A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TEP�TATIVE
TRACT MAP TO ALLOW 10 LOTS FOR CONDOMINIUM PURPOSES.
CASE N0. TT 14417
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 23rd day of August, 1979, hold a duly noticed Public Hearing to
consider the request of TRANSCOPIC DEVELOPMENT CORPORATION for approval of
a Tentative Tract Map to create 10 lots for condominium purposes to provide
for 9 dwelling units and common open space, on approximately 2.2 net acres
within the PR-6, S.P. (Planned Residential, Max. 6 d.u./ac., Scenic Pre-
servation Overlay) zone located on the north side of 44th Avenue, approx-
imately 610 ft. west of Cook Street, more particularly described as:
APN 621-500-007
WHEREAS, the Planning Commission, by Resolution No. 515, has
recommended approval subject to conditions; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-
32", in that the subject project has been previously assessed under Case No.
DP 07-79 and no further evaluation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
City Council did find the following facts and reasons to exist to recommend
approval of the Tentative Tract f�ap:
l. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and
the State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development
proposed.
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious heaith problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That it does hereby approve the above described Tentative
Map No. TT 14417 for the reasons set forth in this Resolution
and subject to the attached conditions.
FURTHER, BE IT RESOLVED that the recommended conditions of approval
do include a requirement that the applicant pay in-lieu fees to comply with
the requirements of Article 26.48 of the City of Palm Desert Subdivision
Ordinance. In return, the C�ty Council hereby agrees to use said fees for
park purposes in conformance with an adopted master plan, within five (5)
years of the recordation of the final map.

1. The development of the propert� described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all muni�ipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
Ordinance and the City Engineer shall be installed in accordance �•�ith Cit�
standards.
3. Prior to submittal of the Final htap, the applicant shall provide the
Department of Environmental Services with a list of proposed street names �ii�h
at least three alternatives. The approval of the final street nare shall be
made by the Director of Environmental Services. �
4. Access rights 44th Avenue, except for approved private street entrance shall
be offered to the City as a dedication on the Final �lap.
5. � The C.C.&R.'s for this development shall be submitted to the City Engineer for
revie��� and aporoval prior to the issuance or" any building permits. Prior tu
recordation of the final subdivision map, the applicant shall submit to the
City Engineer:
a. The document to convey title.
b. Covenants and restriciions to be recorded.
c. �1anagement and maintenance agreement to be entered into
with the owners of the units of the project.
6. Improvem�ent plans for water and set��er systems shall r�eet the requirements of �he
respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having jurisdiction
over the subject area.
8. All dedicated land and/or easements required by this appro��al snall be granted
to the City of Palm Desert, without cost to �he Cit/ and free of all liens and
encumbrances.
9. All on-site utilities, including cable TV, shall be pl�aced urder;reund and
shall be completely concealed frcrn vie�:r exce�t certain appurtenances as ma� �e
approved by the Director of Environr�ental Services.
10. Complete plans and speci`ications shall be suCr�itted as required by Ordirance
to the City Engine�r for checking and aporoval before construction of an�
improvements is cemmenceci. The subdivider shall sub;;�it "as-built" plans pr�or
to acceptance of the subdivision improve:nents by the City.
I1. In order to maintain r�eason�ble fire �rotection d�ring the construction peried,
th�e subdivider shall maintain passable venicular access to all buildings. An
, adequate nu�nber of fire h�drants �•rith re�Uli'C'd �ire rlo�:�s shall be installed as
�. . recorrmended by the Fire i�larshal.
12. Prior to recordation of the Final i•?a�, the developer sf�all furnish the oriciral
and three (3) copies of the �•rater system plar� to t�e �ire t�'arsl�al for revie�,��.
13. All requirements of the City Fire P•larshal fro�� his letter of July 13, 1979,
shall be met as a part of the development of this tract.
14. The ti•�ater system shall be sigred by a registered civil engineer and approved
by the ti��ater corrpany, 4l1tFl the follo�.�in� certification: "I certify that the
design of the �,ater system of Tract i1o. 14417 is in accordance �•rith the require-
ments prescribed by the City Fire i•iarshal."

15. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineered data as requested.
16. All private streets shall be inspected by the Engineering Depart�ent and a
Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the Development Plan
07-79, and related Design Review Case Mo. 174��F shall be �et as a part of the
development of this tract.
18. The total number of lots shall be limited to 9 for d��elling unit purposes,
and other lots for open spaces as deemed necessary.
19. The applicant shall have t�•�elve (12) months from the date of the approval or
conditional approval of the tentative map for filing of the final map unless
an extension of time of up to eighieen (18) months is granted by a Resolution
of the City Council.
20. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the Final Map.
21. Developer shall pay in-lieu fees for park and recreation purposes to comoly
with the requirements of Article 26.48 of the City of Palm Desert Subdivision
Ordinance.
SPECIAL CONDITIO�dS OF APPROVAL
1. The requirement of the PR zone for 50;0 of the net site to be maintained in
common use open space shall be observed by this tract. Proposed Lot No. 10
shall equal 50`,0 of the net site exclusive of private street "A", driveways,
parking areas, and individual d�•relling unit lots.
2. No final map shall be recorded until the Director of Public blorks has
specifically revieuied and approved construction dra�,�ings for the private
street access control to ensure design acceptability.
3. Complete street dedication and improvements shall be provided on 44th Avenue,
�as required by the Director of Public Works.
4. Subdivider shall contribute 5450 to the Signalization Fund of the City of
Palm Desert.
5. Safety street lighting as required and approved by the Director of Public
Works shall be installed at the intersection of private street "A" and
44th Avenue.
6. The final map shall provide for an 8-ft. drainage easement along the northern
tract boundary, with outlets provided in the perimeter tract wall at the north-
west corner. The purpose of said easement is to accomodate storr� tivater f1c�•�s
originating to the west of the subject tract.
7. Exce�t where provided by others, the entire site shall be bounded by a minimum
6-ft. high solid masonary wall with private street entrance permitted to
44th Avenue, as approved through the Design Revie�•� process.
I 8. The 20-ft. ease�nent required along 44th Avenue (Case �lo. DP 07-79, Special
! Condition No. 1) shall be indicated on this map. Improvements for this
�. easement shall be approved by the Design Revie�.i Boar•d and Director of Public

Provide the following fire protection in accordance with the Uniform Fire Code:
1. Install a water system capable of delivering 2500 GP�q fire flow from any fire hydrant
for a two hour duration in addition to domestic supply. 7he computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the tirre of ineasurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome ,yello�•�,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final mao, the developer shall furnish the original and
three (3) copies of the ��ater system plan to the Fire P�arshal for revie��.
4. The water system plan shall be signed by a registered civil engineer and approved by
the water company, ti�iith the follo,vina certifications: "I certify that the design of
the water system in Tract No. 14.417 is in accordance �ii�h the requirements prescribed
by the Fire P�arshal." Upon approval, the original plan will be returned to the
developer.
5. Prior to delivery of combustible materials to the building site, the required �•,ater
system shall be installed, operatir,g and delivering the required flow.
