HomeMy WebLinkAboutCC RES 79-128� RESOLUTION N0. �9-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR AN AMEND- MENT OF SPECIAL CONDITION N0. 8 OF CITY COUNCIL RESOLUTION N0. 78-120 ON 18.5 ACRES OF LAND, GENERALLY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF PORTOLA AVENUE. CASE N0. TT 12181-2 WHEREAS, the City Council of the City of Palm Desert, California, did on the 25th day of October , 1979, hold a duly noticed Public Hearing to consider a request by Lewis Homes for approval of an amendment of Special Condition No. 8 of City Council Resolution No. 78-120 on 18.5 acres of land, generally located at the southwest corner of the intersection of Portola Avenue, more particu- larly described as: The southerly portion of APN 621-360-004 WHEREAS, at said Public Hearing, upon hearing and consider- ing the testimony and arguments, if any, of all interested persons desiring to be heard, the City Council did find the following facts and reasons to exist to deny the amendment: 1. A 6 ft. high masonry wall along the perimeter of the site is a minimum standard desirable for this type of development. 2. The existing conditions adjacent to the site warrant a masonry wall for upgrading of the area and enjoyment of the future resi- dents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That the Planning Commission does hereby deny this request for an amendment of conditions of TT 12181-2 for the reasons stated above.
