HomeMy WebLinkAboutCC RES 79-116RESOLUTION N0. 79-116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING AN AP'IENDPIEI`IT OF STANDARD CONDITION N0. 4, OF CITY COUNCIL RESOLUTION N0. 79-45 PURSUANT TO TIiE PROVISIONS OF SECTION 26.20.150 OF THE PALP1 DESERT MUNICIPAL CODE. WHEP.�AS, the City Council of the City of Palm Desert, California, did receive a request from DAME-DOTY DEVELOPP�ENT COMPANY for an amendment of an approved Tentative Tract P�ap condition pursuant to the provisions of Section 26.20.150 of the Palm Desert Municipal Code, to a11ow a driveway access to the recreational vehicle storage area on Portola Avenue for a 653 dwelling unit project on approximately 233 acres located on the west side of Portola Avenue and northerly of the Whitewater Channel, more particularly described as: APN 621-350-016 621-350-017 621-350-018 621-350-020 621-350-023 621-200-020 621-200-032 621-200-033 WH�REAS, the City Council is empowered to grant amendments to Tentative Tract Maps in Section 26.20.150 of the Palm Desert T'Iunicipal Code; and WfIEREAS, the City Council did find the following reasons to exist to justify the granting of said amendment: l. � Granting the amendment will not in any way adversely affect the public health, safety or general welfare. The applicant is not proposin� any changes to the project NOW, THEP.EFORE, BE IT P.ESOLVED, by the City Council of the City of Pa1r� Desert, California, as follows: 1. 2. That DAME-DOTY DEVELOPME?�1T C0. is hereby granted an amendment of Tentative Tract ilap No. 13381. That Stanciard Condition No. 4 of City Council Resolution �10. 79-45 is hereby amended to read as follows "Access rights on Portola Avenue (except for one private Street entrance, one emergency access, and one recrea- tional vehicle storage access) sha11 be offered to the City as a dedication on the final map."
