A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE
TRACT MAP TO CREATE A 37 LOT SUQDIVISION FOR
RESIDENTIAL CONDOMINIUM PURPOSES.
CASE N0. TT 14805
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 13th day of December, 1979, hold a duly noticed Public Hearing
to consider the request of KAUL CONSTRUCTION for approval of a Tentative
Tract Map to create a 37 lot subdivision for residential condominium
purposes on approximately 7.2 acres within the PR-5 (Planned Residential,
max. 5 d.u./ac.) zone generally located on the southside of Country Club
Drive, between Monterey Avenue and Portola Avenue more particularly
described as:

WHEREAS, the Planning Commission, by Resolution No. 548, has recom-
mended approval subject to conditions; and
ti�HEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 78-32",
in that the subject project has been previously assessed under Case No.
DP 03-79 and no further evaluation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard,
said Planning Cornmission did find the following facts and reasons to exist
to recommend approval of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and
the State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does comply with the adopted
General Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of develop-
ment proposed.
4. The design of the subdivision and the proposed improve-
ments are not likely to cause substantial environmental
damage or serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Council in this case.
2. That it does hereby approve the above described Tentative Map
No. TT 14805 for the reasons set forth in this Resolution and
subject to the attached conditions.
FURTHER, BE IT RESOLVEQ that the conditions of approval do include
a requirement that the applicant pay in-lieu fees to comply with the
requirements of Article 26.48 of the City of Palm Desert Subdivision
Ordinance. In return, the City Council hereby agrees to use said fees
for park purposes in conformance with an adopted Master Plan, within five
(5) years of the recordation of the Final Map.

1. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes now in
force, or which hereafter may be in force.

STANDARD CONDITIONS OF APPROVAL

5. The C.C. & R's for this development shall be submitted to the Director
of Environmental Services for review and final approval by the City
Attorney prior to the issuance of any building permits. Prior to re-
cordation of the final subdivision map, the applicant shall submit to
the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded (Which have been approved).
c. Management and maintenance agreement to be entered into with the
owners of the units of the project (Which has been approved).
6. Improvement plans for water and sewer systems shall meet the require-
ments of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
9. Al1 on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before con-
struction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. As adequate number of fire hydrants with required fire
flows shall be installed as recommended by the Fire Marshal.
12. Prior to recordation of the Final Map, the developer shall furnish
the orignal and three (3) copies of the water system plan to
the Fire Marshal for review.
13. All requirements of the City Fire �larshall from his letter of August 14,
1979, shall be met as a part of the development of this tract.
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 14805
is in accordance with the requirements prescribed by the City Fire
Marshal."

15, Drainage shall be subject to aoproval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering Department
and a Standard Inspection Fee shall be paid.
11. All requirements of the Planning Commission action on the Development
Plan 03-79 shall be met as a part of the development of this tract.
18. The total number of lois shall be limited to 36 for residential unit
purposes and other lots for undivided interest common use as deemed
appropriate and necessary.
19. The applicant shall have twelve (12) months from the date of the
approval or conditional approval fo the tentative map for filing
of the final map unless an extension of time of up to eighteen (18)
months is granted by a Resolution of the City Council.
20. Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Map.
21. Developer shall dedicate land, pay a fee in lieu thereof, or a
combination of both, at the option of the City Council, as a
condition of the Final P�ap, for park and recreation purposes. The
City shall commit the use of any such fees received within a five
year period.
SPECIAL CONDITIONS
1. The map shall be revised to reflect an 8 ft. wide sidewalk on
Country Club Drive.
2. Safety street lighting shall be installed at the tract entrance
and Country Club Drive as required and approved by the pirector
of Public Works.
3. Subdivider shall contribute $1,800 into the Signalizatian Fund, and
�1,500 per gross acre into the Drainage Fund of the City of Palm Desert.

Provide the following fire protection in accordance with the Uniform Fire Code:
1. Install a water system capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computa-
tion shall be based upon a minimum of 20 psi residual operating pressure in
the supply main from which the flow is measured at the time of ineasurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire ��larshal for review.
4. The water system plan shall be signed by a re�istered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 14.�05 is in accordance with the require-
ments prescribed by the Fire �larshal." Upon approval, the original plan will be
returned to the developer.
5. Prior to delivery of combustible materials to the buiiding site, the required
���ater system shall be installed, operating and delivering the required flow.
6. This development lies beyond the 5 minute response area.
7. Alternate access for emergency vehicles must be provided.
