HomeMy WebLinkAboutCC RES 79-139RESOLUTION N0. 7q-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDING AND DENYING AN APPEAL OF A PLANNING COMMISSION DENIAL OF A CONDITIONAL USE PERMIT AMENDMENT TO ALLOW AN ADDITIONAL DRIVEWAY ACCESS FOR PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF HIGHWAY 74 AND EL PASEO. CASE N0. CUP 09-78 (Amendment) WHEREAS, the City Council of the City of Palm Desert, California, did on the 29th day of November, 1979, hold a duly noticed Public Hearing to consider the request by Bank of Indio (Hughes Investments) for approval of an appeai of a Fianning Commission Denial of an amendment of an approved Conditional Use Permit to allow an additional driveway entrance on E1 Paseo to facilitate access to a proposed bank building on approximately 5.4 acres (total Hughes Investment site) within the C-1, S.P. (General Commercial, Scenic Preservation Overlay) zone, generally located at the northeast corner of Highway 74 and E1 Paseo, more particularly described as: APN 627-192-036 (Previously 627-192-27) WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", �n that the Director of Environmental Services has determined that the project has been previously assessed in connection with the original use permit review, and that further documentation is not deemed necessary; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said council did find the following facts and reasons to exist to justify the denial of said appeal. 1. The proposed location of the conditional use amendment access and the conditions under which it could be operated and maintained wiil be detrimental to the pubiic health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed conditional use does not comply with the goals, objectives, and policies of the City's adopted General Plan. 3. The proposed conditional use does not comply with the goals, objectives, and policies of the City's adopted Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. 2. That the above recitations are true and correct and constitute the findings of the council in this case; That the Conditional Use Permit (CUP 09-78, Amendment) is hereby denied.
