A RESOLUTION OF THE CITY COiJI�TCIL OF THE CITY
OF PALhi DESERT, CALIFORNIA, ANNOUNCING ITS
FINDINGS AND DENYING THE �PPEAL OF IIOPE LUTH-
ERAN CIiURC�I OF A CONDITION OF APPROVAL OF CASE
NO. CUP 04-75 �GHICH NOULD REQUIRE CURBS, GUTT�RS
�ND SIDE1`'ALKS ALONG THE PORTOLA FRONTAGE OF THE
SIT�.
CASE Iv'0. CUP 04-78 (Anpeal)
�9HERE�S, the Planning Commission of the City of Pa,lm Desert,
California, did approve a Conditional L'se Permit CUP 04-78 apnro�•inr;
ail o��erall Development Plan for a church-school complex, partiall5�
developed, at the northeast corner oi Port�la A��enue and Fair«•ay Drive;
and,
�1'HERLAS, the Conditions of Approval of said Canditional Lse
Permit did include Special Condition No. 2�;�hich rec�uires that the ap-
plicant install curbs, gutters, and side�valks along the Portola frontage
of the site as a part of the developmcnt of Phase II of the project; and,
�1�HEREAS, HOPE LtiTH�RAv CHL'RCH did file an a.ppeal of Special Con-
dition \o. 2 in a timely manner; and,
StiHEREAS, the City Council of the City of Palm Desert, California,
did hold a duly noticed Public Hearing on July 13, 1978, to consider
the appeal; and,
�t'IiERE�S, after hearing and considering all of the testimony re-
garding this matter the Council did find the follo�•ing facts to e�ist
to justify denying the appeal:
l. The appellant requested that the Condition of Approval
requiring improvements along Portola Avenue be deleted
at the Public Hearing for Case No. CIIP 04-78 bef:ore the
Planning Commission. At that hearing the Commission had
suificient information to evaluate the situation and
subsequently make a reasona.ble jud�ment that required
the improvements. No new information has been presented
to «�arrant a reversal of the Co�uiiiission's decision.
2. The installation of public improvements is a standard
condition of appro�al for projects of this magnitude
within the City, a fact emphasized b5� the Planning
Commission at their meetin� of n4ay 30, 1978.
3. The City has required the installation of public icn-
provements i�or al 1 ne��� pro j ects as a means of achie��in�
some continuity alon� the major art.eries.
