HomeMy WebLinkAboutCC RES 79-105u RESOLUTION N0. 79-105 A RESOLUTIOV OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONTRACT FOR BUILDING INSPECTION SERVICES. WHEREAS, the City of Palm Desert is in need of Specialized Services for the purpose of building inspection; and WHEREAS, such services have been offered to the City under the terms and conditions stipulated by separate agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, hereby approves a contract for Building Inspection Services with Mr. John L. Young, said contract attached and made a part hereof as Exhibit "A". FURYHER, BE IT RESOLVED that the City Manager is hereby authorized to execute said contract on behalf of the City of Palm Desert. GILLT�N, CITY CL� City of Palm �esert, Califo ia Resolut�or No. 79-105 ATTACHMENT "A" BUILDING INSPECTION SERVICES AGREEMENT I This agreement is made and entered into this 4th day of September � 1979 , by and between John L. Young and the City of Palm Desert. II WHEREAS, the City requires a Building Inspector to provide inspection services and on behalf of the City of Palm Desert. WHEREAS, John L. Young agrees to perform such services under the terms and conditions as set forth in this contract. III IT IS AGREED AS FOLLOWS: 1. John L. Young agrees to perform any and all services generally performed by Building Inspectors in their usual line of work. 2. John L. Young shall provide such services as are directed and re- quested by the City of Palm Desert. 3. This contract shall be for a maximum period of 6 months and may be terminated before such time by mutual consent of both parties by either party giving at least 30 days prior notice. 4. As compensation for his service performed hereunder, the City shall pay John L. Young the sum of $12.50 per hour for each hour worked. 5, The parties agree and intend that the relationship between them created by this contract is that of employer-independent contractor. John L. Young is not an employee of employer, and is not entitled to the benefits provided by employer to its employees, including, but not limited to, group insurance and pension plans. The City assumes no obligation to withold taxes from -1- � the compensation paid to contractor. 6. John L. Young will perform his services for employer in accordance with currently approved methods and ethical standards applicable to his pro- fessional capacity. John L. Young shall be free to practice his profession for others during those periods when he is not working under this contract for employer. Except that in no case shall he perform any services for any person or firm doing business with the City of Palm Desert.
