A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS
AND GRANTING A ONE (1) YEAR EXTENSION OF TIME 0� THE
APPROVAL OF A TENTATIVE MAP TO CREATE 13 LOTS TO PROVIDE
FOR 12 CONDOMINIUt� UNITS AND COMMON AREA ON APPROXIMATELY
1.39 ACRES GENERALLY LOCATED ON THE EAST SIDE OF OCOTILLO,
SOUTH OF TUr1BLEWEED.

� WHEREAS, the City Council of the City of Palm Desert, did
receive a verified application from LINSCO AGENCIES, LTD., requesting
approval of a 13 lot subdivision to provide for 12 condominium units
and common area and a written request with the approval period for a
one (1) year time extension on approximately 1.39 acres generally
located on the east side of Ocotillo, south of Tumbleweed, more
particularly described as:
Lots 10, 11 and 12 in
Block G of Palm Desert
Unit No. 3; and
WHEREAS, said original application approval has complied with
the requirements of the "City of Palm Desert Environmental Quality
Procedure Resolution No. 77-7", in that the Director of Environmental
Services has determined on February 13, 1978, that the project will
not have a significant adverse effect on the environment and the
appeal period has expired; and
WHEREAS, the City Council did take into consideration the
Tentative Map as originally approved, and the reports of the various
reviewing agencies; and
WHEREAS, the City Council did find that the site is physically
suitable for the type of development proposed; and
,
WHEREAS, the City Council did find that the subject Tentative
Map does substantially comply with Chapter 26 of the City of
Palm Desert Municipal Code, and the State of California Subdivision �
Map Act as amended; and
WHEREAS, the City Council did find that the subject Tentative
Map does comply with the adopted General Plan and the Palm Desert
Zoning Ordinance; and
WHEREAS, the City Council did find that the site is physically
suited for the proposed density of the development; and
WHEREAS, the City Council did find that the design of the
subdivision and the proposed improvements are not likely to cause
substantial environmental damage or serious health problems; and
WHEREAS, the City Council has examined any new information
relative to this extension of time, and imposed added conditions
where appropriate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Desert, as follows: '
l. That the above recitations are true and correct and
constitute the findings of the Council in this case;
2. That it does hereby require that the applicant pay a
fee in an amount determined under the Ordinance provisions in order
to comply with Article 26.15 of the City's Subdivision Ordinance
regarding the public facilities requirement, as pr�viously required
in City Council Resolution No. 78-30;

3. That it does hereby approve a one (1) year extension of
time for the above described Tentative Map No. TT 12050, subject
to fulfillment of the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the
Palm Desert City Council, held on this22nd day of February , 1979, �

4. The C.C.R:R's for this de�-elopment sh�ll be sub��itted to the Director

buidin� permits. Pi-ior to recordation of the final subdivisicn rr.an,
the applicant shall submit to the Director of Public «'orks:
a. The docur�ent to con��ey title.
b. Co�enants and restrictions to be recorded.
c. ;�ianage:nent and maintenance a�ree:nent to be entered into �vith
the o��•ners of the units of th� project.
5. Impro�e::�ent plans for �vater arid sen•er system shall meet the re-
quirements of the respective service districts.
6. Area shall be anneYed to appropriate Ir�provement Districts ha�ir.�
jurisdiction over the subject area.
7. All dedicated land and/or easenents required by this apnroi•al s::�ll
be granted to the City of Palm Desert, n•ithout cost to the Cit�
and free of all liens and encurr�brances. `
8. All on-site utilities, including cable TV, shall be placed unde�--
ground and shall be cor�pletely concealed from vieiv e:;cept certain
ap�urtenances as may be appro�•ed by the Director of Environrr.ental
Ser��ices. �
9. Complete plans and specifications shall be subr:iitted as required b��
Ordinance to the Director of Public �'�orks for checking and appro�-al
before construction of any imnrovements is comrnenced. The su�-
divider shall submit "as-built" plans prior to acceptance of tt:e
subdivision inpro�•ements by the City.
10. In order to maintain reasonable fire protection durina the const:uc-

15. The applicant shall have twelve (12) months from the date
of the approval or conditional approval of the tentative
map for filing of the final map unless an extension of time
of up to eighteen (18) months is granted by a Resolution of
the City Council.
16. Applicant shall pay fees into the Palm Desert Planned Local
Drainage Facilities Fund in an amount to be determined by
the provisions of Ordinance No. 175.
Special Conditions:
l. Applicant shall install curbs, gutters, tie-in paving and
sidewalks on Ocotillo Drive, acceptable to the Director of
Public Works.
2. Applicant shall contribute $500.00 to the City of Palm Desert
Signalization Fund.
