL OF THE CITY
OF PALA4 DESERT, CALIFORNIA, SETTING FORTH ITS
FINDINGS AND APPROVING AN AMENDMENT TO THE STAN-
DARD CONDITIONS AND SPECIAL CONDITIONS FOR CASE

�tiIIER�AS, the City Council of the City of Palm Desert, California,
did hold a duly noticed Public Hearing on July 13, 1978, to consider a
request by� SILVER SPL'R ASSOCIATES for approval of an amendment to the
Standard Conditions of Approval and Special Conditions of Approval for
Case No. TT 5565 in order to permit Portola Avenue to become a private
roadway from its intersection with biesa View Drive extended westerly to
Fiighway 74; and,
�tiHEREAS, at said Public Hearing, upon hearing and considering
the testimony and arguments, if any, of all persons desiring to be heard.
said Council did find the follo��ing facts and reasons to exist to approve
the request:
1.. The proposed amendment to the Conditions of Approval will
not adversely effect the original intent of the PR zone
district in which the project is located.
2. The proposed amendment to the Conditions of Approval will
not adversely effect the public health, safety, or welfare.
3. The proposed amendment to the Conditions of Approval «�ill
i'acilitate the implementation of the General Plan Amendment
to reduce the status of that portion of Portola Avenue
that lies within the subject tract to a local street.
NO�ti, TH�REFORE, BE IT RESOLVED by the City Council of the Cit1�
of Palm Desert, as follo«�s:
l. That the above recitations are ture and correct and consti-
tute the i'indings of the Council in this case.
2. That it does hereby approve an amendment to the Standa.rd
Conditions of Approval for Case No. TT 5565 as indicated on E�hibii A
aild as incorporated into the Condit�ons of Approval as indicated on
E�hibit B for the reasons set out in this resolution.

2. Re�-ise Special Condition No. 6 to read, "Plans for the Security
Gate Complex at niesa View Drive and Portola Avenue shall have the
approval of the City Fire riarshal."
3. Delete Special Condition No. 10.
4. Delete Special Condition No. 11.
5. Re�-ise Special Condition No. 17 to read, "Storage Space for a min-
imum of eight (S) autamobiles, shall be provided on Portola Avenue
���est of �iesa Vie�i Drive."

All improc�ements shall conform to the requirements of the City
Standard Speci:fications and the City Engineer.
Tract shall be processed in accordance with all applicable pro-
�•isions of Ordinance 1.25, the Subdivision Ordinance.
3. Prior to submittal of the Final ,l1ap, the applicant shall provide
the Cit3� with a list of proposed street names with at least three
alternatives. The approval of the final street names sha,ll be made
by the Director of Environmental Services.
4. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions of
a1.1 municipal ordinances and State and Federal statutes now in force.
5. The C.C.&R's for this development shall be submitted to the City
Attorney for re��iew and approval prior to the issuance of any build-
ing permits. Prior to recordation of the final subdivision map,
the applicant shall submit to the Director of Environmental Services
the following documents which shall demonstrate to the satisfaction
of the Planning Cammission that the total project will be developed
and maintained in accordance with the intent and purposes of the
approval:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. 1lanagement and maintenance a�reement to be entered into ���ith
the owners of the units of the project.
6. In order to maintain reasonable fire protection during construction
period, the subdivider shall mai�ztain passable vehicular access to
all buildings, and adequate fire hydrants with required fire flo��•s
shall be installed as recommended by the Fire Department.
7. The u�ater s��stem shall be signed by a re�istered civil engineer and
appro�-ed by the �cater company, «�ith the following certification:
"I certif5� that the design of the w�ater system of Tract No. 5565 is in
accordance ��ith the requirements prescribed by the City Fire Itiarshal."

ments of the respective service districts.

Any and all on-site storage yards shall. be eliminated at time of
completion.
]. The total number of d��ellin� unit lots shall be limited to 217.
2. In order to meet the neighborhood and public facilities require-
ment oi' the Subdi��ision Ordinance, applicant shall commit in
writing to dedication of reauired park land for this phase of the
development in the future at a mui.ually a�reeable location to
the City of Palm Desert and the applicant. Such committment shall
be made prior to submittal oi' the Final Tract I�Iap and transfer of
title shall occur in conjunction �vith the recordation of the
Final '�iap or at a later date to be specified by the City of Pa].m
Desert.
3. E�isting on-site overhead utilit,y distribution lines shall be under-
grounded per the requirements o1' Article 25.32-6 of the Palm Desert
Zoning Ordinance.

6. Drainage facilities shall be sufficient to maintain at least one
lane of traffic free of ��ater on local streets in a one-year storm
and t«•o lanes for collectors. �1'ater shall not be allowed to top
the curbs in a ten-,year storm and shall not be allowed to flood
any building pads in a 100-ycar storm. The developers shall install
drainage facilities satisfactor5� to the City Engineer to carry run-
off from Drainage Area No. 5. Said drainage area is described in
the Proposed City I�4aster P1an of Drainage dated June, 1976. This
schedule for construction shall be subject to approval of the City
of Palm Desert.

t��een Dlariposa and Irontree Drive. From the outset of construction
of the tract, complete dust control shall be maintained.
Landscapin� along the souih side of Portola Avenue between �4ariposa
